Some Rules Set Forth by the Supreme People's Court for Strictly Abiding by the Time Limits for Case Hearing and Execution have been adopted by the Meeting NO. 1130 of the Case Hearing Commission of the Supreme People's Court and are hereby published for implementation on September 28, 2000.

Some Rules set forth by the Supreme People's Court for Strict Observance of the Time Limits for Case Hearing and Execution
(Adopted by the Meeting No. 1130 of the Case Hearing Commission of the Supreme People's Court, Fashi <2000> No. 29)
In order to improve the efficiency for case hearing and to guarantee judicial justice, the following rules for strictly abiding by the time limits for case hearing are formulated in accordance with the Penal Procedural Law, Civil Procedural Law, Administrative Procedural Law and Special Procedural Law for Maritime Litigation:

为提高诉讼效率,确保司法公正,根据刑事诉讼法民事诉讼法行政诉讼法海事诉讼特别程序法的有关规定,现就人民法院执行案件审理期限制度的有关问题规定如下:
1.Time limits for case hearing and execution procedures of all types of cases
 一、各类案件的审理、执行期限
Article 1. The time limit is one month for hearing by using the ordinary procedure criminal cases of the first instance raised by public prosecution, criminal cases of the first instance raised by a private party and of which the defendant is already under custody, and criminal cases of the second instance raised by public prosecution or by a private party. If extension is needed, the time limit can not be longer than one a d half months. If the criminal cases are supplemented by civil actions, upon approval by the President of Court, the time limit can be extended for two months. If the case involves a situation as provided by Article 126 of the Penal Procedural Law, upon approval by the President of the People's High Court of a province, autonomous region or directly-controlled city, the time limit can be extended for another one month. For a criminal case of the second instance or of the protest procedure heard by the Supreme People's Court, upon decision by the Supreme People's Court, the time limit can be further extended for another month.
The time limit is six months for hearing by using the ordinary procedure criminal cases of the first instance raised by a private party and of which the defendant is not yet under custody. If extension is needed, upon approval of the President of the Court, the time limit can be extended for three months.
The time limit is twenty days for hearing criminal cases by using the simplified procedure.
   第一条 适用普通程序审理的第一审刑事公诉案件、被告人被羁押的第一审刑事自诉案件和第二审刑事公诉、刑事自诉案件的期限为一个月,至迟不得超过一个半月;附带民事诉讼案件的审理期限,经本院院长批准,可以延长两个月。有刑事诉讼法一百二十六条规定情形之一的,经省、自治区、直辖市高级人民法院批准或者决定,审理期限可以再延长一个月;最高人民法院受理的刑事上诉、刑事抗诉案件,经最高人民法院决定,审理期限可以再延长一个月。
适用普通程序审理的被告人未被羁押的第一审刑事自诉案件,期限为六个月;有特殊情况需要延长的,经本院院长批准,可以延长三个月。
适用简易程序审理的刑事案件,审理期限为二十日。
Article 2. The time limit is six months for hearing by using the ordinary procedure civil cases of the first instance. If extension is needed, upon approval of the President of the Court, the time limit can be extended for six months. If further extension is needed, upon approval by the President of the People's Court at a higher level, the time limit can be extended for another three months.
The time limit is three months for hearing civil cases by using the simplified procedure.
The time limit is thirty days for hearing civil cases by using the special procedure. If extension is needed, upon approval of the President of the Court, the time limit can be extended for thirty days; however, for cases concerning voting qualification, the hearing shall be completed before the voting day.
The time limit is one year for hearing maritime cases of the first instance concerning collision of ships or general average. If extension is needed, upon approval of the President of the Court, the time limit can be extended for six months. 
The time limit is three months for hearing civil cases of the second instance. If extension is needed, upon approval of the President of the Court, the time limit can be extended for three months. 
The time limit is thirty days for hearing civil cases of the second instance concerning a civil order.
The time limit is five days for hearing cases concerning a civil decision of fines or detention.
The above time limits do not apply to cases with foreign elements involved in accordance with Article 250 of the Civil Procedural Law.
The above time limits do not apply to civil cases involving Hong Kong, Macao or Taiwan elements either.
   第二条 适用普通程序审理的第一审民事案件,期限为六个月;有特殊情况需要延长的,经本院院长批准,可以延长六个月,还需延长的,报请上一级人民法院批准,可以再延长三个月。
适用简易程序审理的民事案件,期限为三个月。
适用特别程序审理的民事案件,期限为三十日;有特殊情况需要延长的,经本院院长批准,可以延长三十日,但审理选民资格案件必须在选举日前审结。
审理第一审船舶碰撞、共同海损案件的期限为一年;有特殊情况需要延长的,经本院院长批准,可以延长六个月。
审理对民事判决的上诉案件,审理期限为三个月;有特殊情况需要延长的,经本院院长批准,可以延长三个月。
审理对民事裁定的上诉案件,审理期限为三十日。
对罚款、拘留民事决定不服申请复议的,审理期限为五日。
审理涉外民事案件,根据民事诉讼法二百五十条的规定,不受上述案件审理期限的限制。
审理涉港、澳、台的民事案件的期限,参照涉外审理民事案件的规定办理。
Article 3. The time limit is three months for hearing administrative cases of the first instance. If extension is needed, upon approval of the People's High Court, the time limit can be extended for three months. If the case is heard by the People's High Court and extension is needed, upon approval by the Supreme People's Court, the time limit can be extended for three months.
The time limit is two months for hearing administrative cases of the second instance. If extension is needed, upon approval of the People's High Court, the time limit can be extended for two months. If the case is heard by the People's High Court and extension is needed, upon approval by the Supreme People's Court, the time limit can be extended for two months.  
   第三条 审理第一审行政案件的期限为三个月;有特殊情况需要延长的,经高级人民法院批准可以延长三个月。高级人民法院审理第一审案件需要延长期限的,由最高人民法院批准,可以延长三个月。
审理行政上诉案件的期限为两个月;有特殊情况需要延长的,由高级人民法院批准,可以延长两个月。高级人民法院审理的第二审案件需要延长期限的,由最高人民法院批准,可以延长两个月。
Article 4. The time limit is three months for re-hearing criminal cases by using the procedure of adjudication supervision. If extension is needed, upon approval of the President of the Court, the time limit can be extended for three months.

   第四条 按照审判监督程序重新审理的刑事案件的期限为三个月;需要延长期限的,经本院院长批准,可以延长三个月。
