(No. 13)
The Decision on Amending the Detailed Rules for the Implementation of the Regulation on National Science and Technology Awards, which was deliberated and adopted at the 27 executive meeting of the Ministry of Science and Technology on November 13, 2008, is hereby promulgated and shall come into force on February 1, 2009.

Decision on Amending the Detailed Rules for the Implementation of the Regulation on National Science and Technology Awards
To do a better job in the national science and technology awards and ensure the evaluation quality of the national science and technology awards, we hereby amend the Detailed Rules for the Implementation of the Regulation on National Science and Technology Awards (Order No. 9 of the Ministry of Science and Technology), which were promulgated on December 24, 1999 and amended on December 27, 2004 for the first time by the Ministry of Science and Technology, as follows:

《关于修改〈国家科学技术奖励条例实施细则〉的决定》已经2008年11月13日科学技术部第27次部务会议审议通过，现予公布，自2009年2月1日起施行。

关于修改《国家科学技术奖励条例实施细则》的决定
为进一步做好国家科学技术奖励工作，保证国家科学技术奖的评审质量，现对科学技术部1999年12月24日公布、2004年12月27日修改的《国家科学技术奖励条例实施细则》（科学技术部令第9号）作如下修改：

1. The provisions on “Demurral Disposal” in Chapter VI are changed into a separate chapter as Chapter V, and the sequence number of other chapters shall be changed accordingly. Chapter IV “Recommendation” is amended as “Recommendation and Acceptance”. Chapter VII “Award Granting” is amended as “Approval and Award Granting”. Chapter VI “Supervision and Demurral Disposal” is adjusted as Chapter VIII and amended as “Supervision and Punishment”.
| | 一、将第六章中“异议处理”部分的规定单独作为一章，作为第五章，其他章节序号顺延。第四章“推荐”修改为“推荐和受理”。第七章“授奖”修改为“批准和授奖”。第六章“监督及异议处理”调整为第八章，并修改为“监督及处罚”。

2. Article 3 is amended as: “We shall deeply carry out the scientific development view and the guidelines of ‘respecting work, knowledge, talents and creation' through the grant of national science and technology awards, encourage collaboration and cooperation in tackling crucial problems, encourage independent innovation, encourage the climbing up to the pinnacle of science and technology, promote the close combination of scientific research and technological development with economic and social development, promote the transformation of scientific and technological achievements into actual productivity, promote the construction of the national innovation system, create an environment encouraging innovation, strive to train and foster world-class scientists, leaders in science and technology and frontline talents in innovation, accelerate the implementation of the strategies of developing the country by relying on science and education, revitalizing the country through strong human resources and emphasizing sustainable development, and boost the construction of an innovation-oriented country.”
| | 二、第三条修改为：“国家科学技术奖励工作深入贯彻落实科学发展观和‘尊重劳动、尊重知识、尊重人才、尊重创造'的方针，鼓励团结协作、联合攻关，鼓励自主创新，鼓励攀登科学技术高峰，促进科学研究、技术开发与经济、社会发展密切结合，促进科技成果向现实生产力转化，促进国家创新体系建设，营造鼓励创新的环境，努力造就和培养世界一流科学家、科技领军人才和一线创新人才，加速科教兴国、人才强国和可持续发展战略的实施，推进创新型国家建设。”

3. Article 4 is amended as: “The recommendation, appraisal and granting of national science and technology awards shall be based on the principles of openness, fairness and justness, subject to a scientific appraisal system and free of illegal intervention by any organization or individual.”
| | 三、第四条修改为：“国家科学技术奖的推荐、评审和授奖，遵循公开、公平、公正的原则，实行科学的评审制度，不受任何组织或者个人的非法干涉。”

4. The phrase “more than one year” in Article 13, Article 20 and Article 31 (2) is amended as “more than three years”.
| | 四、将第十三条、第二十条和第三十一条第二项中的“一年以上”修改为“三年以上”。

5. Article 26 is amended as: “The term “major engineering projects” as mentioned in item (4), paragraph 1, Article 11 of the Regulation on Awards refers to such projects as key comprehensive capital construction projects, science and technology projects, national defense projects and enterprise technological innovation projects.”
| | 五、第二十六条修改为：“奖励条例第十一条第一款 （四） 所称‘重大工程项目'，是指重大综合性基本建设工程、科学技术工程、国防工程及企业技术创新工程等。”

6. Article 30 is amended as: “The number of persons to be granted the first prize of the National Science and technology Progress Award in a single item shall not exceed 15, and the number of entities shall not exceed 10. The number of persons to be granted the second prize in a single item shall not exceed 10, and the number of entities shall not exceed 7. The number of persons to be granted the top prize in a single item shall not exceed 50, and the number of entities shall not exceed 30.”
| | 六、第三十条修改为：“国家科学技术进步奖一等奖单项授奖人数不超过15人，授奖单位不超过10个；二等奖单项授奖人数不超过10人，授奖单位不超过7个；特等奖单项授奖人数不超过50人，授奖单位不超过30个。”

7. Article 44 is amended as: “Where any member of any appraisal committee of national science and technology awards is unable to attend a meeting for some reason, which is likely to affect the normal work of appraisal, such a member may be replaced by a member of the relevant appraisal group or an expert accredited by the Ministry of Science and Technology as eligible for conducting appraisal, who shall enjoy equal rights with other members of the committee. The specific candidate shall be nominated by the secretary general of the appraisal committee and approved by the director of the corresponding appraisal committee.”
| | 七、第四十四条修改为：“国家科学技术奖各评审委员会的委员因故不能出席会议，可能影响评审工作正常进行时，可以由相关评审组的委员或者经科学技术部认定具备评审资格的专家代替，并享有与其他委员同等的权利。具体人选由评审委员会秘书长提名，经相应评审委员会主任委员批准。”

8. Paragraph 2 of Article 50 is deleted.

9. Article 53 is amended as: “Where there is any dispute over intellectual property right or over the entity or person accomplishing a project, which is pending litigation, arbitration, administrative ruling or administrative reconsideration, such a project shall not be recommended for participation in the appraisal of national science and technology awards before the dispute is settled.”
