PROVISIONAL MEASURES FOR THE CONTROL OF CHINESE CITIZENS ENTERING AND LEAVING THE REGIONS OF HONG KONG AND MACAO FOR PERSONAL REASONS

CHAPTER I GENERAL PRINCIPLES
| | 第一章 总 则
|
Article 1. These Measures are formulated in accordance with the provisions of Article 17 of the Law of the People's Republic of China on the Control of Citizens Leaving and Entering Chinese Territory.
| | 第一条 根据《中华人民共和国公民出境入境管理法》第十七条的规定，制定本办法。
|
Article 2. These Measures shall apply to any domestic Chinese citizen who enters or leaves the Region of Hong Kong (hereinafter referred to as Hong kong) or the Region of Macao (hereinafter referred to as Macao), as well as to any Hong Kong or Macao compatriot who enters or leaves China.
| | 第二条 本办法适用于内地公民因私事往来香港地区（下称香港）或者澳门地区（下称澳门）以及港澳同胞来往内地。
|
Article 3. Any domestic Chinese citizen who travels to Hong Kong or Macao for personal reasons shall present a Hongkong/Macao Entry Pass or a Hong Kong/Macao Travel Pass issued by a State public security organ and shall pass through a designated port. The return entry into China may be through another open port.
Designated ports shall be Shenzhen when travelling to Hong Kong and Gongbei when travelling to Macao.
| | 第三条 内地公民因私事前往香港、澳门，凭我国公安机关签发的前往港澳通行证或者往来港澳通行证从指定的口岸通行；返回内地也可以从其他对外开放的口岸通行。
指定的口岸；往香港是深圳，往澳门是拱北。

Article 4. Any Hong Kong or Macao compatriot who travels between Hong Kong or Macao and China shall present a Pass for Hong Kong /Macao Compatriots Revisiting their Homeland or a Border Entry-Exit Pass issued by a State public security organ and shall pass through an open port.
| | 第四条 港澳同胞来往于香港、澳门与内地之间，凭我国公安机关签发的港澳同胞回乡证或者入出境通行证，从中国对外开放的口岸通行。

CHAPTER II DOMESTIC CHINESE CITIZENS TRAVELLING TO HONG KONG OR MACAO
| | 第二章 内地公民前往香港、澳门
|
Article 5. In order to protect and maintain the economic prosperity and social stability of Hong Kong and Macao, examination and approval of applications by any domestic Chinese citizen who wishes, for personal reasons, to take up residence in Hong Kong or Macao shall be implemented on the basis of fixed quotas.
| | 第五条 内地公民因私事前往香港、澳门定居，实行定额审批的办法，以利于维护和保持香港和澳门的经济繁荣和社会稳定。

Article 6. Any domestic Chinese citizen who travels to Hong Kong or Macao for personal reasons shall submit an application to the exit-entry control department of the local municipal or county public security bureau where the applicant has household registration.
| | 第六条 内地公民因私事前往香港、澳门，须向户口所在地的市、县公安局出入境管理部门提出申请。
|
Article 7. Any person may apply to settle in Hong Kong or Macao if:
| | 第七条 有下列情形之一的，可以申请前往香港、澳门定居：
|
(i) the spouse of the person is a resident of Hong Kong or Macao and the couple have been separated for many years;
| | （一）夫妻一方定居香港、澳门，分居多年的；
|
(ii) a parent of the person, being resident in Hong Kong or Macao and elderly or frail, requires a son or daughter in China to take care of the parent;
| | （二）定居香港、澳门的父母年老体弱，必须由内地子女前往照料的；
|
(iii) the person is elderly or a child, has no-one in China upon whom to depend and needs to seek support from an immediate or close relative in Hong Kong or Macao.
| | （三）内地无依无靠的老人和儿童须投靠在香港、澳门的直系亲属和近亲属的；
|
(iv) the person has a parent resident in Hong Kong or Macao and there would be no heir to the parent's estate except if a son or daughter of the parent in China becomes a resident of Hong Kong or Macao; or
| | （四）定居香港，澳门直系亲属的产业无人继承，必须由内地子女去定居才通继承的；
|
(v) the person needs to take up residence in Hong Kong or Macao due to other special circumstances.
| | （五）有其他特殊情况必须去定居的。
|
Article 8. Any person may apply for a short-term travel pass for entry to and exit from Hong Kong or Macao if:
| | 第八条 有下列情形之一的，可以申请短期前往香港、澳门：
|
(i) the person has close relatives in Hong Kong or Macao whom they need to visit;
| | （一）在香港、澳门有定居的近亲属，须前往探望的；
|
(ii) the person's immediate or close relatives are Taiwanese compatriots and the person needs to go to Hong Kong or Macao to meet them;
| | （二）直系亲属或者近亲属是台湾同胞，必须由内地亲人去香港、澳门会亲的；
|
(iii) the person is a Returned Overseas Chinese whose immediate relatives and brothers and sisters are unable to visit China or the person is a relative of an overseas Chinese and the person's immediate relatives are unable to visit China, therefore requiring the person to meet them in Hong Kong or Macao;
| | （三）归国华侨的直系亲属、兄弟姐妹和侨眷的直系亲属不通回内地探亲，必须去香港、澳门会面的。
|
(iv) the person needs to go to Hong Kong or Macao to deal with an estate; or
| | （四）必须去香港、澳门处理产业的；
|
(v) the person needs to make a short-term visit to Hong kong or Macao due to other special circumstances.
| | （五）有其他特殊情况，必须短期去香港、澳门的。
|
Article 9. A domestic Chinese citizen who applies to enter Hong Kong or Macao for personal reasons shall answer the relevant enquiries and shall;
| | 第九条 内地公民因私事申请前往香港、澳门，须回答有关的询问并履行下列手续：
|
(i) submit the applicant's household residence registration booklet or other documentation of residence registration for inspection;
| | （一）交验户口簿或者其他户籍证明；
|
(ii) complete an application form;
| | （二）填写申请表；
|
(iii) submit the views of the applicant's work unit on the application to enter Hong Kong or Macao; and
| | （三）提交所在工作单位对申请人前往香港、澳门的意见；
|
(iv) submit other documentation related to the application.
| | （四）提交与申请事由相应的证明。
|
Article 10. The reference to "documentation" in item (iv) of Article 9 of these Measures is a reference to:
| | 第十条 本办法第九条第四项所称的证明是指：
|
(i) a legal marriage licence and the Hong Kong or Macao permanent residence certificate of the spouse, in the case of a reunion of husband and wife;
| | （一）夫妻团聚，须提交合法婚姻证明，以及配偶在香港、澳门有永久居住资格的证明；
|
(ii) documentation of kinship and the Hong Kong or Macao permanent residence certificate of the relative, in the case of a person applying to enter Hong Kong or Macao to take care of an elderly or frail parent, or in the case of an elderly person or child who has no-one upon whom to depend and who needs to seek support from a relative in Hong Kong or Macao;
| | （二）去香港、澳门照顾年老体弱父母或者无依无靠的老人、儿童投靠香港、澳门亲属，须提交与香港、澳门亲属关系及其在香港、澳门有永久居住资格的证明；
|
(iii) details of an estate and documentation of the person's legal right of inheritance, in the case of a person inheriting or dealing with an estate;
| | （三）继承或者处理产业，须提交产业状况和合法继承权的证明；
|
(iv) correspondence from relatives, in the case of a person applying to visit relatives in Hong Kong or Macao and, if the case is urgent, as much explanation or documentation as possible which is of relevance to the application; and
| | （四）探望在香港、澳门亲属，须提交亲属函件；时间急迫的，应尽可通提交与申请事由相关的说明或者证明。
|
(v) precise documentation of the date of a relative's arrival in Hong Kong or Macao in the case of meetings with Taiwanese relatives or relatives who live abroad.
