To strengthen the work of administrative punishment of the China Securities Regulatory Commission, this Commission has formulated the Measures for the Composition of the Administrative Punishment Committee, which are hereby announced.

为了加强中国证券监督管理委员会的行政处罚工作，我会制定了《行政处罚委员会组成办法》，现予公告。

Article 1 To establish and enhance a securities law enforcement system with Chinese characteristics and improve the work of administrative punishment of the China Securities Regulatory Commission (“CSRC”), these Measures have been formulated in accordance with the provisions of the Securities Law, Administrative Punishment Law, and other laws and administrative regulations.
| | 第一条 为了建立健全有中国特色的证券执法体制，完善中国证券监督管理委员会（以下简称中国证监会）的行政处罚工作，根据《证券法》、《行政处罚法》等法律和行政法规的规定，制定本办法。

Article 2 The CSRC shall establish an Administrative Punishment Committee.
The Administrative Punishment Committee shall consist of one chairman and several vice-chairmen and other members.
| | 第二条 中国证监会设立行政处罚委员会。
行政处罚委员会设主任委员1人，副主任委员及委员若干人。

Article 3 The members on the Administrative Punishment Committee shall comprise the staff of the CSRC and experts of other institutions such as securities and futures exchanges, and be appointed by the CSRC.
| | 第三条 行政处罚委员会委员由中国证监会的工作人员和证券、期货交易所等其他机构的专家组成，由中国证监会聘任。

Article 4 The Administrative Punishment Committee shall adopt a “Presiding-collegiality” system for adjudication of cases, i.e., an administrative punishment case shall be adjudicated by one member as presiding adjudicator and two members as collegial adjudicators.
The major, difficult and complicated cases shall be collectively discussed and studied by the Administrative Punishment Committee.
| | 第四条 行政处罚委员会实行“主审-合议”的案件审理制度，行政处罚案件由一名委员主审，两名委员合议。
重大、疑难、复杂案件由行政处罚委员会集体讨论、研究。

Article 5 The members on the Administrative Punishment Committee shall be subject to the withdrawal system in adjudication or hearing according to the relevant provisions.
| | 第五条 行政处罚委员会委员在审理或听证时按照有关规定实行回避制度。

Article 6 In the work of administrative punishment, the members and other staff of the Administrative Punishment Committee shall adhere to the facts and take the law as the yardstick, insist on handling cases impartially, strictly abide by the requirements of all provisions on integrity and self-discipline of the CSRC, and handle cases fairly and impartially.
