食品安全国家标准管理办法
Chapter I General Provisions
 

第一章 总 则


Article 1 These Measures are formulated in accordance with the Food Safety Law of the People's Republic of China (hereinafter referred to as Food Safety Law) and the Regulation on the Implementation thereof for the purpose of regulating the formulation and revision of national food safety standards.
   第一条 为规范食品安全国家标准制(修)订工作,根据《中华人民共和国食品安全法》及其实施条例,制定本办法。
Article 2 The formulation of national food safety standards shall aim to protect public health, and be based on the results of food safety risk assessment, so as to achieve scientificity, reasonability, openness, transparency, safety and reliability thereof.
   第二条 制定食品安全国家标准应当以保障公众健康为宗旨,以食品安全风险评估结果为依据,做到科学合理、公开透明、安全可靠。
Article 3 The Ministry of Health shall be responsible for the formulation and revision of national food safety standards.
The Ministry of Health shall set up a Review Committee for National Food Safety Standards (hereinafter referred to as the “Review Committee”), which shall be responsible for examining the draft national food safety standards, and provide advisory opinions for the work on national food safety standards. The Review Committee shall consist of professional sub-committees and the Secretariat.
   第三条 卫生部负责食品安全国家标准制(修)订工作。
卫生部组织成立食品安全国家标准审评委员会(以下简称审评委员会),负责审查食品安全国家标准草案,对食品安全国家标准工作提供咨询意见。审评委员会设专业分委员会和秘书处。
Article 4 The formulation and revision of national food safety standards shall include planning, plan, initiation, drafting, examination, approval, issuance, amendment, review, etc.
   第四条 食品安全国家标准制(修)订工作包括规划、计划、立项、起草、审查、批准、发布以及修改与复审等。
Article 5 Citizens, legal persons and other organizations shall be encouraged to participate in the formulation and revision of national food safety standards and put forward comments and suggestions.
   第五条 鼓励公民、法人和其他组织参与食品安全国家标准制(修)订工作,提出意见和建议。
Chapter II Planning, Plan and Initiation
 

第二章 规划、计划和立项


Article 6 The Ministry of Health shall, jointly with the agriculture administrative department, quality supervision department, industry and commerce administrative department, state food and drug administrative department, commerce department, industry and information technology department and other departments under the State Council, formulate planning for national food safety standards and implementation plans thereof.
   第六条 卫生部会同国务院农业行政、质量监督、工商行政管理和国家食品药品监督管理以及国务院商务、工业和信息化等部门制定食品安全国家标准规划及其实施计划。
Article 7 The planning for national food safety standards and the implementation plans thereof shall specify the recent development objectives, implementation programs and guarantee measures for national food safety standards, etc.
   第七条 食品安全国家标准规划及其实施计划应当明确食品安全国家标准的近期发展目标、实施方案和保障措施等。
Article 8 The Ministry of Health shall, in accordance with the planning for national food safety standards and the implementation plans thereof and in light of the needs of the food safety work, work out plans for formulation and revision of national food safety standards.
   第八条 卫生部根据食品安全国家标准规划及其实施计划和食品安全工作需要制定食品安全国家标准制(修)订计划。
Article 9 Where the relevant department considers that the field under its supervision needs a national food safety standard, it shall, prior to the preparation of the plan for the formulation and revision of national food safety standards each year, put forward project initiation proposals to the Ministry of Health, which shall include important issues to be solved, backgrounds and reasons for the project initiation, the basis for monitoring and assessment of existing food safety risks, and candidates for the drafting of the standard. And the project initiation proposals shall be sequenced according to their priorities.
Any citizen, legal person or any other organization may put forward proposals for initiation of national food safety standards.
   第九条 各有关部门认为本部门负责监管的领域需要制定食品安全国家标准的,应当在每年编制食品安全国家标准制(修)订计划前,向卫生部提出立项建议。立项建议应当包括要解决的重要问题、立项的背景和理由、现有食品安全风险监测和评估依据、标准候选起草单位,并将立项建议按照优先顺序进行排序。
任何公民、法人和其他组织都可以提出食品安全国家标准立项建议。
Article 10 National food safety standards that are proposed to be initiated shall comply with Article 20 of the Food Safety Law.
   第十条 建议立项的食品安全国家标准,应当符合《食品安全法》第二十条规定。
Article 11 The Review Committee shall, in accordance with the needs of the work on food safety standards, make research on the proposals for the initiation of national food safety standards, and put forward advisory opinions on the formulation of plans for formulation and revision of national food safety standards to the Ministry of Health.
   第十一条 审评委员会根据食品安全标准工作需求,对食品安全国家标准立项建议进行研究,向卫生部提出制定食品安全国家标准制(修)订计划的咨询意见。
Article 12 The Ministry of Health shall, prior to the announcement of the planning, implementation plan and formulation and revision plans for national food safety standards, solicit opinions from the public.
   第十二条 卫生部在公布食品安全国家标准规划、实施计划及制(修)订计划前,应当向社会公开征求意见。
Article 13 Plans for formulation and revision of national food safety standards may be adjusted according to actual needs during the process of implementation.
