The Law of the People's Republic of China on the Prevention and Treatment of Occupational Diseases has been adopted at the 24th meeting of the Standing Committee of the Ninth People's Congress of the People's Republic of China on Oct.27, 2001, and is hereby promulgated and shall come into force on May 1, 2002.

 Chapter 1 General Provisions
 第一章 总则


Article 1 This Law is enacted in accordance with the Constitution in order to prevent, control and eliminate the harm of occupational diseases, to prevent and treat occupational diseases, to protect the health and relevant rights and interests of the laborers, and to promote the economic development.
   第一条 为了预防、控制和消除职业病危害,防治职业病,保护劳动者健康及其相关权益,促进经济发展,根据宪法,制定本法。
Article 2 This law shall apply to the prevention and treatment of occupational diseases within the territory of the People's Republic of China.
The occupational diseases used in this Law refer to the diseases caused to the laborers of enterprises, public institutions and individual economic organizations (hereinafter referred to as the employing work units) by touching the factors such as powder and dust, radioactive materials and other poisonous and harmful materials in their occupational activities.
The classification and catalog of occupational diseases shall be provided for, adjusted and promulgated by the administrative department of health under the State Council together with the administrative department of labor protection under the State Council.
   第二条 本法适用于中华人民共和国领域内的职业病防治活动。
本法所称职业病,是指企业、事业单位和个体经济组织(以下统称用人单位)的劳动者在职业活动中,因接触粉尘、放射性物质和其他有毒、有害物质等因素而引起的疾病。
职业病的分类和目录由国务院卫生行政部门会同国务院劳动保障行政部门规定、调整并公布。
Article 3 The prevention and treatment of occupational diseases shall adhere to the guideline of relying on prevention and combining prevention and treatment, and shall adopt classified administration and comprehensive treatment.
   第三条 职业病防治工作坚持预防为主、防治结合的方针,实行分类管理、综合治理。
Article 4 The laborers are entitled to the rights of occupational health protection according to law.
The employing work units shall create the work environment and conditions that meet the occupational health standards and health requirements of the State, and shall adopt measures to guarantee that laborers get occupational health protection.
   第四条 劳动者依法享有职业卫生保护的权利。
用人单位应当为劳动者创造符合国家职业卫生标准和卫生要求的工作环境和条件,并采取措施保障劳动者获得职业卫生保护。
Article 5 The employing work units shall establish and perfect the responsibility system of occupational disease prevention and treatment, strengthen the administration and improve the level of occupational disease prevention and treatment, and bear responsibilities for the harm of occupational diseases engendered therefrom.
   第五条 用人单位应当建立、健全职业病防治责任制,加强对职业病防治的管理,提高职业病防治水平,对本单位产生的职业病危害承担责任。
Article 6 The employing work units must purchase the social insurance of industrial injury.
The State Council and the administrative departments of labor protection of the local people's governments at the level of county and above shall strengthen the supervision and administration of the social insurance of industrial insurance, and ensure that the laborers enjoy the benefits of the social insurance of industrial injury.
   第六条 用人单位必须依法参加工伤社会保险。
国务院和县级以上地方人民政府劳动保障行政部门应当加强对工伤社会保险的监督管理,确保劳动者依法享受工伤社会保险待遇。
Article 7 The State shall encourage the manufacturing, development, spreading and application of the new technologies, new processes and new materials that can enhance the prevention and treatment of occupational diseases and the protection of labor health, and shall strengthen the basic research of the mechanism and law of the occurrence of occupational diseases, improve the scientific and technological level of the prevention and treatment of occupational diseases; actively apply effective technologies, processes and materials for the prevention and treatment of occupational diseases; and limit the use of or eliminate the technologies, processes and materials that engender serious occupational diseases.
   第七条 国家鼓励研制、开发、推广、应用有利于职业病防治和保护劳动者健康的新技术、新工艺、新材料,加强对职业病的机理和发生规律的基础研究,提高职业病防治科学技术水平;积极采用有效的职业病防治技术、工艺、材料;限制使用或者淘汰职业病危害严重的技术、工艺、材料。
Article 8 The State shall apply the occupational health supervision system.
The administrative department of health under the State Council shall be responsible for the uniform supervision and administration of the prevention and treatment of the occupational diseases of the whole country. And the relevant departments under the State Council shall be responsible for the relevant supervision and administration of the prevention and treatment of occupational diseases within their respective scope of functions and duties.
The administrative departments of health of the local people's governments at the level of county and above shall be responsible for the supervision and administration of the prevention and treatment of occupational diseases within their respective administrative areas. And the relevant departments of the local people's governments at the level of county and above shall be responsible for the relevant supervision and administration of occupational diseases within their respective scope of functions and duties.
   第八条 国家实行职业卫生监督制度。
国务院卫生行政部门统一负责全国职业病防治的监督管理工作。国务院有关部门在各自的职责范围内负责职业病防治的有关监督管理工作。
县级以上地方人民政府卫生行政部门负责本行政区域内职业病防治的监督管理工作。县级以上地方人民政府有关部门在各自的职责范围内负责职业病防治的有关监督管理工作。
Article 9 The State Council and the local people's governments at the level of county and above shall draw up plans on the prevention and treatment of occupational diseases, which shall be brought into the national economic and social development planning and be carried out.
The people's governments of the townships, autonomous townships of ethnic groups, and towns shall enforce this Law earnestly, and support the administrative departments of health to perform their functions and duties according to law.
   第九条 国务院和县级以上地方人民政府应当制定职业病防治规划,将其纳入国民经济和社会发展计划,并组织实施。
乡、民族乡、镇的人民政府应当认真执行本法,支持卫生行政部门依法履行职责。
Article 10 The administrative departments of health of the people's governments at the level of county and above and other relevant departments shall strengthen the publicity and education of the prevention and treatment of occupational diseases, spread the knowledge enhance the sense of the employers of the prevention and treatment of occupational diseases and improve the awareness of the laborers of self health protection.
   第十条 县级以上人民政府卫生行政部门和其他有关部门应当加强对职业病防治的宣传教育,普及职业病防治的知识,增强用人单位的职业病防治观念,提高劳动者的自我健康保护意识。
Article 11 The state occupational health standards on the prevention and treatment of occupational diseases shall be formulated and promulgated by the administrative department of health under the State Council.
   第十一条 有关防治职业病的国家职业卫生标准,由国务院卫生行政部门制定并公布。
Article 12 Any unit or individual has the right to report and accuse any violations of this Law.
The units and individuals that have make notable achievements in the prevention and treatment of occupational diseases shall be awarded.
   第十二条 任何单位和个人有权对违反本法的行为进行检举和控告。
对防治职业病成绩显著的单位和个人,给予奖励。

Chapter 2 Prophase Prevention
 第二章 前期预防


Article 13 Except that the establishment of the employing work unit engendering the harm of occupational diseases shall meet the requirements for establishment provided by laws and regulations, the work place shall also meet the following requirements for occupational health:
   第十三条 产生职业病危害的用人单位的设立除应当符合法律、行政法规规定的设立条件外,其工作场所还应当符合下列职业卫生要求:
1) the intensity or density of the elements engendering the harm of occupational diseases shall meet the requirements for occupational health of the State;
 (一)职业病危害因素的强度或者浓度符合国家职业卫生标准;
2) having the facilities fit for the protection against the harm of occupational diseases;
 (二)有与职业病危害防护相适应的设施;
3) the production layout shall be reasonable, and be in accordance with the principle of separating harmful operations and harmless operations;
 (三)生产布局合理,符合有害与无害作业分开的原则;
4) having accessory health facilities such as locker rooms, bathrooms, restrooms for pregnant women, etc;
 (四)有配套的更衣间、洗浴间、孕妇休息间等卫生设施;
5) the equipments, tools, appliances and other facilities shall meet the requirements for the protection of the physical and mental health of the laborers; and
 (五)设备、工具、用具等设施符合保护劳动者生理、心理健康的要求;
6) other requirements for the protection of the health of the laborers provided for by laws, regulations and the administrative department of health under the State Council.
 (六)法律、行政法规和国务院卫生行政部门关于保护劳动者健康的其他要求。
Article 14 The report system of projects engendering the harm of occupational diseases shall be established in the administrative departments of health.
Where the employing work unit has established the projects of the harm of occupational diseases listed in the occupational disease catalog legally promulgated, it shall report to the administrative departments of health promptly and according to the facts, and shall accept the supervision.
The specific measures for the report of projects of the harm of occupational diseases shall be formulated by the administrative department of health under the State Council.
   第十四条 在卫生行政部门中建立职业病危害项目的申报制度。
用人单位设有依法公布的职业病目录所列职业病的危害项目的,应当及时、如实向卫生行政部门申报,接受监督。
职业病危害项目申报的具体办法由国务院卫生行政部门制定。
Article 15 If the construction projects of new building, expanding, and rebuilding and the projects of technology reform and technology introduction (hereinafter referred to as construction projects in general) may engender the harm of occupational diseases, the construction unit shall submit the report on preliminary evaluation of the harm of occupational diseases to the administrative department of health at the phase of feasibility study. The administrative department of health shall, within 30 days since the day on which the report on preliminary evaluation of the harm of occupational diseases is received, make the examination decision and notify the construction unit in written form. And the relevant departments shall not approve the construction projects that haven't submitted the report on preliminary evaluation or of which the report on preliminary evaluation hasn't been approved by the administrative department through examination.
The preliminary evaluation of the harm of occupational diseases shall evaluate the harmful factors of occupational disease that may be engendered by the construction projects and the affection caused to the work place and to the health of the laborers, and shall determine the category of the harm and the protective measures against occupational diseases.
The classification catalog and the measures for classified administration of the harm of occupational diseases of construction projects shall be formulated by the administrative department of health under the State Council.
   第十五条 新建、扩建、改建建设项目和技术改造、技术引进项目(以下统称建设项目)可能产生职业病危害的,建设单位在可行性论证阶段应当向卫生行政部门提交职业病危害预评价报告。卫生行政部门应当自收到职业病危害预评价报告之日起三十日内,作出审核决定并书面通知建设单位。未提交预评价报告或者预评价报告未经卫生行政部门审核同意的,有关部门不得批准该建设项目。
职业病危害预评价报告应当对建设项目可能产生的职业病危害因素及其对工作场所和劳动者健康的影响作出评价,确定危害类别和职业病防护措施。
建设项目职业病危害分类目录和分类管理办法由国务院卫生行政部门制定。
Article 16 The expenses needed for the protective facilities against occupational diseases of the construction projects shall be incorporated into the project budget of the construction project, and the facilities shall be designed, constructed, and put into production and use at the same time as that of the main part of the project.
The design of the protective facilities of the construction projects that engender serious harm of occupational diseases shall go through health examination conducted by the administrative departments of health, and only those meeting the occupational health standards and health requirements of the State may be constructed.
The construction units shall make the evaluation of the result of the harm of occupational diseases control before the construction project is completed and checked for acceptance. When the construction project is completed and checked for acceptance, its protective facilities may be put into regular production and use only after passing the check for acceptance conducted by the administrative departments of health.
   第十六条 建设项目的职业病防护设施所需费用应当纳入建设项目工程预算,并与主体工程同时设计,同时施工,同时投入生产和使用。
职业病危害严重的建设项目的防护设施设计,应当经卫生行政部门进行卫生审查,符合国家职业卫生标准和卫生要求的,方可施工。
建设项目在竣工验收前,建设单位应当进行职业病危害控制效果评价。建设项目竣工验收时,其职业病防护设施经卫生行政部门验收合格后,方可投入正式生产和使用。
Article 17 The preliminary evaluation of the harm of occupational diseases and the evaluation of the effectiveness of controlling the harm of occupational diseases shall be conducted by the occupational health technological service agencies that have obtained the quality certification granted by the administrative departments of health of the people's governments at the provincial level and above. And the evaluation made by the occupational health technological service agencies shall be objective and true.
   第十七条 职业病危害预评价、职业病危害控制效果评价由依法设立的取得省级以上人民政府卫生行政部门资质认证的职业卫生技术服务机构进行。职业卫生技术服务机构所作评价应当客观、真实。
Article 18 The State shall apply the special administration of the operations such as radioactive operation, highly poisonous operation, etc. And the specific administration measures shall be formulated by the State Council.
   第十八条 国家对从事放射、高毒等作业实行特殊管理。具体管理办法由国务院制定。

Chapter 3 Protection and Management during the Labor Process
 第三章 劳动过程中的防护与管理


Article 19 The employing work unit shall adopt the following management measures for the prevention and treatment of occupational diseases:
   第十九条 用人单位应当采取下列职业病防治管理措施:
1) setting up or appointing the occupational health management agency or organization, and allocating full-time or part-time professional personnel of occupational health to be responsible for the prevention and treatment of the occupational diseases within the unit;
 (一)设置或者指定职业卫生管理机构或者组织,配备专职或者兼职的职业卫生专业人员,负责本单位的职业病防治工作;
2) drawing up plans and implementation schemes on the prevention and treatment of occupational diseases;
 (二)制定职业病防治计划和实施方案;
3) establishing and perfecting the management system and operation rules for occupational health;
 (三)建立、健全职业卫生管理制度和操作规程;
4) establishing and perfecting the occupational health archives and the laborer health protection archives;
 (四)建立、健全职业卫生档案和劳动者健康监护档案;
5) establishing and perfecting the monitoring and evaluating system of the harmful factors of occupational diseases; and
 (五)建立、健全工作场所职业病危害因素监测及评价制度;
6) establishing and perfecting the preparations for emergent treatment of the harm of occupational disease accidents.
 (六)建立、健全职业病危害事故应急救援预案。
Article 20 The employing work unit must adopt effective protective facilities against occupational diseases, and provide protective articles to the laborers for personal use against occupational diseases.
The protective articles for personal use provided by the employing work unit to the laborers must meet the requirements of the prevention and treatment of occupational diseases; and those failing to meet the requirements may not be used.
   第二十条 用人单位必须采用有效的职业病防护设施,并为劳动者提供个人使用的职业病防护用品。
用人单位为劳动者个人提供的职业病防护用品必须符合防治职业病的要求;不符合要求的,不得使用。
Article 21 The employing work unit shall adopt in priority the new technologies, new processes and new materials that enhance the prevention and treatment of occupational diseases and the protection of the health of laborers, and gradually replace the technologies, processes and materials that engender serious harm of occupational diseases.
   第二十一条 用人单位应当优先采用有利于防治职业病和保护劳动者健康的新技术、新工艺、新材料,逐步替代职业病危害严重的技术、工艺、材料。
Article 22 The employing work unit that engenders occupational disease harm shall set up bulletins at the eye-catching places to announce the rules and regulations, and the operation rules that are related to the prevention and treatment of occupational diseases, the measures for emergent treatment of the harm of occupational diseases accidents and the testing results of the harmful factors of the occupational diseases at the work place.
For the operation posts that engender serious harm of occupational diseases, warning marks and Chinese warning explanations shall be set up at the eye-catching places. And the warning explanations shall indicate the categories, results, and prevention of the occupational diseases engendered, and the emergent treatment measures, etc.
   第二十二条 产生职业病危害的用人单位,应当在醒目位置设置公告栏,公布有关职业病防治的规章制度、操作规程、职业病危害事故应急救援措施和工作场所职业病危害因素检测结果。
对产生严重职业病危害的作业岗位,应当在其醒目位置,设置警示标识和中文警示说明。警示说明应当载明产生职业病危害的种类、后果、预防以及应急救治措施等内容。
Article 23 For the poisonous and harmful work place where acute occupational injuries are likely to take place, the employing work unit shall set up alarming equipments, allocate on-spot emergent treatment articles, washing equipments, emergent withdrawal passages and necessary danger-releasing zones.
For the radioactive work place and the transport and storage of radioactive isotopes, the employing work unit must allocate protective facilities and alarming equipments, and ensure that the working personnel that contact the radiation carry the personal dosage gauge.
For the protective equipments against occupational diseases, emergent treatment facilities, and the protective articles for personal use against occupational diseases, the employing work unit shall conduct frequent maintenance, and examination and repair, check and measure their performance and effect regularly to ensure that they are in normal state, and may not demolish or stop using them without authorization.
   第二十三条 对可能发生急性职业损伤的有毒、有害工作场所,用人单位应当设置报警装置,配置现场急救用品、冲洗设备、应急撤离通道和必要的泄险区。
对放射工作场所和放射性同位素的运输、贮存,用人单位必须配置防护设备和报警装置,保证接触放射线的工作人员佩戴个人剂量计。
对职业病防护设备、应急救援设施和个人使用的职业病防护用品,用人单位应当进行经常性的维护、检修,定期检测其性能和效果,确保其处于正常状态,不得擅自拆除或者停止使用。
Article 24 The employing work unit shall conduct daily monitoring of the harmful factors of occupational diseases which is in the charge of specially assigned personnel, and shall ensure that the monitoring system be in normal operation.
The employing work unit shall, according to the provisions of the administrative department of health under the State Council, make regular tests and evaluations of the harmful factors of occupational diseases at the work place. The results of the test and evaluation shall be kept in the occupational health archives of the employing work unit, and be reported to the administrative department of the place where the employing work unit is located and be promulgated to the laborers.
The test and evaluation of the occupational disease factors shall be conducted by the occupational health technological service agencies that have obtained the quality certification of the administrative departments of health of the people's governments at the provincial level and above. The test and evaluation conducted by the occupational health technological service agencies shall be objective and true.
If it is found that the occupational disease factors at the work place haven't met the occupational health standards and health requirements of the State, the employing work unit shall take corresponding treatment measures immediately, if the occupational health standards and health requirements are still not met, the operations that contain occupational disease harmful factors must be stopped; only if the occupational disease factors meet the occupational health standards and health requirements of the State, the operations may be started over again.
   第二十四条 用人单位应当实施由专人负责的职业病危害因素日常监测,并确保监测系统处于正常运行状态。
用人单位应当按照国务院卫生行政部门的规定,定期对工作场所进行职业病危害因素检测、评价。检测、评价结果存入用人单位职业卫生档案,定期向所在地卫生行政部门报告并向劳动者公布。
职业病危害因素检测、评价由依法设立的取得省级以上人民政府卫生行政部门资质认证的职业卫生技术服务机构进行。职业卫生技术服务机构所作检测、评价应当客观、真实。
发现工作场所职业病危害因素不符合国家职业卫生标准和卫生要求时,用人单位应当立即采取相应治理措施,仍然达不到国家职业卫生标准和卫生要求的,必须停止存在职业病危害因素的作业;职业病危害因素经治理后,符合国家职业卫生标准和卫生要求的,方可重新作业。
Article 25 Those providing equipments that may engender the harm of occupational diseases to the employing work unit shall provide the Chinese specification, and place warning marks and Chinese warning explanations at the eye-catching places of the equipments. The warning explanations shall indicate the contents such as the functions of the equipments, the harm of occupational diseases that might be engendered, the matters that need attention for safe operation and maintenance, the protection against occupational disease and the measures for emergent treatment, etc.
   第二十五条 向用人单位提供可能产生职业病危害的设备的,应当提供中文说明书,并在设备的醒目位置设置警示标识和中文警示说明。警示说明应当载明设备性能、可能产生的职业病危害、安全操作和维护注意事项、职业病防护以及应急救治措施等内容。
Article 26 Those who provide chemicals, radioactive isotopes and the materials containing radioactive substances that might engender the harm of occupational diseases to the employing work unit shall provide a Chinese specification. The specification shall indicate the contents such as the characteristics of the products, the main compositions, the harmful ingredients existing, the matters that need attention for safe operation, the protection against occupational diseases and the measures for emergent treatment, etc. The package of the products shall bear eye-catching warning marks and Chinese warning explanations. The places where the materials mentioned above are stored shall place the marks of dangerous articles or the warning marks of radiation at the prescribed places.
For the chemical materials related to the harm of occupational diseases that are used or import for the first time in China, the unit that uses or imports it shall, after being approved by the relevant departments under the State Council according to the provisions of the State, submit the toxicity appraisal of those chemical materials as well as the documents of registration with the relevant departments or of the approval for import, etc, to the administrative department of health under the State Council.
The import of radioactive isotopes, radial equipments and the articles containing radioactive materials shall be handled according to the relevant provisions of the State.
   第二十六条 向用人单位提供可能产生职业病危害的化学品、放射性同位素和含有放射性物质的材料的,应当提供中文说明书。说明书应当载明产品特性、主要成份、存在的有害因素、可能产生的危害后果、安全使用注意事项、职业病防护以及应急救治措施等内容。产品包装应当有醒目的警示标识和中文警示说明。贮存上述材料的场所应当在规定的部位设置危险物品标识或者放射性警示标识。
国内首次使用或者首次进口与职业病危害有关的化学材料,使用单位或者进口单位按照国家规定经国务院有关部门批准后,应当向国务院卫生行政部门报送该化学材料的毒性鉴定以及经有关部门登记注册或者批准进口的文件等资料。
进口放射性同位素、射线装置和含有放射性物质的物品的,按照国家有关规定办理。
Article 27 No unit or individual may produce, operate, import or use the equipments or materials, which might engender the harm of occupational diseases, that are prohibited from use by public orders of the State.
   第二十七条 任何单位和个人不得生产、经营、进口和使用国家明令禁止使用的可能产生职业病危害的设备或者材料。
Article 28 No unit or individual may transfer the operations that engender the harm of occupational diseases to the units and individuals that don't possess the protective conditions against occupational diseases. The units and individuals that don't possess the protective conditions against occupational diseases may not accept any work that engenders the harm of occupational diseases.
   第二十八条 任何单位和个人不得将产生职业病危害的作业转移给不具备职业病防护条件的单位和个人。不具备职业病防护条件的单位和个人不得接受产生职业病危害的作业。
Article 29 If the employing work unit should have known the harm of occupational diseases engendered by the technologies, processes, materials they adopt yet conceal the harm of those technologies, processes and materials containing the harm of occupational diseases and adopt them, they shall bear the responsibilities for the harmful results of the occupational diseases thus caused.
   第二十九条 用人单位对采用的技术、工艺、材料,应当知悉其产生的职业病危害,对有职业病危害的技术、工艺、材料隐瞒其危害而采用的,对所造成的职业病危害后果承担责任。
Article 30 When signing labor contracts (including employment contracts, the same hereinafter) with the laborers, the employing work unit shall inform the laborers, according to the facts, the harm of occupational diseases that might be engendered in the work process as well as the consequences thereof, the protective measures and treatment against occupational diseases, and shall indicate these information in the labor contract and may not conceal such information or cheat the laborers.
If the laborers are engaged in the operations that contain the harm of occupational diseases that haven't been informed in the labor contracts signed, because of the change of work posts or work contents during the contracted period of labor, the employers shall perform the obligations to inform the laborers according to the facts in accordance with the provisions of the preceding paragraph, and shall negotiate to change the relevant terms of the original labor contracts.
If the according to the facts violates the provisions of the preceding two paragraphs, the laborers have the right to refuse to undertake the operations containing the harm of occupational diseases, and the according to the facts may not cancel or terminate the labor contracts signed with the laborers.
   第三十条 用人单位与劳动者订立劳动合同(含聘用合同,下同)时,应当将工作过程中可能产生的职业病危害及其后果、职业病防护措施和待遇等如实告知劳动者,并在劳动合同中写明,不得隐瞒或者欺骗。
劳动者在已订立劳动合同期间因工作岗位或者工作内容变更,从事与所订立劳动合同中未告知的存在职业病危害的作业时,用人单位应当依照前款规定,向劳动者履行如实告知的义务,并协商变更原劳动合同相关条款。
用人单位违反前两款规定的,劳动者有权拒绝从事存在职业病危害的作业,用人单位不得因此解除或者终止与劳动者所订立的劳动合同。
Article 31 The principals of the employing work units shall accept the occupational health training, abide by the laws and regulations on the prevention and treatment of occupational diseases, and organize the prevention and treatment of occupational diseases within their respective units.
The employers shall conduct to the laborers the pre-post occupational health training and the regular occupational health training during the working period, spread the knowledge of occupational health, supervise and urge the laborers to abide by the laws, regulations, decrees and operation rules on the prevention and treatment of occupational diseases, and direct the laborers to correctly use the protective equipments against occupational diseases and the protective articles for personal use against occupational diseases.
The laborers shall learn and have relevant knowledge about occupational health, abide by the laws, regulations, decrees and operation rules on the prevention and treatment of professional diseases, correctly use and maintain the protective equipments against occupational diseases and the protective articles for personal use against occupational diseases, and shall report promptly if they find any possibility that may cause occupational disease accidents.
The employing work unit shall educate the laborers that don't perform the obligations provided for in the preceding paragraph.
   第三十一条 用人单位的负责人应当接受职业卫生培训,遵守职业病防治法律、法规,依法组织本单位的职业病防治工作。
用人单位应当对劳动者进行上岗前的职业卫生培训和在岗期间的定期职业卫生培训,普及职业卫生知识,督促劳动者遵守职业病防治法律、法规、规章和操作规程,指导劳动者正确使用职业病防护设备和个人使用的职业病防护用品。
劳动者应当学习和掌握相关的职业卫生知识,遵守职业病防治法律、法规、规章和操作规程,正确使用、维护职业病防护设备和个人使用的职业病防护用品,发现职业病危害事故隐患应当及时报告。
劳动者不履行前款规定义务的,用人单位应当对其进行教育。
Article 32 For the laborers that are engaged in the operations contacting the harm of occupational diseases, the employing work unit shall organize the occupational health examination of the laborers before they take the posts, when they are at the posts and when they leave the posts, the employing work unit shall inform the laborers of the examination results. The employing work unit shall afford the expenses needed for the occupational health examination.
The employing work unit may not assign the laborers that haven't gone through the pre-post occupational health examination to undertake the operations involving the harm of occupational diseases; may not assign the laborers that have occupational contraindications to undertake the operations that they shall avoid; the laborers that are found to have the health injuries related to their posts during the occupational health examination shall be transferred from their former posts and be settled appropriately; and the employing work unit may not cancel or terminate the labor contacts signed with the laborers that haven't gone through the occupational health examination before they leave their posts.
The occupational health examination shall be undertaken by the medical health institutions approved by the administrative departments of health of the people's governments at the provincial level and above.
   第三十二条 对从事接触职业病危害的作业的劳动者,用人单位应当按照国务院卫生行政部门的规定组织上岗前、在岗期间和离岗时的职业健康检查,并将检查结果如实告知劳动者。职业健康检查费用由用人单位承担。
用人单位不得安排未经上岗前职业健康检查的劳动者从事接触职业病危害的作业;不得安排有职业禁忌的劳动者从事其所禁忌的作业;对在职业健康检查中发现有与所从事的职业相关的健康损害的劳动者,应当调离原工作岗位,并妥善安置;对未进行离岗前职业健康检查的劳动者不得解除或者终止与其订立的劳动合同。
职业健康检查应当由省级以上人民政府卫生行政部门批准的医疗卫生机构承担。
Article 33 The employing work unit shall establish occupational health monitoring and protection archives for the laborers, and shall keep the archives in good conditions within the prescribed period.
The occupational health monitoring and protection archives shall include the relevant personal health information, such as the occupational history, the history of contacting the harm of occupational diseases, the occupational health examination results and the diagnosis and treatment of occupational diseases, etc.
The laborers, when they leave the employing work unit, have the right to request for the copies of the occupational health monitoring and protection archives of their own, and the employing work unit shall provide free of charge, and shall sign and seal on the copies provided.
   第三十三条 用人单位应当为劳动者建立职业健康监护档案,并按照规定的期限妥善保存。
职业健康监护档案应当包括劳动者的职业史、职业病危害接触史、职业健康检查结果和职业病诊疗等有关个人健康资料。
劳动者离开用人单位时,有权索取本人职业健康监护档案复印件,用人单位应当如实、无偿提供,并在所提供的复印件上签章。
Article 34 When an accident of acute occupational disease happens or might happen, the employing work unit shall adopt the measures for emergent treatment and control immediately, and shall report to the administrative department of health and the relevant departments of the place where it is located. The administrative department shall, after receiving the report, organize the investigation and handling together with relevant departments; and may adopt temporary control measures when necessary.
For the laborers that suffer from or might suffer from the acute occupational diseases, the employing work unit shall promptly organize the treatment, conduct the health examination and medical observation, and shall afford the expenses needed.
   第三十四条 发生或者可能发生急性职业病危害事故时,用人单位应当立即采取应急救援和控制措施,并及时报告所在地卫生行政部门和有关部门。卫生行政部门接到报告后,应当及时会同有关部门组织调查处理;必要时,可以采取临时控制措施。
对遭受或者可能遭受急性职业病危害的劳动者,用人单位应当及时组织救治、进行健康检查和医学观察,所需费用由用人单位承担。
Article 35 The employing work unit may not assign underage laborers to undertake the operations that have contact with the harm of occupational diseases; and may not assign the female laborers in pregnancy and lactation to undertake the operations that are harmful to them and their fetuses or babies.
   第三十五条 用人单位不得安排未成年工从事接触职业病危害的作业;不得安排孕期、哺乳期的女职工从事对本人和胎儿、婴儿有危害的作业。
Article 36 The laborers are entitled to the following rights of occupational health protection:
   第三十六条 劳动者享有下列职业卫生保护权利:
1) accepting occupational health education and training;
 (一)获得职业卫生教育、培训;
2) accepting occupational health examination, diagnosis and treatment of occupational diseases, occupational disease healing and other services relating to the prevention and treatment of occupational diseases;
 (二)获得职业健康检查、职业病诊疗、康复等职业病防治服务;
3) getting to know the occupational disease factors that are engendered or might be engendered at the work place, the harmful results and the protective measures for the prevention and treatment of occupational diseases that should be adopted;
 (三)了解工作场所产生或者可能产生的职业病危害因素、危害后果和应当采取的职业病防护措施;
4) asking the employers to provide the protective facilities against occupational diseases and the protective articles for personal use against occupational diseases that meet the requirements for the prevention and treatment of occupational diseases;
 (四)要求用人单位提供符合防治职业病要求的职业病防护设施和个人使用的职业病防护用品,改善工作条件;
5) criticizing, reporting and accusing the acts that violate the laws and regulations on the prevention and treatment of occupational diseases and that endanger lives and health;
 (五)对违反职业病防治法律、法规以及危及生命健康的行为提出批评、检举和控告;
6) refusing to undertake the operations without protective measures against occupational diseases that are assigned to them by instructions and orders in violation of rules; and
 (六)拒绝违章指挥和强令进行没有职业病防护措施的作业;
7) participating in the democratic management of the occupational health work of the employer, and proposing opinions and suggestions to the prevention and treatment of occupational diseases.
The employing work unit shall guarantee the laborers to exercise the rights listed in the preceding paragraph. If the employing work unit reduces the remuneration of the laborers such as salary, welfare, etc, or cancel, terminate the labor contracts signed with the laborers because the laborers exercise their legitimate rights according to law, those acts shall be invalid.
 (七)参与用人单位职业卫生工作的民主管理,对职业病防治工作提出意见和建议。
用人单位应当保障劳动者行使前款所列权利。因劳动者依法行使正当权利而降低其工资、福利等待遇或者解除、终止与其订立的劳动合同的,其行为无效。
Article 37 The labor union shall supervise, urge, and assist the employing work unit in the publicity and education, and training of occupational health, give advice and suggestions to the employing work unit on the prevention and treatment of occupational diseases, coordinate with the employing work unit and supervise and urge the settlement of the problems related to the prevention and treatment of occupational diseases reported by the laborers.
The union has the right to request for correction of the acts of the employing work unit of infringement upon the legal rights and interests of the laborers in violation of the laws and regulations on the prevention and treatment of occupational diseases; has the right to request for adopting protective measures when serious harm of occupational diseases takes place, or to suggest the relevant government departments to adopt compulsory measures; has the right to participate in the accident investigation and handling when the harm of occupational diseases accident takes place; has the right to suggest the employing work unit to organize the laborers to withdraw from the dangerous scene when circumstances that endanger the lives and health of the laborers are found, and the employing work unit shall handle the case immediately.
   第三十七条 工会组织应当督促并协助用人单位开展职业卫生宣传教育和培训,对用人单位的职业病防治工作提出意见和建议,与用人单位就劳动者反映的有关职业病防治的问题进行协调并督促解决。
工会组织对用人单位违反职业病防治法律、法规,侵犯劳动者合法权益的行为,有权要求纠正;产生严重职业病危害时,有权要求采取防护措施,或者向政府有关部门建议采取强制性措施;发生职业病危害事故时,有权参与事故调查处理;发现危及劳动者生命健康的情形时,有权向用人单位建议组织劳动者撤离危险现场,用人单位应当立即作出处理。
Article 38 The expenses incurred in the prevention and treatment of occupational disease harm, the health test and health monitoring and protection of the work place, and the occupational health training, etc, by the employing work unit according to the requirements of the prevention and treatment of occupational diseases shall be truthfully listed in the production costs according to the relevant provisions of the state.
   第三十八条 用人单位按照职业病防治要求,用于预防和治理职业病危害、工作场所卫生检测、健康监护和职业卫生培训等费用,按照国家有关规定,在生产成本中据实列支。

Chapter 4 Occupational Disease Diagnosis and Guarantee of the Patients of Occupational Diseases
 第四章 职业病诊断与职业病病人保障


Article 39 The occupational disease diagnosis shall be undertaken by the medial institutions approved by the administrative departments of health of the people's governments at the provincial level and above.
   第三十九条 职业病诊断应当由省级以上人民政府卫生行政部门批准的医疗卫生机构承担。
Article 40 The laborer shall take the diagnosis of occupational disease at the medical institution undertaking the diagnosis of occupational disease, according to law, of the place where the employing work unit is located or of the place of residence of the laborer himself/herself.
   第四十条 劳动者可以在用人单位所在地或者本人居住地依法承担职业病诊断的医疗卫生机构进行职业病诊断。
Article 41 The standards for occupational disease diagnosis, and the measures for diagnosis and appraisal of occupational disease shall be formulated by the administrative department of health under the State Council. The measures for the appraisal of occupational disease disability grade shall be formulated by the administrative department of labor protection under the State Council together with the administrative department of health under the State Council.
   第四十一条 职业病诊断标准和职业病诊断、鉴定办法由国务院卫生行政部门制定。职业病伤残等级的鉴定办法由国务院劳动保障行政部门会同国务院卫生行政部门制定。
Article 42 The occupational disease diagnosis shall include a comprehensive analysis of the following factors:
   第四十二条 职业病诊断,应当综合分析下列因素:
1) the occupational history of the patient;
 (一)病人的职业史;
2) the history of contacting the harm of occupational diseases and the on-spot investigation and evaluation of the harm; and
 (二)职业病危害接触史和现场危害调查与评价;
3) the clinical manifestation as well as the result of supplementary examination, etc.
If there is no evidence that can deny the inevitable connection between the occupational disease factors and the clinical manifestation of the patient, then the disease shall be diagnosed as occupational disease after excluding other disease causing factors.
The medical institutions undertaking the occupational disease diagnosis shall, when conducting occupational disease diagnosis, organize three or more licensed doctors that have obtained the qualification for occupational disease diagnosis to diagnose together.
The certification of occupational disease diagnosis shall be jointly signed by the doctors that take part in the diagnosis, and shall be examined and sealed by the medical institution undertaking the occupational disease diagnosis.
 (三)临床表现以及辅助检查结果等。
没有证据否定职业病危害因素与病人临床表现之间的必然联系的,在排除其他致病因素后,应当诊断为职业病。
承担职业病诊断的医疗卫生机构在进行职业病诊断时,应当组织三名以上取得职业病诊断资格的执业医师集体诊断。
职业病诊断证明书应当由参与诊断的医师共同签署,并经承担职业病诊断的医疗卫生机构审核盖章。
Article 43 If the employing work unit or the medical institution find any patient suffering from occupational disease or any patient that seems to suffer from occupational disease, they shall report to the administrative department of health of the place where it is located. If the disease is diagnosed as occupational disease, the employing work unit shall also report to the administrative department of labor protection of the place where it is located.
The administrative department of health and the administrative department of labor protection shall handle the case according to law after receiving the report.
   第四十三条 用人单位和医疗卫生机构发现职业病病人或者疑似职业病病人时,应当及时向所在地卫生行政部门报告。确诊为职业病的,用人单位还应当向所在地劳动保障行政部门报告。
卫生行政部门和劳动保障行政部门接到报告后,应当依法作出处理。
Article 44 The administrative departments of health of the local people's governments at the level of county and above shall be responsible for the administration of the statistical reports of occupational diseases within their respective administrative areas, and shall report to the higher authorities according to the provisions.
   第四十四条 县级以上地方人民政府卫生行政部门负责本行政区域内的职业病统计报告的管理工作,并按照规定上报。
Article 45 If any party concerned has disagreements over the occupational disease diagnosis, it may apply to the administrative department of health of the local people's government of the place where the medical institution made the diagnosis is located for appraisal.
In case of dispute over occupational disease diagnosis, the administrative department of health of the local people's government at the level of city divided into districts or above shall organize the occupational disease diagnosis appraisal committee to appraise according to the application of the party concerned.
If the party concerned refuses to accept the appraisal conclusion of the occupational disease diagnosis committee at the level of city divided into districts, they may apply to the administrative department of health of the people's government of the province, autonomous region or municipality directly under the Central Government for reappraisal.
   第四十五条 当事人对职业病诊断有异议的,可以向作出诊断的医疗卫生机构所在地地方人民政府卫生行政部门申请鉴定。
职业病诊断争议由设区的市级以上地方人民政府卫生行政部门根据当事人的申请,组织职业病诊断鉴定委员会进行鉴定。
当事人对设区的市级职业病诊断鉴定委员会的鉴定结论不服的,可以向省、自治区、直辖市人民政府卫生行政部门申请再鉴定。
Article 46 The occupational disease diagnosis appraisal committee shall be composed of the experts of relevant professions.
The administrative departments of health of the people's governments of the provinces, autonomous regions and municipalities directly under the Central Government shall establish relevant expert databases, when it is needed to make diagnosis appraisal for the dispute over occupational disease, the parties concerned or the administrative department entrusted by the parties concerned shall determine the experts participating in the diagnosis appraisal committee by the means of random selection from the expert database.
The occupational disease diagnosis appraisal committee shall conduct the occupational disease diagnosis appraisal according to the standards for occupational disease diagnosis and the measures for occupational disease diagnosis and appraisal promulgated by the administrative department of health under the State Council, and shall produce the occupational disease diagnosis appraisal letter to the parties concerned. The expenses needed for the occupational disease diagnosis appraisal shall be afforded by the employing work unit.
   第四十六条 职业病诊断鉴定委员会由相关专业的专家组成。
省、自治区、直辖市人民政府卫生行政部门应当设立相关的专家库,需要对职业病争议作出诊断鉴定时,由当事人或者当事人委托有关卫生行政部门从专家库中以随机抽取的方式确定参加诊断鉴定委员会的专家。
职业病诊断鉴定委员会应当按照国务院卫生行政部门颁布的职业病诊断标准和职业病诊断、鉴定办法进行职业病诊断鉴定,向当事人出具职业病诊断鉴定书。职业病诊断鉴定费用由用人单位承担。
Article 47 The members of the occupational disease diagnosis appraisal committee shall observe professional ethics, conduct diagnosis appraisals objectively and impartially, and shall bear corresponding responsibilities. The members of the occupational disease diagnosis appraisal committee may not contact with the parties concerned in private, may not accept money and goods or other benefits from the parties concerned, and those having interests with the parties concerned shall withdraw.
If the relevant cases accepted by the people's courts need occupational disease appraisal, the people's courts shall select the experts participating in the appraisal from the relevant expert databases established according to law by the administrative departments of health of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
   第四十七条 职业病诊断鉴定委员会组成人员应当遵守职业道德,客观、公正地进行诊断鉴定,并承担相应的责任。职业病诊断鉴定委员会组成人员不得私下接触当事人,不得收受当事人的财物或者其他好处,与当事人有利害关系的,应当回避。
人民法院受理有关案件需要进行职业病鉴定时,应当从省、自治区、直辖市人民政府卫生行政部门依法设立的相关的专家库中选取参加鉴定的专家。
Article 48 If the occupational disease diagnosis and appraisal need the employing work unit to provide the materials related to occupational health and health monitoring and protection, etc, the employer shall provide such materials according to the facts, and the laborers and relevant agencies shall also provide the materials related to the occupational disease diagnosis and appraisal.
   第四十八条 职业病诊断、鉴定需要用人单位提供有关职业卫生和健康监护等资料时,用人单位应当如实提供,劳动者和有关机构也应当提供与职业病诊断、鉴定有关的资料。
Article 49 If the medical institution finds any patient that seems to suffer from occupational disease, it shall inform the laborer himself/herself and notify the employing work unit promptly.
The employing work unit shall promptly arrange the diagnosis of the patient that seems to suffer from occupational disease; and may not cancel or terminate the labor contract signed with the patient that seems to suffer from occupational disease during the diagnosis and the medical observation.
The expenses needed by the patient that seems to suffer from occupational disease during the diagnosis and medical observation shall be afforded by the employing work unit.
   第四十九条 医疗卫生机构发现疑似职业病病人时,应当告知劳动者本人并及时通知用人单位。
用人单位应当及时安排对疑似职业病病人进行诊断;在疑似职业病病人诊断或者医学观察期间,不得解除或者终止与其订立的劳动合同。
疑似职业病病人在诊断、医学观察期间的费用,由用人单位承担。
Article 50 The patients suffering from occupational diseases are entitled to the treatment of occupational diseases provided for by the State.
The employing work unit shall, according to the relevant provisions of the State, arrange the diagnosis, healing and regular examination of the patients suffering from occupational diseases.
The employing work unit shall transfer the patient who is not suitable for his/her former work from the post, and settle him/her appropriately.
The employing work unit shall give proper post subsidies to the laborers who are engaged in the operations contacting the harm of occupational diseases.
   第五十条 职业病病人依法享受国家规定的职业病待遇。
用人单位应当按照国家有关规定,安排职业病病人进行治疗、康复和定期检查。
用人单位对不适宜继续从事原工作的职业病病人,应当调离原岗位,并妥善安置。
用人单位对从事接触职业病危害的作业的劳动者,应当给予适当岗位津贴。
Article 51 The expenses for the diagnosis and healing of patients suffering from occupational diseases, the social security of the patients who are disabled and without labor capacity due to occupational diseases shall be subject to the provisions related to the disability social insurance of the State.
   第五十一条 职业病病人的诊疗、康复费用,伤残以及丧失劳动能力的职业病病人的社会保障,按照国家有关工伤社会保险的规定执行。
Article 52 Besides enjoying the disability social insurance according to law, the patients suffering from occupational diseases who have the right to get compensation according to relevant civil laws shall have the right to request the employing work unit for compensation.
   第五十二条 职业病病人除依法享有工伤社会保险外,依照有关民事法律,尚有获得赔偿的权利的,有权向用人单位提出赔偿要求。
Article 53 If a laborer is diagnosed as suffering from occupational disease yet the employing work unit failed to purchase the disability social insurance according to law, the medial and living costs shall be born by the last employing work unit; if the last employing work unit has the evidence to prove that the occupational disease was caused by the harm of occupational diseases of the former employing work unit, then the costs shall be born by the former employing work unit.
   第五十三条 劳动者被诊断患有职业病,但用人单位没有依法参加工伤社会保险的,其医疗和生活保障由最后的用人单位承担;最后的用人单位有证据证明该职业病是先前用人单位的职业病危害造成的,由先前的用人单位承担。
Article 54 The treatment enjoyed by the patients suffering from occupational diseases shall remain the same when the patients changing their work units.
If the employing work unit is divided, merged, disbanded, or goes bankrupt, it shall make health examination to the laborers who are engaged in the operations contacting the harm of occupational diseases, and shall settle the patients suffering from occupational diseases appropriately according to the relevant provisions of the State.
   第五十四条 职业病病人变动工作单位,其依法享有的待遇不变。
用人单位发生分立、合并、解散、破产等情形的,应当对从事接触职业病危害的作业的劳动者进行健康检查,并按照国家有关规定妥善安置职业病病人。

Chapter 5 Supervision and Inspection
 第五章 监督检查


Article 55 The administrative departments of health of the people's governments at the level of county and above shall supervise and inspect the prevention and treatment of occupational diseases and the test and evaluation of the harm of occupational diseases according to the laws and regulations on the prevention and treatment of occupational diseases, the occupational health standards and health requirements of the State and according to the division of their functions and duties.
   第五十五条 县级以上人民政府卫生行政部门依照职业病防治法律、法规、国家职业卫生标准和卫生要求,依据职责划分,对职业病防治工作及职业病危害检测、评价活动进行监督检查。
Article 56 The administrative department of health has the right to apply the following measures when performing the functions and duties of supervision and inspection:
   第五十六条 卫生行政部门履行监督检查职责时,有权采取下列措施:
1) entering the units under inspection and the scene of the harm of occupational diseases to find out the situation and to investigate and collect evidence;
 (一)进入被检查单位和职业病危害现场,了解情况,调查取证;
2) consulting or copying the materials related to the acts violating the laws and regulations on the prevention and treatment of occupational diseases and collecting samples; and
 (二)查阅或者复制与违反职业病防治法律、法规的行为有关的资料和采集样品;
3) ordering the units and individuals violating the laws and regulations on the prevention and treatment of occupational diseases to stop their illegal acts.
 (三)责令违反职业病防治法律、法规的单位和个人停止违法行为。
Article 57 When an accident of occupational disease takes place or there is evidence to prove that the harmful state might lead to an accident of occupational diseases, the administrative department of health may apply the following measure for temporary control:
   第五十七条 发生职业病危害事故或者有证据证明危害状态可能导致职业病危害事故发生时,卫生行政部门可以采取下列临时控制措施:
1) ordering to stop temporarily the operations leading to an accident of occupational disease;
 (一)责令暂停导致职业病危害事故的作业;
2) sealing up the materials and equipments that cause an accident of occupational diseases or that might lead to the accident of occupational disease; and
 (二)封存造成职业病危害事故或者可能导致职业病危害事故发生的材料和设备;
3) organizing to control the scene of the accident of occupational disease.
After the accident of occupational disease or the harmful state is effectively controlled, the administrative department of health shall rescind the control measures.
 (三)组织控制职业病危害事故现场。
在职业病危害事故或者危害状态得到有效控制后,卫生行政部门应当及时解除控制措施。
Article 58 The law enforcement personnel of occupational health supervision shall show their law enforcement certificates when performing their duties.
The law enforcement personnel of occupational health supervision shall be devoted to their duties and be impartial in law enforcement, abide by the rules of law enforcement strictly; and keep secret for the employing work unit if its secrets are involved.
   第五十八条 职业卫生监督执法人员依法执行职务时,应当出示监督执法证件。
职业卫生监督执法人员应当忠于职守,秉公执法,严格遵守执法规范;涉及用人单位的秘密的,应当为其保密。
Article 59 When the law enforcement personnel of occupational health supervision perform their duties according to law, the units under inspection shall accept the inspection and give support and assistance, and may not refuse or hinder the inspection.
   第五十九条 职业卫生监督执法人员依法执行职务时,被检查单位应当接受检查并予以支持配合,不得拒绝和阻碍。
Article 60 The administrative department of health and its law enforcement personnel of occupational health supervision may not conduct the following acts when performing their functions and duties:
   第六十条 卫生行政部门及其职业卫生监督执法人员履行职责时,不得有下列行为:
1) granting relevant certification documents, quality certification documents to or giving approval to those construction projects that fail to meet the legal requirements;
 (一)对不符合法定条件的,发给建设项目有关证明文件、资质证明文件或者予以批准;
2) failing to perform the functions and duties of supervision and inspection over those that have obtained the relevant certification documents;
 (二)对已经取得有关证明文件的,不履行监督检查职责;
3) failing to apply control measures promptly after finding the employing work unit has the harm of occupational diseases that might cause an accident of occupational disease; and
 (三)发现用人单位存在职业病危害的,可能造成职业病危害事故,不及时依法采取控制措施;
4) other acts in violation of this Law.
 (四)其他违反本法的行为。
Article 61 The law enforcement personnel of occupational health supervision shall go through the quality certification according to law.
The administrative departments of health shall strengthen the buildup of the team, improve the political and operational quality of the law enforcement personnel of occupational health supervision, establish and perfect the internal supervision system according to the provisions of this Law and other relevant laws and regulations, and supervise and inspect the enforcement of laws and regulations and the observation of disciplines of their working personnel.
   第六十一条 职业卫生监督执法人员应当依法经过资格认定。
卫生行政部门应当加强队伍建设,提高职业卫生监督执法人员的政治、业务素质,依照本法和其他有关法律、法规的规定,建立、健全内部监督制度,对其工作人员执行法律、法规和遵守纪律的情况,进行监督检查。

Chapter 6 Legal Liabilities
 第六章 法律责任


Article 62 If any construction unit has, in violation of the provisions of this Law, committed any of the following acts, the administrative department of health shall give warning to it and order it to make corrections within a prescribed time limit; a fine of more than 100,000 but less than 500,000 Yuan shall be imposed on it if the act hasn't been corrected within the time limit; if the circumstances are serious, the unit shall be ordered to stop the operations that engender the harm of occupational diseases or be submitted to the people's government concerned which shall order the stop of construction or shutdown according to the limit of authority provided for by the State Council:
   第六十二条 建设单位违反本法规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正;逾期不改正的,处十万元以上五十万元以下的罚款;情节严重的,责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令停建、关闭:
1) failing to make preliminary evaluation of the harm of occupational diseases or submit the report on preliminary evaluation of the harm of occupational diseases according to the provisions, or starting the construction while the report on preliminary evaluation of occupational disease harm hasn't been examined and approved by the administrative department of health;
 (一)未按照规定进行职业病危害预评价或者未提交职业病危害预评价报告,或者职业病危害预评价报告未经卫生行政部门审核同意,擅自开工的;
2) the protective facilities against occupational disease of the construction project having not been put into production and use at the same time as that of the main part of the project;
 (二)建设项目的职业病防护设施未按照规定与主体工程同时投入生产和使用的;
3) starting the construction project that engenders serious harm of occupational diseases while its design of protective facilities against occupational diseases fails to meet the occupational health standards and health requirements of the State; and
 (三)职业病危害严重的建设项目,其职业病防护设施设计不符合国家职业卫生标准和卫生要求施工的;
4) failing to make evaluation of the effect of controlling occupational disease of the protective facilities against occupational diseases according to the provisions, the facilities having not been checked up for acceptance or putting the facilities that failed the check for acceptance into use without authorization.
 (四)未按照规定对职业病防护设施进行职业病危害控制效果评价、未经卫生行政部门验收或者验收不合格,擅自投入使用的。
Article 63 Those that, in violation of the provisions of this Law, has committed any of the following acts, shall be given a warning and be ordered to make corrections by the administrative department of health; and those failing to make corrections within the time limit shall be imposed upon a fine of less than 20,000 Yuan:
   第六十三条 违反本法规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正;逾期不改正的,处二万元以下的罚款:
1) the results of the test and evaluation of the harm of occupational diseases at work place having not been kept in the archives, reported to the higher authorities and promulgated;
 (一)工作场所职业病危害因素检测、评价结果没有存档、上报、公布的;
2) having not applied the management measures for the prevention and treatment of occupational diseases provided for in Article 19 of this Law;
 (二)未采取本法第十九条规定的职业病防治管理措施的;
3) having not promulgated the rules and regulations on, and operation procedures for the prevention and treatment of occupational diseases, and the emergent treatment measures for an accident of occupational diseases according to the provisions;
 (三)未按照规定公布有关职业病防治的规章制度、操作规程、职业病危害事故应急救援措施的;
4) having not organized the laborers to accept occupational health training, or having not adopted the direction and supervision measures for the self protection against occupational diseases of the laborers; and
 (四)未按照规定组织劳动者进行职业卫生培训,或者未对劳动者个人职业病防护采取指导、督促措施的;
5) in case of the chemical materials related to the harm of occupational disease that are used or imported for the first time, the toxicity appraisal materials, as well as the documents of registration with relevant departments or the approval for import having not been submitted according to the provisions.
 (五)国内首次使用或者首次进口与职业病危害有关的化学材料,未按照规定报送毒性鉴定资料以及经有关部门登记注册或者批准进口的文件的。
Article 64 If any employing work unit, in violation of the provisions of this Law, has committed any of the following acts, the administrative department of health shall order it to make corrections within a prescribed time limit and give a warning to it, and may impose on it a fine of more than 20,000 Yuan but less than 50,000 Yuan concurrently:
   第六十四条 用人单位违反本法规定,有下列行为之一的,由卫生行政部门责令限期改正,给予警告,可以并处二万元以上五万元以下的罚款:
1) failing to report the projects that engender the harm of occupational diseases to the administrative department of health promptly and truthfully according to the provisions;
 (一)未按照规定及时、如实向卫生行政部门申报产生职业病危害的项目的;
2) failing to conduct the daily monitoring of the occupational disease factors in the charge of specially assigned personnel, or the monitor system failing to monitor normally;
 (二)未实施由专人负责的职业病危害因素日常监测,或者监测系统不能正常监测的;
3) failing to inform the laborers of the true conditions of the harm of occupational diseases when signing or changing the labor contracts; and
 (三)订立或者变更劳动合同时,未告知劳动者职业病危害真实情况的;
4) failing to organize the occupational health examination, establish the occupational monitoring and protection archives according to the provisions or failing to inform the laborers the examination results.
 (四)未按照规定组织职业健康检查、建立职业健康监护档案或者未将检查结果如实告知劳动者的。
Article 65 If the employing work unit, in violation of the provisions of this Law, has committed any of the following acts, the administrative department of health shall give it a warning and order it to make corrections within a prescribed time limit, if no correction is made within the time limit, a fine of 50,000 Yuan but less than 200,000 Yuan shall be imposed on it; if the circumstances are serious, the department shall order it to stop the operations than engender the harm of occupational diseases, or request the relevant people's government to order the shutdown of the employing work unit according to the provisions of the State Council:
   第六十五条 用人单位违反本法规定,有下列行为之一的,由卫生行政部门给予警告,责令限期改正,逾期不改正的,处五万元以上二十万元以下的罚款;情节严重的,责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令关闭:
1) the intensity or density of the occupational disease factors at the work place exceeding the occupational health standards of the State;
 (一)工作场所职业病危害因素的强度或者浓度超过国家职业卫生标准的;
2) failing to provide the protective facilities against occupational diseases and the protective articles for personal use against occupational diseases, or the protective facilities against occupational diseases and the protective articles for personal use against occupational disease provided failing to meet the occupational health standards and health requirements of the State;
 (二)未提供职业病防护设施和个人使用的职业病防护用品,或者提供的职业病防护设施和个人使用的职业病防护用品不符合国家职业卫生标准和卫生要求的;
3) failing to maintain, examine and repair, and test the protective equipments against occupational diseases, the emergent treatment facilities and the protective articles for personal use against occupational diseases according to the provisions, or failing to keep the normal operating and using state;
 (三)对职业病防护设备、应急救援设施和个人使用的职业病防护用品未按照规定进行维护、检修、检测,或者不能保持正常运行、使用状态的;
4) failing to test or evaluated the occupational disease harmful factors at work place according to the provisions:
 (四)未按照规定对工作场所职业病危害因素进行检测、评价的;
5) the occupational disease harmful factors at the work place failing to meet the occupational health standards and health requirements even after treatment, and the operations that contain occupational disease harmful factors having not been stopped;
 (五)工作场所职业病危害因素经治理仍然达不到国家职业卫生标准和卫生要求时,未停止存在职业病危害因素的作业的;
6) failing to arrange the diagnosis and treatment for the patients of occupational diseases and the patients that seem to suffer from occupational disease according to the provisions;
 (六)未按照规定安排职业病病人、疑似职业病病人进行诊治的;
7) failing to apply emergent treatment and control measures or failing to report promptly according to the provisions when an accident acute occupational diseases happens or might happen;
 (七)发生或者可能发生急性职业病危害事故时,未立即采取应急救援和控制措施或者未按照规定及时报告的;
8) failing to place warning marks and Chinese warning explanations at the eye-catching places at the work posts that engender serious harm of occupational diseases according to the provisions; and
 (八)未按照规定在产生严重职业病危害的作业岗位醒目位置设置警示标识和中文警示说明的;
9) refusing the supervision and inspection of the administrative department of health.
 (九)拒绝卫生行政部门监督检查的。
Article 66 Those providing equipments, materials that might engender the harm of occupational disease to the employing work units, and having not provided Chinese specification or placed the warning marks and Chinese warning explanations according to the provisions shall be ordered by the administrative department to make corrections within a prescribed time limit and be given a warning, and be impose upon a fine of more than 50,000 Yuan but less than 200,000 Yuan.
   第六十六条 向用人单位提供可能产生职业病危害的设备、材料,未按照规定提供中文说明书或者设置警示标识和中文警示说明的,由卫生行政部门责令限期改正,给予警告,并处五万元以上二十万元以下的罚款。
Article 67 The employing work unit and medical institution that failed to report the occupational diseases and likely occupational diseases according to the provisions shall be ordered by the administrative department of health to make corrections within a prescribed time limit and be given a warning, and be imposed upon a fine of less than 10,000 Yuan; those practicing frauds shall be imposed upon a fine of more than 20,000 Yuan but less than 50,000 Yuan; and the punishment of demotion or dismiss may be given to the personnel-in-charge who is held directly responsible and other directly responsible personnel according to law.
   第六十七条 用人单位和医疗卫生机构未按照规定报告职业病、疑似职业病的,由卫生行政部门责令限期改正,给予警告,可以并处一万元以下的罚款;弄虚作假的,并处二万元以上五万元以下的罚款;对直接负责的主管人员和其他直接责任人员,可以依法给予降级或者撤职的处分。
Article 68 Those that, in violation of the provisions of this Law, are under any of the following circumstances shall be ordered by the administrative department of health to give treatment within prescribed time limit, and shall be imposed upon a fine of more than 50,000 Yuan but less than 300,000 Yuan; if the circumstances are serious, the department shall order the stop of the operations engendering the harm of occupational diseases, or submit to the relevant people's government to order shutdown according to the limit of authority provided for by the State Council:
   第六十八条 违反本法规定,有下列情形之一的,由卫生行政部门责令限期治理,并处五万元以上三十万元以下的罚款;情节严重的,责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令关闭:
1) concealing the harm of occupational diseases engendered by technologies, processes and materials adopted;
 (一)隐瞒技术、工艺、材料所产生的职业病危害而采用的;
2) concealing the actual health conditions of the unit;
 (二)隐瞒本单位职业卫生真实情况的;
3) the poisonous and harmful work place and the radioactive work place that might engender acute occupational diseases, or the transport and storage of the radioactive isotopes failing to meet the provisions of Article 23 of this Law;
 (三)可能发生急性职业损伤的有毒、有害工作场所、放射工作场所或者放射性同位素的运输、贮存不符合本法第二十三条规定的;
4) using the equipments or materials, which might engender the harm of occupational diseases, that are prohibited from use by the orders of the State;
 (四)使用国家明令禁止使用的可能产生职业病危害的设备或者材料的;
5) transferring the operations engendering the harm of occupational diseases to the units and individuals without protective conditions against occupational diseases, or the units and individuals without protective conditions against occupational diseases accepting the operations engendering occupational disease harm;
 (五)将产生职业病危害的作业转移给没有职业病防护条件的单位和个人,或者没有职业病防护条件的单位和个人接受产生职业病危害的作业的;
6) demolishing or stopping, without authorization, the use of protective equipment against occupational diseases or the emergent treatment facilities;
 (六)擅自拆除、停止使用职业病防护设备或者应急救援设施的;
7) allocating the laborers that failed to go through the occupational health examination, the laborers who have occupational contraindications, underage laborers or female employees in pregnancy or lactation to undertake the operations have contact with the harm of occupational diseases or the operations of contraindications; and
 (七)安排未经职业健康检查的劳动者、有职业禁忌的劳动者、未成年工或者孕期、哺乳期女职工从事接触职业病危害的作业或者禁忌作业的;
8) instructing and ordering, in violation of the rules, the laborers to undertake the operations without protective measures against occupational diseases.
 (八)违章指挥和强令劳动者进行没有职业病防护措施的作业的。
Article 69 Those producing, operating or importing the equipments or materials, which might engender occupational disease harm, prohibited from use by State orders shall be punished according to the provisions of the relevant laws and regulations.
   第六十九条 生产、经营或者进口国家明令禁止使用的可能产生职业病危害的设备或者材料的,依照有关法律、行政法规的规定给予处罚。
Article 70 If the employing work unit, in violation of the provisions of this Law, has caused serious damages to the lives and health of the laborers, the administrative department of health shall order it to stop the operations that engender the harm occupational disease, or request the relevant people's government to order shutdown according to the limit of authority provided by the State Council, and shall impose a fine of more than 100,000 Yuan but less than 300,000 Yuan on the employing work unit at concurrently.
   第七十条 用人单位违反本法规定,已经对劳动者生命健康造成严重损害的,由卫生行政部门责令停止产生职业病危害的作业,或者提请有关人民政府按照国务院规定的权限责令关闭,并处十万元以上三十万元以下的罚款。
Article 71 If the employing work unit, in violation of the provisions of this Law, has caused any serious accident of occupational diseases or other serious results and constituted a crime, the person-in-charge who is held to be directly responsible or other directly responsible personnel shall be investigated into for criminal responsibilities.
   第七十一条 用人单位违反本法规定,造成重大职业病危害事故或者其他严重后果,构成犯罪的,对直接负责的主管人员和其他直接责任人员,依法追究刑事责任。
Article 72 Those providing occupational health technological services without obtaining the quality certification of occupational health technological service or the medical institutions undertaking the occupational health examination and occupational disease diagnosis without approval shall be ordered by the administrative department of health to stop the illegal acts immediately and be given a warning, and the illegal gains shall be confiscated; if the illegal gains is more than 5,000 Yuan, a fine of more than two times but less than five times the illegal gains shall be imposed concurrently; if there is no illegal gains or the illegal gains is less than 5,000 Yuan, a fine of more than 5,000 Yuan but less than 20,000 Yuan shall be imposed concurrently; if the circumstances are serious, the original certifying or approving organ shall cancel the corresponding qualification; the personnel in charge held directly responsible and other directly responsible personnel shall be given the punishment of demotion, dismissal or discharge according to law; and the criminal responsibilities shall be investigated if a crime is constituted:
   第七十二条 未取得职业卫生技术服务资质认证擅自从事职业卫生技术服务的,或者医疗卫生机构未经批准擅自从事职业健康检查、职业病诊断的,由卫生行政部门责令立即停止违法行为,没收违法所得;违法所得五千元以上的,并处违法所得二倍以上十倍以下的罚款;没有违法所得或者违法所得不足五千元的,并处五千元以上五万元以下的罚款;情节严重的,对直接负责的主管人员和其他直接责任人员,依法给予降级、撤职或者开除的处分。
Article 73 Those providing occupational health technological services without obtaining the quality certification of occupational health technological service or the medical institutions undertaking the occupational health examination and occupational disease diagnosis without approval shall be ordered by the administrative department of health to stop the illegal acts immediately and be given a warning, and the illegal gains shall be confiscated; if the illegal gains is more than 5,000 Yuan, a fine of more than two times but less than five times the illegal gains shall be imposed concurrently; if there is no illegal gains or the illegal gains is less than 5,000 Yuan, a fine of more than 5,000 Yuan but less than 20,000 Yuan shall be imposed concurrently; if the circumstances are serious, the original certifying or approving organ shall cancel the corresponding qualification; the personnel in charge held directly responsible and other directly responsible personnel shall be given the punishment of demotion, dismissal or discharge according to law; and the criminal responsibilities shall be investigated if a crime is constituted:
   第七十三条 从事职业卫生技术服务的机构和承担职业健康检查、职业病诊断的医疗卫生机构违反本法规定,有下列行为之一的,由卫生行政部门责令立即停止违法行为,给予警告,没收违法所得;违法所得五千元以上的,并处违法所得二倍以上五倍以下的罚款;没有违法所得或者违法所得不足五千元的,并处五千元以上二万元以下的罚款;情节严重的,由原认证或者批准机关取消其相应的资格;对直接负责的主管人员和其他直接责任人员,依法给予降级、撤职或者开除的处分;构成犯罪的,依法追究刑事责任:
1) undertaking the occupational health technological services or occupational health examination and occupational disease diagnosis beyond the scope of the quality certification or the approval;
 (一)超出资质认证或者批准范围从事职业卫生技术服务或者职业健康检查、职业病诊断的;
2) failing to perform the lawful duties according to the provisions of this Law; and
 (二)不按照本法规定履行法定职责的;
3) producing false certification documents.
 (三)出具虚假证明文件的。
Article 74 The member of the occupational disease diagnosis appraisal committee who accepts the money and goods or other benefits from the parties concerned to the dispute over occupational disease diagnosis shall be given a warning, the money and goods accepted shall be confiscated, a fine of more than 3,000 Yuan but less than 5,000 Yuan be imposed upon concurrently, the qualification for the member of occupational disease diagnosis appraisal committee be canceled, and his/her name be removed from the expert database established by the administrative department of health of the people's government of the province, autonomous region or municipality directly under the Central Government.
   第七十四条 职业病诊断鉴定委员会组成人员收受职业病诊断争议当事人的财物或者其他好处的,给予警告,没收收受的财物,可以并处三千元以上五万元以下的罚款,取消其担任职业病诊断鉴定委员会组成人员的资格,并从省、自治区、直辖市人民政府卫生行政部门设立的专家库中予以除名。
Article 75 If the administrative department of health failed to report any occupational disease or any accident of occupational diseases according to provisions, the administrative department of health at the higher level shall order it to make corrections, circulate a notice of criticism and give warnings to it; for those that make a false report or conceal and don't report, the person-in-charge of the unit, the personnel-in-charge held directly responsible and other directly responsible personnel shall be given the administrative punishment of demotion, dismiss or discharge according to law.
   第七十五条 卫生行政部门不按照规定报告职业病和职业病危害事故的,由上一级卫生行政部门责令改正,通报批评,给予警告;虚报、瞒报的,对单位负责人、直接负责的主管人员和其他直接责任人员依法给予降级、撤职或者开除的行政处分。
Article 76 If the administrative department of health and its law enforcement personnel of occupational health supervisions has committed any of the acts listed in Article 60 of this Law, and caused the happening any occupational diseases and constituted a crime, the criminal responsibilities shall be investigated into; if a crime hasn't been constituted, the principal of the unit, the personnel-in-charge held directly responsible and other directly responsible personnel shall be given the administrative punishment of demotion, dismissal or discharge according to law.
   第七十六条 卫生行政部门及其职业卫生监督执法人员有本法第六十条所列行为之一,导致职业病危害事故发生,构成犯罪的,依法追究刑事责任;尚不构成犯罪的,对单位负责人、直接负责的主管人员和其他直接责任人员依法给予降级、撤职或者开除的行政处分。

Chapter 7 Supplementary Provisions
 第七章 附则


Article 77 Definition of the following terms used in this Law:
The harm of occupational diseases means all kinds of harm that may cause occupational disease to the laborers engaged in the occupational activities. The occupational disease factors include: all kinds of harmful chemical, physical and biological factors existing in the occupational activities as well as other occupational harmful factors engendered in the process of the operations.
Occupational contraindications mean the personal special physiological or pathological state of the laborer who is more likely to suffer from the harm of occupational diseases and fall in occupational diseases than the general occupational multitude, or of whom the already existing disease may be caused to become heavier, or who may be caused to engender the disease that may endanger the lives and health of others during the process of undertaking the operations.
   第七十七条 本法下列用语的含义:
职业病危害,是指对从事职业活动的劳动者可能导致职业病的各种危害。职业病危害因素包括:职业活动中存在的各种有害的化学、物理、生物因素以及在作业过程中产生的其他职业有害因素。
职业禁忌,是指劳动者从事特定职业或者接触特定职业病危害因素时,比一般职业人群更易于遭受职业病危害和罹患职业病或者可能导致原有自身疾病病情加重,或者在从事作业过程中诱发可能导致对他人生命健康构成危险的疾病的个人特殊生理或者病理状态。
Article 78 For the units apart from the employing work unit provided for by Article 2 of this Law engendering the harm of occupational diseases, the prevention and treatment of occupational diseases may be implemented in reference of this Law.
The measures for implementation of the People's Liberation Army of China in reference of this Law shall be formulated by the State Council and the Central Military Committee.
   第七十八条 本法第二条规定的用人单位以外的单位,产生职业病危害的,其职业病防治活动可以参照本法执行。
中国人民解放军参照执行本法的办法,由国务院、中央军事委员会制定。
Article 79 This Law shall come into force on May 1, 2002.

   第七十九条 本法自2002年5月1日起施行。
