Decision of the Standing Committee of the National People's Congress on Reinforcing the Superintendence over Economic Activities
Adopted on March 1, 2000 by the Fourteenth Session of the Standing Committee of the Ninth National People Congress
In order to carry out the duties of The NPC and The Standing Committee of the NPC as provided in the Constitution and to promote the sustained, rapid and healthy development of the national economy, the Standing Committee of the National People's Congress (hereinafter referred to as NPC), in conformity with the Constitution and relevant laws, and on the basis of years of experience, has come to the following decisions:

为了履行宪法赋予全国人民代表大会及其常务委员会的职责，加强经济工作监督，促进国民经济持续、快速、健康发展，依据宪法和有关法律，总结多年来的实践经验，作如下决定：

1) The Standing Committee of NPC, in accordance with the law, shall exercise the supervisory power over the economic activities of the State Council.
| | 一、全国人民代表大会常务委员会依法对国务院经济工作行使监督职权。
|
2) Draft plans for annual national economic and social development, drafts for five-year plans and drafts for long-term plans worked out by the State Council shall be submitted to the Standing Committee of NPC one month prior to the corresponding session of NPC.
| | 二、国务院编制的国民经济和社会发展年度计划草案、五年计划草案以及长远规划草案，应当在全国人民代表大会举行的一个月前，报送全国人民代表大会常务委员会。

3) While NPC is in session, The Financial and Economic Committee shall examine the drafts and reports on the basis of the opinions of the delegations and special committees, present a report of the examination, and issue the report to delegates after the approval by the presidium.
| | 三、全国人民代表大会会议期间，财政经济委员会根据各代表团和有关专门委员会的审查意见，对计划草案和计划报告进行审查，并提出审查结果报告，经主席团审议通过后，印发代表大会。

4) The Primary focus of the examination of the drafts and reports by The Financial and Economic Committee shall focus on assurance of the following aspects :
| | 四、财政经济委员会对年度计划草案和计划报告的审查重点是：编制的指导方针要符合全国人民代表大会批准的国民经济和社会发展五年计划以及长远规划；主要目标和指标要符合持续、稳定发展国民经济的要求；主要措施要符合加强宏观调控，优化经济结构，安排好国家重点建设，切实改善人民生活，积极促进就业，做好社会保障工作和可持续发展等要求。

a) That the guidelines for the drafts and reports are in conformance with the Five-Year Plan for Economic and Social Development Plan and the Long-term Plan ratified by NPC;
| | 五、对涉及面广、影响深远、投资巨大的国家特别重大建设项目，国务院可以向全国人民代表大会或者常务委员会提出议案，由全国人民代表大会或者常务委员会审议并作出决定。

b) that the major objectives and quotas are in accordance with the requirements for sustainable and stable development of the national economy; That primary measures shall be able to strengthen macroeconomic regulation, optimize economic structure, provide priority for major national construction, raise the people's living standards, actively increase employment, and guarantee social security and sustainable development.
| | 六、在经济运行过程中，全国人民代表大会批准的年度计划、五年计划和长远规划必须作的部分调整，由国务院提请常务委员会审查批准。除特殊情况外，国务院应当在全国人民代表大会常务委员会举行会议一个月前，将调整方案的议案报送全国人民代表大会常务委员会。
国务院应当在８月向全国人民代表大会常务委员会报告上半年计划执行情况。
经济运行发生重大变化时，国务院应当向全国人民代表大会常务委员会报告，作出说明。
全国人民代表大会常务委员会可以根据需要，听取并审议国务院经济工作方面的专题汇报。
全国人民代表大会常务委员会应当对国民经济和社会发展计划的执行情况进行监督，对计划安排的国家重点建设项目，可以根据需要听取国务院的工作汇报，进行监督。

5) Large-scale national construction projects involving a wide range of sectors, bearing far-reaching significance and demanding enormous investment shall require that the State Council propose a bill to the NPC or its Standing Committee for examination and decision.
| | 七、同外国或者国际组织缔结、废除有关经济方面的条约和协定，凡依照中华人民共和国缔结条约程序法的规定，必须由全国人民代表大会常务委员会决定批准的，国务院应当向全国人民代表大会常务委员会提出议案，提请审议决定。

6)Partial adjustments that must be made to the annual plans, five-year plans and long-term plans in the economic operation shall be proposed by the State Council to the Standing Committee of NPC for examination and ratification. The State Council shall submit the bill of suggestions for adjustment to the Standing Committee of the NPC one month prior to the session with the exclusion of special occasions.
The State Council shall make a report to the Standing Committee of the NPC in August concerning the execution of the annual plans in the first half of the year.
Where a substantial change occurs in economic operation, the State Council shall make a report to the Standing Committee of NPC for explanation.
The Standing Committee of NPC may, if necessary, hear and examine special reports of the State Council on the economic work.
The Standing Committee of the NPC shall exercise superintendence over the execution of the national economic and social development plans, and where necessary, may hear reports of the State Council concerning and exercise supervision of planned key national construction projects.
| | 八、受委员长会议委托，有关专门委员会可以召开全体会议，听取国务院有关部门的专题汇报。国务院有关部门的专题汇报由国务院统一安排。
财政经济委员会应当在４月、７月和１０月的１５日前分别召开全体会议，听取国务院有关部门关于一季度、上半年、前三季度国民经济运行情况的汇报，并进行分析研究。

7) With regards to the treaties and agreements between China and foreign countries or international organizations concerning economic affairs whose conclusion or abrogation require the ratification of the Standing Committee of the NPC, in accordance with the procedural laws of the People's Republic of China concerning the conclusion of treaties, a bill shall be proposed by the State Council to the Standing Committee of the NPC for examination and decision.
| | 九、全国人民代表大会常务委员会会议审议讨论本决定所列事项时，国务院应当根据要求，及时提供相关的信息资料及说明，并派国务院负责人或者有关部门负责人到会，听取意见，回答询问。

8) Under the authorization of the meeting of the chairpersons of the Standing Committee of the NPC, the special committees of NPC concerned may convene plenary sessions so as to hear special reports of the related department(s) of the the State Council. The special reports of the departments related department(s) of the the State Council shall be subject to the arrangement of the State Council.
The Financial and Economic Committee of the NPC shall hold its plenary sessions prior to the fifteenth of April, July and October, hearing the reports of the related department(s) of the the State Council concerning the economic operations in the first quarter, second quarter and third quarter of the year respectively, and then make an analysis and examination of the reports.
| | 十、专门委员会在召开全体会议听取国务院有关部门汇报后提出的意见和建议，应当报告委员长会议，由委员长会议审议决定是否批转国务院及其有关部门研究处理，并将结果报告全国人民代表大会常务委员会。

9) In the process of examination and discussion of the items as mentioned in This decision by the members of the Standing Committee of NPC, the State Council shall, when necessary, timely present relevant information, data and explanations, and assign the person in charge of the State Council or the persons in charge of the departments to the sessions to observe suggestions and answer inquiries.
In the process of examination and discussion of the items as mentioned in This Decision by the members of the special committees of the Standing Committee of the NPC, the relevant departments of the State Council shall, when necessary, timely provide relevant information, data and explanations, and shall assign the relevant persons-in-charge to the sessions to observe suggestions and answer inquiries.
| | 十一、全国人民代表大会常务委员会开展经济工作监督的情况向社会公布，法律另有规定的除外。

10) Comments and suggestions worked out by the special committee(s) of the NPC after hearing the reports of the relevant departments of the State Council at the sessions shall be reported to the session of chairpersons. It shall be the responsibility of the chairperson of the Standing Committee of the NPC to decide whether to approve the execution of the comment and suggestions by the State Council or the relevant departments of the State Council, and report the result to the Standing Committee of the NPC.

| 11) Unless otherwise stipulated by law, the Standing Committee of the NPC shall publicize its superintendence over economic activities. | | |
