Notice of the Supreme People's Court on Issuing the Several Opinions on Regulating the Trial Work Relations between the People's Courts at Different Levels
(No.61 [2010] of the Supreme People's Court)
The higher people's courts of all provinces, autonomous regions and municipalities directly under the Central Government; the Military Court of the People's Liberation Army; and the Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uygur Autonomous Region:
The Several Opinions of the Supreme People's Court on Regulating the Trial Work Relations between the People's Courts at Different Levels, as adopted at the 1493rd meeting of the Judicial Committee of the Supreme People's Court, are hereby issued to you for your earnest compliance and implementation in light of the trial practice.

Several Opinions on Regulating the Trial Work Relations between the People's Courts at Different Levels
To further regulate the trial work relations between the people's courts at different levels, specify the scope and procedures of supervision and guidance, and guarantee the independent exercise of the judicial power by the people's courts at all levels according to law, these Opinions are formulated in accordance with the provisions of the Constitution of the People's Republic of China, the Law of the People's Republic of China on the Organization of the People's Courts and other relevant laws and in light of the trial practice.

各省、自治区、直辖市高级人民法院,解放军军事法院,新疆维吾尔自治区高级人民法院生产建设兵团分院:
最高人民法院《关于规范上下级人民法院审判业务关系的若干意见》已经最高人民法院审判委员会第1493次会议通过,现印发给你们,请结合审判工作实际,认真遵照执行。

关于规范上下级人民法院审判业务关系的若干意见
为进一步规范上下级人民法院之间的审判业务关系,明确监督指导的范围与程序,保障各级人民法院依法独立行使审判权,根据《中华人民共和国宪法》和《中华人民共和国人民法院组织法》等相关法律规定,结合审判工作实际,制定本意见。
Article 1 The Supreme People's Court shall supervise and guide the trial work of local people's courts at all levels and special people's courts. The people's courts at a higher level shall supervise and guide the trial work of the corresponding people's courts at lower levels. The scope, methods and procedures of supervision and guidance shall comply with legal provisions.

   第一条 最高人民法院监督指导地方各级人民法院和专门人民法院的审判业务工作。上级人民法院监督指导下级人民法院的审判业务工作。监督指导的范围、方式和程序应当符合法律规定。
