Notice of the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration on Issuing the Interim Measures for the Administration of the Collection and Use of the Renewable Energy Development Fund

The public finance departments (bureaus), development and reform commissions, energy bureaus and price bureaus of all provinces, autonomous regions and municipalities directly under the Central Government; the financial supervision commissioner's offices of the Ministry of Finance in all provinces, autonomous regions and municipalities directly under the Central Government; the State Grid Corporation; the China Southern Power Grid Co., Ltd; and the Inner Mongolia Electric Power Co. Ltd:
To promote the development and utilization of renewable energy, the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration have jointly formulated the Interim Measures for the Administration of the Collection and Use of the Renewable Energy Development Fund in accordance with the relevant provisions of the Renewable Energy Law of the People's Republic of China, which are hereby issued to you for compliance and implementation.

各省、自治区、直辖市财政厅（局）、发展改革委、能源局、物价局，财政部驻各省、自治区、直辖市财政监察专员办事处，国家电网公司、中国南方电网有限责任公司、内蒙古自治区电力有限责任公司：
为了促进可再生能源的开发利用，根据《中华人民共和国可再生能源法》有关规定，财政部会同国家发展改革委、国家能源局共同制定了《可再生能源发展基金征收使用管理暂行办法》，现印发给你们，请遵照执行。

Chapter I General Provisions
| | 第一章 总则 |
Article 1 These Measures are formulated in accordance with the relevant provisions of the Renewable Energy Law of the People's Republic of China for the purpose of promoting the development and utilization of renewable energy.
| | 第一条 为了促进可再生能源的开发利用，根据《中华人民共和国可再生能源法》的有关规定，制定本办法。
|
Article 2 These Measures shall apply to the administration, supervision and inspection of the raising and use of the renewable energy development fund.
| | 第二条 可再生能源发展基金的资金筹集、使用管理和监督检查等适用本办法。
|
Chapter II Raising of the Fund
| | 第二章 资金筹集 |
Article 3 The renewable energy development fund shall include the special-purpose fund appropriated by the public budget of the national finance (hereinafter referred to as the “special-purpose fund for the development of renewable energy”) and the income from surcharges on renewable energy power prices as collected from power users according to law.
| | 第三条 可再生能源发展基金包括国家财政公共预算安排的专项资金（以下简称可再生能源发展专项资金）和依法向电力用户征收的可再生能源电价附加收入等。

Article 4 The central treasury shall appropriate the special-purpose fund for the development of renewable energy from the annual public budget (excluding the special-purpose fund for infrastructure appropriated within the central budget by the investment authority of the State Council).
| | 第四条 可再生能源发展专项资金由中央财政从年度公共预算中予以安排（不含国务院投资主管部门安排的中央预算内基本建设专项资金）。
|
Article 5 The surcharges on renewable energy power prices shall be collected throughout the country, except the Tibet Autonomous Region, on the sales volume of electricity of all provinces, autonomous regions and municipalities directly under the Central Government after the electricity used for agricultural production purposes (including electricity used for agricultural irrigation and drainage) is deducted.
| | 第五条 可再生能源电价附加在除西藏自治区以外的全国范围内，对各省、自治区、直辖市扣除农业生产用电（含农业排灌用电）后的销售电量征收。

Article 6 The sales volume of electricity of all provinces, autonomous regions and municipalities directly under the Central Government which are subject to the collection of surcharges on renewable energy power prices shall include:
| | 第六条 各省、自治区、直辖市纳入可再生能源电价附加征收范围的销售电量包括：
|
(1) the volume of electricity sold by provincial power grid enterprises (including subsidiaries at all levels) to power users;
| | （一）省级电网企业（含各级子公司）销售给电力用户的电量；
|
(2) the volume of electricity wholesaled by provincial power grid enterprises after reasonable line losses are deducted (namely, the actual volume of electricity sold to resupplying entities, excluding the volume of electricity wholesaled to subsidiaries at all levels);
| | （二）省级电网企业扣除合理线损后的趸售电量（即实际销售给转供单位的电量，不含趸售给各级子公司的电量）；
|
(3) the volume of electricity sold overseas by provincial power grid enterprises;
| | （三）省级电网企业对境外销售电量；
|
(4) the volume of electricity generated and utilized by an enterprise's own power plants;
| | （四）企业自备电厂自发自用电量；
|
(5) the volume of electricity sold (excluding the volume of electricity sold by provincial power grid enterprises to local independent power grids) by local independent power grids (here and below, including local power supply enterprises); and
| | （五）地方独立电网（含地方供电企业，下同）销售电量（不含省级电网企业销售给地方独立电网的电量）；
|
(6) the volume of electricity directly traded in between large users and power generation enterprises.
For collection of the surcharges on renewable energy power prices, the volume of electricity traded in between provinces (autonomous regions or/and municipalities directly under the Central Government) shall be included in the electricity sales volume of the province receiving the power.
| | （六）大用户与发电企业直接交易的电量。
省（自治区、直辖市）际间交易电量，计入受电省份的销售电量征收可再生能源电价附加。

Article 7 The standards for the collection of surcharges on renewable energy power prices shall be 0.008 yuan per kWh. The standards for collection may be adjusted at a proper time in accordance with the medium and long-term total volume targets for the development and utilization of renewable energy, development and utilization planning, and income and expenditures regarding renewable energy power price surcharges.
| | 第七条 可再生能源电价附加征收标准为8厘/千瓦时。根据可再生能源开发利用中长期总量目标和开发利用规划，以及可再生能源电价附加收支情况，征收标准可以适时调整。

Article 8 The surcharges on renewable energy power prices shall be collected by the financial supervision commissioner's offices of the Ministry of Finance in all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the “commissioner's offices”) from power grid enterprises on a monthly basis, and shall be paid to the treasury directly, and the income shall be turned over to the central treasury in the full amount.
