The Measures for the Administration of License of Design, Production, Maintenance and Import of Railway Locomotives, which were adopted at the 3rd minister's working meeting of the Ministry of Railways on March 29, 2005, are hereby promulgated, and shall come into force on April 1, 2005.

Article 1 These Measures are formulated in accordance with the Regulation on the Protection of Railway Transport Safety so as to strengthen the administration of railway locomotives, and guarantee railway transport safety.
| | 第一条 为加强对铁路机车车辆的管理，确保铁路运输安全，根据《铁路运输安全保护条例》，制定本办法。

Article 2 Railway locomotives as mentioned in these Measures include various railway locomotives, vehicles, motor cars teams, rail vehicles, large railway maintenance machines, rescue vehicles and other special self-rolling equipment which have entered the railways in China for use. The Ministry of Railways shall formulate and promulgate the catalogue of railway locomotive types, and shall, in light of the needs, make adjustments at proper times to the scope of products listed in the catalogue.
| | 第二条 本办法所称铁路机车车辆包括进入中国铁路使用的各类铁路机车、车辆、动车组、轨道车、大型养路机械、救援车及其他自轮运转特种设备。铁道部应当制定并公布铁路机车车辆类型目录，并根据需要对目录所列产品范围适时进行调整。

Article 3 The design, production, maintenance or import of new-type railway locomotives shall be licensed by the Ministry of Railways. If any designer succeeds in designing a new-type locomotive, it shall pass the technical authentication and obtain the certificate of qualified type. An applicant concerned shall obtain the production permit before the product under the certificate of qualified type is put into production in batches. Whoever intends to engage in locomotive maintenance shall obtain the certificate of qualified maintenance. Whoever intends to import a new-type locomotive shall, before formally concluding the supply contract, obtain the type accreditation certificate.
| | 第三条 设计、生产、维修或者进口新型的铁路机车车辆，应当经铁道部许可。设计出新型的机车车辆，应当通过技术鉴定并取得型号合格证；取得型号合格证的产品，在投入批量生产之前，应当取得生产许可证；从事机车车辆维修业务，应当取得维修合格证；进口新型的机车车辆，在正式签订供货合同前，应当取得型号认可证。

Article 4 The design, production, maintenance or import of new-type railway locomotives shall conform to the State's industry development policies, technical development policies, the requirements of modernization of railway equipment, and meet the demands of railway users, as well.
| | 第四条 设计、生产、维修或者进口新型的铁路机车车辆应当符合国家产业发展政策、技术发展政策及铁路装备现代化的要求，符合铁路用户的需求。

Article 5 An applicant who intends to obtain a certificate of qualified type shall meet the following conditions:
| | 第五条 取得型号合格证应当具备下列条件：
|
(1) The technical conditions and design program of the sample locomotive have passed the examination;
| | （一）样车技术条件、设计方案通过审查；
|
(2) The key parts and the complete vehicle have passed the pattern test;
| | （二）关键部件和整车通过型式试验；
|
(3) The sample locomotive is qualified from running assessment, working assessment and disassembly check;
| | （三）样车运行考核、作业考核及解体检查合格；
|
(4) The sample locomotive is qualified from technical authentication;
| | （四）样车技术鉴定合格；
|
(5) The applicant shall have corresponding professional design technicians, complete product quality guaranty systems and management systems, complete technical conditions, and the capacity to guarantee the design and manufacture; and
| | （五）申请人应有相应的专业设计技术人员，有完备的产品质量保证体系和管理制度，有完备的技术条件和保证设计制造的能力；
|
(6) Other conditions prescribed in any law or regulation.
| | （六）法律法规规定的其他条件。
|
Article 6 An applicant who applies for a certificate of qualified type shall submit the following materials:
| | 第六条 申请型号合格证应当提交下列材料：
|
(1) the application letter for administrative license;
| | （一）行政许可申请书；
|
(2) the report on demonstration of technical conditions of the sample locomotive, and the design program;
| | （二）样车技术条件论证报告、设计方案；
|
(3) basic information on professional technicians, and the information on the product quality guaranty systems and management systems, etc.;
| | （三）专业技术人员基本情况，产品质量保证体系和管理制度等资料；
|
(4) the statement materials on producing equipment and other design and manufacture capacities; and
| | （四）生产设备等设计制造能力的说明材料；
|
(5) other materials required by any law or regulation.
| | （五）法律法规要求的其他材料。
|
Article 7 An applicant who intends to obtain a production permit shall meet the following conditions:
| | 第七条 取得生产许可证应当具备下列条件：
|
(1) The products to be produced must be generally testified upon strength of the certificate of qualified type (such products include the products which have passed the running assessment, working assessment or disassembly check of sample locomotive, and the products approved by the Ministry of Railways to be produced);
| | （一）拟生产的产品原则上必须是取得型号合格证的产品（含通过样车运行考核和作业考核及解体检查，铁道部批准生产的产品）；
|
(2) The program on producing the locomotive and the technical preparation report have passed the examination;
| | （二）机车车辆生产及技术准备报告通过审查；
|
(3) The applicant has passed the pattern test on such products (except the products for which the certificates of qualified type have been issued);
| | （三）型式试验合格（已取得型号合格证的产品除外）；
|
(4) The applicant has passed the technical examination on production of the sample locomotive;
| | （四）通过生产样车的技术审查；
|
(5) The applicant's main management staff shall have corresponding production management abilities and experiences;
| | （五）申请人的主要管理人员应具备相应的生产管理能力和经验；
|
(6) The applicant shall have corresponding professional technicians, complete product quality guaranty systems and management systems, as well as complete technical conditions and the ability to ensure continuous manufacture in batches;
| | （六）申请人应具有相应的专业技术人员，有完备的产品质量保证体系和管理制度，有完备的技术条件和保证持续批量制造的能力；
|
(7) There were no severe ill records in recent 3 years on the quality of the relevant products produced by the applicant; and
| | （七）申请人已生产的相关产品近3年内无严重质量不良记录；
|
(8) The applicant meets other requirements prescribed in any law or regulation.
| | （八）符合法律法规规定的其他要求。

Article 8 An applicant who applies for a production permit shall submit the following materials:
| | 第八条 申请生产许可证应当提交下列材料：
|
(1) the application letter for administrative license;
| | （一）行政许可申请书；
|
(2) a photocopy of the certificate of qualified type or the technology transfer testimonial;
| | （二）型号合格证复印件或技术转让证明材料；
|
(3) the type approval drawing approved by the Ministry of Railways;
| | （三）铁道部批准的定型图纸；
|
(4) the producing report and the technical preparation report;
| | （四）生产及技术准备报告；
|
(5) basic information on the main management staff;
| | （五）主要管理人员基本情况；
|
(6) basic information on professional technicians, and the information on the product quality guaranty systems and management systems, etc.;
| | （六）专业技术人员基本情况，产品质量保证体系和管理制度等资料；
|
(7) the statement materials on producing equipment and other manufacture capacities;
| | （七）生产设备等制造能力的说明材料；
|
(8) the business license (counterpart) of the enterprise legal person; and
| | （八）企业法人营业执照（副本）；
|
(9) other materials required by any law or regulation.
