Notice of the General Office of the State Council on Issuing the Working Rules for the Revision of Urban Master Plans

The people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all ministries and commissions of the State Council and all institutions directly under the State Council:
The Working Rules for the Revision of Urban Master Plans have been approved by the State Council and are hereby issued to you for your implementation.

Working Rules for the Revision of Urban Master Plans
To maintain the solemnity of urban master plans and regulate the working procedures and contents of revision of urban master plans reported to the State Council for examination and approval, these Working Rules are formulated in accordance with the Urban and Rural Planning Law of the People's Republic of China.

各省、自治区、直辖市人民政府，国务院各部委、各直属机构：
《城市总体规划修改工作规则》已经国务院同意，现印发给你们，请认真贯彻执行。

城市总体规划修改工作规则
为了维护城市总体规划的严肃性，对报经国务院审批的城市总体规划修改工作程序和内容进行规范，依据《中华人民共和国城乡规划法》制定本工作规则。

I. These Working Rules shall apply to the revision of urban master plans reported to the State Council for examination and approval. The working rules for the revision of other urban master plans shall be formulated by the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government pursuant to these Working Rules by analogy.
| | 一、报经国务院审批的城市总体规划修改适用本工作规则。其他城市总体规划修改工作规则，由省、自治区、直辖市人民政府参照本工作规则制定。

II. The revision of urban master plans shall be governed by the Scientific Outlook on Development, safeguard the legitimated rights and interests of the people, correctly deal with the relationship between the partial and the whole, the near future and the long term, the needs and possibilities, as well as the development and protection, and promote the comprehensive, coordinated and sustainable development of urban economy, society, ecology, resources and environment.
| | 二、城市总体规划修改，要贯彻落实科学发展观，维护人民群众合法权益，正确处理局部与整体、近期与长远、需要与可能、发展与保护的关系，促进城市经济社会与生态资源环境全面协调可持续发展。

III. Under any of the following circumstances, the organ organizing the formation may revise the urban master plan according to the prescribed authority and procedures:
| | 三、有下列情形之一的，组织编制机关可按照规定的权限和程序修改城市总体规划；
|
1. changes in the urban and rural plan established by the people's government at a higher level require for modifying the plan;
| | （一）上级人民政府制定的城乡规划发生变更，提出修改规划要求的；
|
2. adjustment of administrative divisions requires for modifying the plan;
| | （二）行政区划调整确需修改规划的；
|
3. a significant construction project approved by the State Council requires for modifying the plan;
| | （三）因国务院批准重大建设工程确需修改规划的；
|
4. the modification is necessary upon evaluation; or
| | （四）经评估确需修改规划的；
|
5. other circumstances under which the modification is deemed necessary by the State Council.
