Notice of the Civil Aviation Administration of China on Amending and Issuing the Interim Measures for the Administration of the Introduction of Imported General Aircrafts
The regional administrations of the Civil Aviation Administration of China, and all general airline companies:
To regulate the administration of the civil aviation administrative organs on the introduction of imported general aircrafts by enterprises, public institutions, organizations and individuals inside China and further enhance general aviation safety and the coordinated development of the civil aviation industry, the Civil Aviation Administration of China (CAAC) amended the Interim Measures for the Administration of the Introduction of Imported General Aircrafts (No.116 [2008] of the CAAC ) and hereby issues the amended ones to you for your compliance and implementation.

民航各地区管理局，各通用航空公司：
为规范我国境内民用航空行政机关对企事业单位、组织和个人引进进口通用航空器的管理，进一步促进通用航空安全和民航行业协调发展，民航局对《关于引进进口通用航空器管理暂行办法》（民航发[2008]116号）进行了修订，现将修订后的《办法》印发你们，请认真遵照执行。

Chapter I General Provisions
| | 第一章 总则
|
Article 1 To regulate the administration of the civil aviation administrative organs on the introduction of imported general aircrafts by enterprises, public institutions, organizations and individuals inside China and further enhance general aviation safety and the coordinated development of the civil aviation industry, these Measures are formulated pursuant to the Civil Aviation Law of the People's Republic of China.
| | 第一条 为规范我国境内民用航空行政机关对企事业单位、组织和个人（以下简称“申请人”）引进进口通用航空器的管理，促进通用航空安全和民航行业协调发展，根据《中华人民共和国民用航空法》，制定本办法。

Article 2 The term “imported general aircrafts” (hereinafter referred to as “general aircrafts”) as mentioned in the preceding article refers to the civil aircrafts imported by an applicant from foreign countries (or through domestic trade or leasing companies) for general aviation uses.
| | 第二条 前款所称进口通用航空器是指申请人自国外（或通过国内的贸易、租赁公司）进口用于从事通用航空用途的民用航空器。（以下简称“通用航空器”）

Article 3 These Measures shall apply to an applicant's introduction of general aircrafts by purchase, financing lease, operating lease, wet lease, etc. (hereinafter referred to as “introduction ways”).
| | 第三条 本办法适用于申请人以购买、融资租赁、经营租赁、湿租等方式（以下简称“引进方式”）引进通用航空器的行为。

Article 4 The introduction of general aircrafts shall be subject to the administration of the Civil Aviation Administration of China (CAAC) and the regional civil aviation administrations (hereafter referred to as the “regional administrations”), hence the two-level administration system. The regional administrations shall be responsible for the acceptance and preliminary examination of project applications. The CAAC shall be responsible for the approval of project applications.
| | 第四条 引进通用航空器实行中国民用航空局（以下简称“民航局”）和中国民用航空地区管理局（以下简称“管理局”）两级管理。管理局负责申请项目的受理及初步审核，民航局负责核准。

Chapter II Application Qualifications and Approval Procedures for the Introduction of General Aircrafts
| | 第二章 引进通用航空器的申请条件和审核程序

Article 5 An application for introduction of general aircrafts for commercial activities on general aviation shall be filed by a general aviation business operation permit holder or an operator with the approval to do the preparatory establishment work.
| | 第五条 引进通用航空器从事经营性通用航空活动的，应由通用航空经营许可证持有人或经批准开展筹建工作的营运人提出申请。

Article 6 To introduce a general aircraft for commercial activities on general aviation, an applicant shall submit application materials (in triplicate) to the regional administration and make a written statement on the authenticity and validity of the materials. The application materials include:
| | 第六条 申请人引进通用航空器从事经营性通用航空活动的，应向所在地区管理局提交申请材料（一式三份），并书面声明保证其材料真实有效。申请材料应包括：

1. The general aviation business operation permit (photocopy) or the preparatory establishment permit (photocopy) held by the applicant;
| | （一）申请人持有的通用航空经营许可证（复印件）或筹建认可通知书（复印件）；
|
2. The model, quantity, introduction schedule and introduction way of the general aircrafts to be introduced;
| | （二）计划引进通用航空器的机型、数量、进度和引进方式；
|
3. The operation plan, scheme or uses of the general aircrafts to be introduced;
| | （三）引进通用航空器的运营计划、方案或用途；
|
4. The general operation situation, including the quantity of currently owned general aircraft, their service conditions, the operation capacity, and the annual flying hours and flights of general aviation in each of the last three years (or in each of the operating years);
| | （四）运营概况，包括现有通用航空器数量、使用情况和人员保障实力以及近三年（或自开始运营至今）分年度通用航空作业飞行小时数和起飞架次数等；
|
5. If the general aircrafts are introduced by wet lease, a wet lease agreement, the qualification certificate of the lessor and the operation situation of the lessor; and
| | （五）以湿租方式引进通用航空器的，应提交湿租协议和出租人资质证明以及出租人运营概况；
|
6. Other materials as specified by the civil aviation authorities.
| | （六）民航管理部门认为应提供的其它材料。

Article 7 An application for introducing general aircrafts for non-commercial activities on general aviation can be filed by the applicant or the operator that is to take custody of the general aircrafts.
