Announcement of the Supreme People's Court
The Several Provisions of the Supreme People's Court concerning Further Strengthening the Functions of Collegial Panels, which were adopted at the 1479th Meeting of the Judicial Committee of the Supreme People's Court on December 14, 2009, are hereby promulgated and shall come into force as of February 1, 2010.

Several Provisions of the Supreme People's Court concerning Further Strengthening the Functions of Collegial Panels
(Adopted at the 1479th Meeting of the Judicial Committee of the Supreme People's Court on December 14, 2009; No.1 [2010] Judicial Interpretation of SPC)
These Provisions are formulated in accordance with the Law of the People's Republic of China on the Organization of the People's Courts and other relevant legal provisions and in light of the actualities of work of the people's courts, for the purpose of further strengthening and optimizing the judicial functions of collegial panels.

最高人民法院关于进一步加强合议庭职责的若干规定
（法释〔2010〕1号）
为了进一步加强合议庭的审判职责，充分发挥合议庭的职能作用，根据《中华人民共和国人民法院组织法》和有关法律规定，结合人民法院工作实际，制定本规定。

Article 1 Collegial panels are the basic judicial organizations in the people's courts. All members of a collegial panel shall equally participate in the hearings, deliberations and judgments of cases, and perform their judicial functions according to law.
| | 第一条 合议庭是人民法院的基本审判组织。合议庭全体成员平等参与案件的审理、评议和裁判，依法履行审判职责。

Article 2 A collegial panel shall be composed of judges (including deputy judges) or composed of judges (including deputy judges) and randomly selected people's jurors. Collegial panels with relatively fixed members shall maintain regular exchange among the members. If people's jurors participate in a collegial panel, they shall be randomly selected from the list of people's jurors.
| | 第二条 合议庭由审判员、助理审判员或者人民陪审员随机组成。合议庭成员相对固定的，应当定期交流。人民陪审员参加合议庭的，应当从人民陪审员名单中随机抽取确定。

Article 3 The handling judge shall perform the following functions:
| | 第三条 承办法官履行下列职责：
|
1. Lead or guide ancillary judicial personnel in pre-trial preparations, such as pre-trial mediation and exchange of evidence;
| | （一）主持或者指导审判辅助人员进行庭前调解、证据交换等庭前准备工作；
|
2. Draft outlines of court hearings and make records of file review;
| | （二）拟定庭审提纲，制作阅卷笔录；
|
3. Assist the presiding judge in organizing court hearings;
| | （三）协助审判长组织法庭审理活动；
|
4. Prepare a trial report in a timely manner within the specified time period;
| | （四）在规定期限内及时制作审理报告；
|
5. Report a case to the Judicial Committee as assigned by the presiding judge, if the case needs to be submitted to the Judicial Committee for discussion;
| | （五）案件需要提交审判委员会讨论的，受审判长指派向审判委员会汇报案件；
|
6. Prepare a judgement document and submit it to the collegial panel for adoption; and
| | （六）制作裁判文书提交合议庭审核；
|
7. Handle other matters relating to the trial.
| | （七）办理有关审判的其他事项。

Article 4 All members of a collegial panel shall review the files of a case which is tried without court hearing according to law, and submit written file review opinions when necessary.
