The Interim Measures for the Administration of Investment Projects Financed by Loans of International Financial Organizations and Foreign Governments, which were deliberated and adopted at the office meeting of the directors-general of the National Development and Reform Commission, are hereby promulgated, and shall come into force as of March 1st, 2005.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 The present Measures are formulated in accordance with the Decision of the State Council on the Reform of Investment Institutions and the relevant state provisions on the administration of foreign debts for the purpose of strengthening the regulation of investment projects financed by the loans of international financial organizations and foreign governments (hereinafter referred to as foreign loans), and expanding the benefits of using foreign loans.
| | 第一条 为加强国际金融组织和外国政府贷款（以下简称国外贷款）投资项目管理，提高国外贷款使用效益，根据《国务院关于投资体制改革的决定》和国家有关外债管理规定，制定本办法。

Article 2 The present Measures shall be applicable to the administration of loans issued by the World Bank, the Asian Development Bank, International Agriculture Development Funds and other loans issued by international financial organizations and foreign governments, as well as donations and joint financing used in combination with such loans and other investment projects.
| | 第二条 借用世界银行、亚洲开发银行、国际农业发展基金会等国际金融组织贷款和外国政府贷款及与贷款混合使用的赠款、联合融资等投资项目的管理，适用本办法。

Article 3 Any domestic enterprise, institution or organization may apply for foreign loans.
| | 第三条 境内企业、机构、团体均可申请借用国外贷款。

Article 4 Foreign loans belong to foreign debts under national sovereignty, and shall be managed as government investment funds. The foreign loans shall primarily be used for constructing public welfare projects and public infrastructure, protecting and improving the environment, and promoting the economic and social development of under-developed regions.
| | 第四条 国外贷款属于国家主权外债，按照政府投资资金进行管理。国外贷款主要用于公益性和公共基础设施建设，保护和改善生态环境，促进欠发达地区经济和社会发展。

Chapter II Plan for Projects Prepared for Foreign Loans
| | 第二章 国外贷款备选项目规划
|
Article 5 The plan for projects prepared for foreign loans shall serve as the basis for carrying out foreign affairs work. Any project that is financed by foreign loans shall be included in the plan for projects prepared for foreign loans.
For those projects that are not included in the plan for projects prepared for foreign loans, the relevant departments of the State Council, the local governments at all levels and entities whose projects need financing shall not file an official application to any international financial organization, foreign government or any other foreign loan issuing institution.
| | 第五条 国外贷款备选项目规划是项目对外开展工作的依据。借用国外贷款的项目必须纳入国外贷款备选项目规划。
未纳入国外贷款备选项目规划的项目，国务院各有关部门、地方各级政府和项目用款单位不得向国际金融组织或外国政府等国外贷款机构正式提出贷款申请。

Article 6 The department of development and reform of the State Council shall compile plans for projects prepared for foreign loans in light of national economic and social development plans, industry policies, foreign debt administration, and the principles and requirements for the use of foreign loans, and issue an annual plan for signing project contracts on this basis.
The plans for projects prepared for the selection of the loans of the World Bank, Asian Development Bank and Japanese yen of the Japan Government shall be put forward by the department of development and reform of the State Council, and be reported to the State Council for approval after negotiating with the finance department of the State Council.
| | 第六条 国务院发展改革部门按照国民经济和社会发展规划、产业政策、外债管理及国外贷款使用原则和要求，编制国外贷款备选项目规划，并据此制定、下达年度项目签约计划。
世界银行、亚洲开发银行贷款和日本政府日元贷款备选项目规划由国务院发展改革部门提出，商国务院财政部门后报国务院批准。

Article 7 The competent departments in charge of the corresponding industries of the State Council, the provincial departments of development and reform, enterprise groups under separate planning, and the enterprises directly under the Central Government shall declare to the department and reform department of the State Council for the projects prepared for the selection of foreign loans.
In case any local government arranges for the supporting funds, undertakes liabilities for the repayment of loans or provides loan guaranty for the projects declared by the competent department in charge of a certain industry of the State Council, it shall issue the opinions of the provincial department of development and reform and other relevant departments at the same time.
| | 第七条 国务院行业主管部门、省级发展改革部门、计划单列企业集团和中央管理企业向国务院发展改革部门申报纳入国外贷款规划的备选项目。
国务院行业主管部门申报的项目，由地方政府安排配套资金、承担贷款偿还责任或提供贷款担保的，应当同时出具省级发展改革部门及有关部门意见。

Article 8 The materials for the declaration of any project prepared for being included in the plans for foreign loans shall include the following contents:
| | 第八条 申报纳入国外贷款规划的备选项目材料包括以下内容：

1. The brief information of the project;
| | （一）项目简要情况；
|
2. The necessities for the construction of the project;
| | （二）项目建设必要性；
|
3. The type of foreign loans to be applied for or the country thereof;
| | （三）拟申请借用国外贷款的类别或国别；
|
4. The amount and use of the loan; and
| | （四）贷款金额及用途；
|
5. Liabilities for repayment of the loan.
| | （五）贷款偿还责任。
|
Article 9 For any project that has been included in the plan for projects prepared for the loans of international financial organizations or the Japanese yen of the Japan Government, if there is necessity to adjust or revoke the source of the loan, the contents of adjustment shall be reported to the department of development and reform of the State Council in light of the procedures as prescribed in Article 7 of the present Measures.
For any project that has been included in the plan for projects prepared for other foreign government loans, if there is necessity to adjust the source of the loan, the contents of adjustment shall be reported for approval during the examination and approval stage of the application report for the project fund.
| | 第九条 已纳入国际金融组织贷款、日本政府日元贷款备选项目规划的项目，如需调整贷款来源或撤销贷款的，应当将调整内容按照本办法第七条规定的程序报国务院发展改革部门。
纳入其他外国政府贷款备选项目规划的项目，如需调整贷款来源的，应当将调整内容在项目资金申请报告审批阶段一并报批。

Article 10 In case any project formerly approved for using other funds is planning to apply for using any foreign loan, or any project that has been approved for using foreign loans is planning to use other funds, it shall report to the department of development and reform of the State Council in accordance with the provisions of Article 7 of the present Measures.
