NOTICE OF THE MINISTRY OF FOREIGN TRADE AND ECONOMIC COOPERATION ON PRINTING AND DISTRIBUTING "THE CATALOGUE OF COMMODITIES SUBJECT TO EXPORT LICENSING ADMINISTRATION BY DIFFERENT LEVELS" AND RELEVANT ISSUES
(December 17, 1997)
In accordance with "The Interim Procedures on Administration of Export Commodities", "The Methods on Compensated Quota Bidding for Export Commodities" and its detailed rules for implementation issued by the Ministry of Foreign Trade and Economic Cooperation (MOFTEC), MOFTEC has made some adjustments with commodity varieties, commodity codes and issuing organizations of those commodities subject to export licensing administration after consulting the Customs General Administration. Now, the new "Catalogue of Commodities Subject to Export Licensing Administration by Different Levels" (in appendix) is printed and distributed for observance and implementation. The notice on the relevant issues is hereby given as follows:

各省、自治区、直辖市及计划单列市外经贸厅（委、局），哈尔滨、长春、沈阳、西安、成都、武汉、南京、广州市外经贸委，外经贸部驻各地特派员办事处，配额许可证事务所，各进出口商会，广东海关分署，各直属海关：
根据《出口商品管理暂行办法》和外经贸部《出口商品配额有偿招标办法》及其实施细则，经商海关总署，我部对实行出口许可证管理的商品种类、商品编码和发证机关作了调整。现将新的《出口许可证管理商品分级发证目录》（见附件）印发给你们，请遵照执行，并就有关问题通知如下：

I. From January 1, 1998, the export licensing control on sorghum shall be cancelled; carbon silicon and newsprint paper are to be added to those commodities subject to export licensing administration, the latter one under the control of export quota at the same time; the foreign invested enterprises shall be treated according to current regulations.
The export of carbon silicon to the United States of America can only be dealt with by the Metals and Minerals Import and Export Company of Qinghai Province, the Import and Export Trade Company of Inner Mongolia Autonomous Region, the Seventh Abrasion Wheel Plant Import and Export Company of Guizhou Province, the China National Abrasive Material and Tool Import and Export Integrated Company, the Metals and Minerals Import and Export Company of Shaanxi Province and the Feitian Electronics Technical Company of Hainan Province. The provincial issuing organizations where the companies are located are responsible for such license issuance. Other companies shall not be permitted to engage in this line of business, and other provincial organizations shall not issue the export licenses with regard to carbon silicon exported to U.S.A.
| | 一、自１９９８年１月１日起，取消高梁的出口许可证管理；增加碳化硅、新闻纸为出口许可证管理商品，其中对新闻纸同时实行出口配额管理；外商投资企业按现行规定办理。
对美国出口碳化硅由青海省五金矿产进出口公司、内蒙古自治区进出口贸易公司、贵州省第七砂轮厂进出口公司、中国磨料磨具进出口联营公司、陕西省五金矿产进出口公司、海南飞天电子技术公司等六家公司经营，公司所在的省级发证机关发证，其他公司不得经营，其他省级发证机关也不得签发对美国出口碳化硅的出口许可证。

II. From January 1, 1998, the Commissioner's Offices of MOFTEC located at various cities (hereinafter referred to as "Commissioner's Offices") will replace the provincial organizations to issue the export licenses of wooden pencil and Vitamin C, while the license issuance of Arabian robe (or trousers) will be adjusted and transferred from the Commissioner's Offices to various provincial responsible organizations.
| | 二、自１９９８年１月１日起，木杆铅笔、维生素Ｃ由省级发证机关发证调整为外经贸部驻各地特派员办事处（以下简称特办发证）；阿拉伯袍（裤）由特办发证调整为各省级发证机关发证。

III. In 1998, 27 export commodities shall be subject to compensated quota bidding (excluding passive quota for textiles). These are: light and heavy caustic magnesium, fluorspar lump (or powder), talc lump (or powder), paraffin wax, bauxite, rosin (or oleoresin), cashmere, dehaired wool, cony hair, ginseng, licorice, bleached cotton fabric, bleached cotton-polyester fabric, ramie yarn, ramie gray fabric, ramie strip (or top), refined dried-jute, garlic, small red bean, sesame, bee honey, fresh royal jelly, licorice products, wooden pencil, rush and its products, leather working gloves, and single cylinder diesel.
Among them, with regard to ginseng, light and heavy caustic magnesium, cashmere and dehaired wool, the licenses shall be issued by the designated Commissioner's Offices, to which all foreign trade enterprises must apply for the export licenses before exporting the above-mentioned commodities. Except these commodities, as far as other commodities subject to compensated quota bidding are concerned, the corporations directly under ministries and commissions of the State Council in Beijing should make applications to the Administration of Quota and License Affairs of MOFTEC for the export licenses; all kinds of local foreign trade enterprises (including foreign invested enterprises and manufacturing enterprises with foreign trade rights) should go to the Commissioner's Offices of the same location for such an application. Any other issuing organizations have no right to issue the export licenses of the commodities subject to compensated quota bidding.
| | 三、１９９８年实行配额有偿招标的出口商品为２７种（纺织品被动配额除外），具体品种是：轻重炼镁、氟石块（粉）、滑石块（粉）、石蜡、矾土、松香（脂）、羊绒、无毛绒、兔毛、人参、甘草、棉漂布、棉涤纶漂布、苎麻纱、苎麻坯布、苎麻条（球）、精干麻、大蒜、红小豆、芝麻、蜂蜜、鲜蜂王浆、甘草制品、木杆铅笔、蔺草及制品、皮制劳保手套、单缸柴油机。
其中人参、轻重炼镁、羊绒、无毛绒等商品，由指定特办发证，各类外经贸企业出口上述商品，均须到指定的特办申领出口许可证。除指定特办发证商品外，其他配额有偿招标商品，在京的部委直属总公司，向外经贸部配额许可证事务局申领出口许可证；地方各类外经贸企业（包括外商投资企业、有外贸经营权的生产企业），向所在地区的特办申领出口许可证。其他任何发证机关无权签发配额有偿招标商品的出口许可证。

IV. The export of light (and heavy) caustic magnesium is limited to be carried out at several designated export ports, which are Dalian, Yingkou, Bayuquan, Dadonggang, Zhongshan, Qingdao, Tianjin, Changchun and Manzhouli. The authorized issuing organizations shall carry out the issuance work in accordance with the above ports, while relevant inspection certificates should also be issued by the local commodity inspection bureaus at these ports.
