The Measures for the Administration of Bidding on Electromechanical Equipment of Water Carriage Projects, which were adopted at the executive meeting of this Ministry, are hereby promulgated, and shall be implemented as of December 1, 2004.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 With a view to regulating the activities of bidding on electromechanical equipment of water carriage projects, ensuring the quality of the electromechanical equipment of water carriage projects, and protecting the legitimate rights and interests of the parties concerned, the present Measures are formulated in accordance with the Bidding Law of the People's Republic of China, the Government Procurement Law of the People's Republic of China and the relevant state provisions.
| | 第一条 为规范水运工程机电设备招标投标活动，保证水运工程机电设备质量，保护各方当事人的合法权益，依据《中华人民共和国招标投标法》、《中华人民共和国政府采购法》和国家有关规定，制定本办法。
|
Article 2 The present Measures shall be applicable to the procurement of electromechanical equipment of capital construction items of water carriage projects and technical reform projects within the territory of the People's Republic of China.
The electromechanical equipment of water carriage projects shall refer to such equipment as the machinery equipment, electric equipment and vehicles and vessels in items of port projects, sea-route projects, shipping hinge projects, projects of buildings open to navigation, and hydropower buildings projects for shipbuilding and maintenance.
| | 第二条 本办法适用于中华人民共和国境内水运工程基本建设项目和技术改造项目的机电设备采购。
水运工程机电设备是指港口工程、航道工程、航运枢纽工程、通航建筑物工程、修造船水工建筑物工程项目中的机械、电气、车船等设备。

Article 3 Bid invitation shall be conducted for the procurement of electromechanical equipment. In any one of the following circumstances, bid invitation may not be conducted:
| | 第三条 机电设备的采购应当进行招标。属于下列情形之一的，可以不进行招标：
|
1.the electromechanical equipment may only be obtained from a single manufacturer;
| | （一）只能从唯一制造商获得的；
|
2.the procurement activity involves national security and secrets;
| | （二）采购活动涉及国家安全和秘密的；
|
3. the single contract is under RMB 1 million Yuan, and the total investment of the project is less than RMB 30 million Yuan; or
| | （三）单项合同在100万元以下，且项目总投资在3000万元以下的；
|
4. there are different provisions by any law or regulation.
| | （四）法律、法规另有规定的。
|
Article 4 The principle of openness, fairness, justness and honesty and good faith shall be followed for the activities of bidding on electromechanical equipment of water carriage projects.
| | 第四条 水运工程机电设备招标投标活动，应遵循公开、公平、公正和诚实信用的原则。
|
Article 5 The unified leadership and administration by level shall be applied for the supervision and administration of activities of bidding on electromechanical equipment of water carriage projects.
The Ministry of Communications shall be responsible for the supervision and administration of activities of bidding on electromechanical equipment of water carriage projects nation wide.
The competent department of communications of the people's government at the provincial level shall be responsible for the supervision and administration of the activities of bidding on electromechanical equipment of water carriage projects within their own administrative districts.
The competent department of communications of the people's government at or above the county level shall investigate into and punish the illegal acts in the activities of bidding on electromechanical equipment of water carriage projects according to the power of project management.
| | 第五条 水运工程机电设备招标投标活动的监督管理实行统一领导、分级管理。
交通部负责全国水运工程机电设备招标投标活动的监督管理。
省级人民政府交通主管部门负责本行政区域内水运工程机电设备招标投标活动的监督管理。
县级以上人民政府交通主管部门按照项目管理权限，依法查处水运工程机电设备招标投标活动中的违法行为。 |
Chapter II Invitation to Bid
| | 第二章 招标
|
Article 6 The tenderee in the electromechanical equipment of water carriage projects shall be a legal person or any other organization that proposes the electromechanical equipment project for bid invitation and carries out the bid invitation to electromechanical equipment in accordance with the provisions of the present Measures.
| | 第六条 水运工程机电设备的招标人，是依照本办法规定提出机电设备招标项目、进行机电设备招标的法人或者其他组织。
|
Article 7 The tenderee that meets the following conditions may handle the bid invitation matters by itself:
| | 第七条 具备下列条件的招标人，可以自行办理招标事宜：
|
1. having the qualification of a legal person;
| | （一）具有法人资格；
|
2. having the capacity of technology and economic management and compilation of bid invitation documents matching the project for bid invitation;
| | （二）具有与招标项目相适应的技术、经济管理和编制招标文件的能力；
|
3. having the experiences for bid invitation for the similar projects;
| | （三）有同类项目招标的经验；
|
4. having corresponding business personnel for bid invitation and the capacity for organizing bid invitation and assessing the bid; and
| | （四）拥有相应的招标业务人员，具有组织招标、评标的能力；
|
5. being familiar with and mastering the bidding law and the relevant laws, regulations and rules.
If a tenderee does not have the conditions as prescribed in the preceding paragraph, it shall entrust a bid invitation agency that has the corresponding qualifications to handle the bid invitation matters.
No entity or individual may designate any bid invitation agency for any tenderee by any way.
| | （五）熟悉和掌握招标投标法及有关法律、法规、规章。
招标人不具备前款规定条件的，应当委托具有相应资格的招标代理机构办理招标事宜。
任何单位和个人不得以任何方式为招标人指定招标代理机构。

Article 8 For any project that shall be subject to bid invitation, if a tenderee handles the bid invitation matters by itself, it shall, 15 days before issuing announcement on bid invitation or bid invitation letter, report to the competent department of communications for archival filing according to the power of project management, of which, the large and medium-sized capital construction projects invested by the state and the technical reform construction projects above the quota shall be reported to the Ministry of Communications for archival filing, and a copy shall be sent to the competent administrative department of communications at the provincial level at the same time.
| | 第八条 必须进行招标的项目，招标人自行办理招标事宜的，应当在发布招标公告或者发出投标邀请书十五日前，按项目管理权限报交通主管部门备案，其中，国家投资的大中型基本建设项目及限额以上技术改造建设项目报交通部备案，并同时抄送省级交通行政主管部门。

Article 9 Bid invitations for electromechanical equipment of water carriage projects include open bid invitations and selective bid invitations.
The open bid invitation means a tenderee issues announcement on bid invitations through the newspapers and periodicals, information networks or other media as designated by the relevant departments of the State Council, and invites any legal person or other organization that is not specific to bid.
The selective bid invitations shall mean that a tenderee who, by way of bid invitation letter, invites more than three specific legal persons or other organizations that have the ability to undertake a project for bid invitations and with good credit standing to bid.
| | 第九条 水运工程机电设备招标分为公开招标和邀请招标。
公开招标是招标人通过国务院有关部门指定的报刊、信息网络或者其它媒介发布招标公告，邀请不特定的法人或者其他组织投标。
邀请招标是指招标人以投标邀请书的方式，邀请三个以上具备承担招标项目能力的、资信良好的特定法人或者其它组织投标。

Article 10 An open bid invitation shall be carried out for the bid invitations for electromechanical equipment of water carriage projects which are completely financed by state-owned funds or the investment of state-owned funds takes the controlling or leading position.
The state key projects determined by the department of development and reform of the State Council and the local key projects determined by the people's government of any province, autonomous region, and municipality directly under the Central Government, which are not suitable for being subject to open bid invitations, may be subject to selective bid invitations upon the approval of the department of development and reform of the State Council or the people's government of a province, autonomous region, and municipality directly under the Central Government.
| | 第十条 全部使用国有资金投资或者国有资金投资占控股或者主导地位的水运工程项目的机电设备招标，应当公开招标。
国务院发展和改革部门确定的国家重点项目和省、自治区、直辖市人民政府确定的地方重点项目不适宜公开招标的，经国务院发展和改革部门或者省、自治区、直辖市人民政府批准，可以进行邀请招标。

Article 11 The bid invitation for electromechanical equipment of water carriage projects shall be organized by a tenderee and conducted according to the following procedures:
| | 第十一条 水运工程机电设备招标由招标人组织，按下列程序进行：
|
1. determining the ways of bid invitations;
| | （一）确定招标方式；
|
2. compiling bid invitation documents;
| | （二）编制招标文件；
|
3. submitting the bid invitation documents to the competent department of communications for archival filing;
| | （三）招标文件报送交通主管部门备案；
|
4. publicizing announcement on bid invitations or sending out bid invitation letter;
| | （四）发布招标公告或发出投标邀请书；
|
5. selling or issuing bid invitation documents;
| | （五）出售或发放招标文件；
|
6. convening meetings before bid invitations if necessary, and answering questions;
| | （六）必要时召开标前会，并进行答疑；
|
7. receiving the bid documents of the tenderer;
| | （七）接收投标人的投标文件；
|
8. opening of bid, and examining the bid documents;
| | （八）开标，审查投标文件；
|
9. establishing bid assessment committee, assessing the bid according to the bid assessment method, bringing forward bid assessment report and recommending candidates for bid winning;
| | （九）组建评标委员会，依据评标办法评标，提出评标报告，推荐中标候选人；
|
10. reporting the assessment report and the assessment result to the competent department of communications for archival filing;
| | （十）将评标报告、评标结果报交通主管部门备案；
|
11. determining the bid winner and issuing the notice of bid winning; and
| | （十一）确定中标人，发出中标通知书；
|
12. signing contract for purchasing the electromechanical equipment of water carriage projects with the bid winner.
| | （十二）与中标人签订水运工程机电设备采购合同。
|
Article 12 The announcement on bid invitations (bid invitation letter) shall cover the following main contents:
| | 第十二条 招标公告（投标邀请书）应当包括以下主要内容：
|
1. the name and address of the tenderee;
| | （一）招标人的名称和地址；
|
2. the basis of bid invitations;
| | （二）招标依据；
|
3. the general situation of the project for bid invitations, including the name of the equipment to be purchased, scope of bid invitations, time of goods supply and the capital resources, and etc.;
．．．．．． | | （三）招标项目的概况，包括采购设备的名称、招标范围、供货时间和资金来源等；
