The Administrative Measures for the Completion-based Check and Acceptance of Waterway Projects, which were adopted at the 14th executive meeting of the Ministry of Communications on December 28, 2007, are hereby promulgated and shall come into force from March 1, 2008.

Article 1 The present Measures are formulated according to the Regulation of the People's Republic of China on Waterway Control for the purpose of strengthening the construction control of waterway projects, regulating the completion-based check and acceptance of waterway projects, and guaranteeing the quality of projects.
| | 第一条 为加强航道工程建设管理，规范航道工程竣工验收工作，保证工程质量，根据《中华人民共和国航道管理条例》，制定本办法。

Article 2 The present Measures shall be applicable to the completion-based check and acceptance of waterway projects.
The “completion-based check and acceptance of waterway projects” as mentioned in the present Measures refers to the comprehensive completion-based check and acceptance of the quality of waterway projects, the implementation of national and industrial mandatory standards, the use of capital and other matters after the completion of waterway projects but before the official delivery and use thereof, as well as the comprehensive appraisal of the building, designing, construction and supervision of waterway projects.
| | 第二条 本办法适用于航道工程竣工验收工作。
本办法所称航道工程竣工验收工作是指航道工程完工后、正式交付使用前，对航道工程质量、国家和行业强制性标准执行情况、资金使用情况等事项的全面检查验收，以及对航道工程建设、设计、施工、监理等工作的综合评价。

Article 3 A waterway project may not be delivered for use until it has been found to be qualified upon completion-based check and acceptance.
| | 第三条 航道工程经竣工验收合格后方可正式交付使用。

Article 4 The completion-based check and acceptance of waterway projects shall be made in an impartial, scientific and standardized manner.
| | 第四条 航道工程竣工验收工作，应当做到公正、科学、规范。
|
Article 5 The uniform administration and level-by-level responsibility system shall be implemented for the completion-based check and acceptance of waterway projects.
The Ministry of Communications shall supervise and administer the completion-based check and acceptance of waterway projects throughout the country; and be specifically responsible for the completion-based check and acceptance of waterway projects that are approved or verified by the National Development and Reform Commission or are approved by the Ministry of Communications.
The provincial administrative department of communications shall supervise and administer the completion-based check and acceptance of waterway projects within its own jurisdiction other than those mentioned in the preceding paragraph; and be specifically responsible for the completion-based check and acceptance of waterway projects that are approved or verified by the relevant departments under the provincial people's government. For the waterway projects that are included in the national high-level waterways and have the total investment amount of 100 million yuan or more, the provincial administrative department of communications shall solicit opinions from the Ministry of Communications before organizing the completion-based check and acceptance. The administrative department of communications at the districted city or county shall, according to the relevant provisions of the provincial people's government, supervise and administer the completion-based check and acceptance of waterway projects within its jurisdiction other than those mentioned in paragraphs 2 and 3 of this Article.
The aforesaid departments responsible for the completion-based check and acceptance of waterway projects shall be jointly referred to as the department in charge of completion-based check and acceptance.
| | 第五条 航道工程竣工验收工作，实行统一管理、分级负责。
交通部负责全国航道工程竣工验收工作的监督管理。具体负责由国家发展和改革委员会批准或者核准以及交通部批准的航道工程的竣工验收工作。
省级交通主管部门负责本行政区域内除前款规定之外的航道工程竣工验收工作的监督管理。具体负责由省级人民政府有关部门批准或者核准的航道工程的竣工验收工作。其中列入国家高等级航道且总投资在1亿元（含1亿元）以上的航道工程，省级交通主管部门在组织竣工验收前应当征求交通部意见。设区的市和县级交通主管部门按照省级人民政府的有关规定负责本行政区域内除本条第二款、第三款以外的航道工程竣工验收活动的监督管理。
以上负责航道工程竣工验收工作的部门统称为竣工验收部门。

Article 6 The main grounds for the completion-based check and acceptance of a waterway project shall include:
| | 第六条 航道工程竣工验收的主要依据是：
|
1. Relevant laws, regulations and rules promulgated by the State and the Ministry of Communications;
| | （一）国家和交通部颁布的相关法律、法规、规章；
|
2. Relevant technical standards and criteria promulgated by the State and the Ministry of Communications;
| | （二）国家和交通部颁布的相关技术标准、规范；
|
3. Documents on approval, verification and archival filing of the construction project;
| | （三）建设项目的批准、核准、备案文件；
|
4. Documents on preliminary design, working drawing, design alteration, budget adjustment and etc. for the construction project;
| | （四）建设项目的初步设计文件、施工图设计文件、设计变更文件以及概算调整等文件；
|
5. Technical specifications or instructions of main equipment; and
| | （五）主要设备技术规格或者说明书；
|
6. Bid invitation documents and contracts.
| | （六）招标文件以及合同文本。
|
Article 7 The following requirements shall be met for the completion-based check and acceptance of a waterway project:
| | 第七条 航道工程竣工验收应当具备以下条件：
|
1. The waterway project has been completed according to the approved construction scale, standards and contents, and can meet the requirements for production and use; if there is any unfinished part of the waterway project for which an application for completion-based check and acceptance is filed, the unfinished part shall not be the principal work or shall not have any impact on the effects or the normal operation of the project, and the investment amount in the unfinished part may not exceed 5% of the total budget of the project;
| | （一）已按批准的建设规模、标准和内容建成，满足生产使用要求；申请竣工验收的航道建设工程有尾留工程的，尾留工程不得是主体工程，不得影响工程效果和工程正常运行，投资额不能超过工程总概算的5%；
|
2. All the unit works and projects have been found to be qualified upon inspection of the supervisory department of project quality;
| | （二）各单位工程和项目经工程质量监督机构检验合格；
|
3. All the unit works have been found to be qualified upon completion-based check and acceptance;
| | （三）各单位工程交工验收合格；
|
4. Main technical equipment or facilities have been debugged, the linkage testing has been completed, and main technical parameters have met the designing requirements;
| | （四）主要工艺设备或者设施调试以及联动测试均已完成，主要技术参数达到设计要求；
|
5. The shipping hub project has been found to be qualified upon the intermediate check and acceptance;
| | （五）航运枢纽工程阶段验收合格；
|
6. Where the vessel seaworthiness inspection is required, the design vessel types have been selected for the vessel seaworthiness inspection, and all the inspection indicators have met the designing requirements;
| | （六）需要实船适航检验的，已选用设计船型进行了实船适航检验，各项检验指标满足设计要求；
|
7. The trial operation of the project has been carried out for one year, and the project is operated in gear;
| | （七）工程试运行期满一年，运行情况正常；
|
8. The archival material on the completion of the project are complete and have been found as qualified upon special check and acceptance;
| | （八）竣工档案资料齐全，通过有关专项验收；
|
9. The final accounting of completed project has been prepared and completed, for which the state audit organ or an intermediary institutions qualified for auditing has issued an audit report without reserved opinions;
．．．．．． | | （九）竣工决算报告已编制完成，并取得国家审计机构或者具有审计资格的中介机构出具的审计报告，且审计报告无保留意见；
