Chapter 1 General Provisions
 

第一章 总则


Article 1 The Business Center of Beijing is constructed according to the Overall Urban Planning of Beijing as approved by the State Council. These Measures are hereby formulated according to the relevant laws and regulations in order to further promote the construction and sustainable development of the Business Center of Beijing, to improve the urban functions of the Capital, and to improve the standards of urban modernization.
   第一条 根据国务院批准的《北京城市总体规划》,建设北京商务中心区。为进一步推进北京商务中心区建设和可持续发展,完善首都城市功能,提高城市现代化水平,根据有关法律、法规,特制定本办法。
Article 2 These Measures shall apply to the area of the Business Center of Beijing (hereinafter referred to as “Business Center”). The Business Center occupies about 4 sq. km, from East Daqiao Road on the west to the West Dawang Road on the east, and from Tonghui River on the south to the Chaoyang Road on the north.
   第二条 本办法适用于北京商务中心区(以下简称商务中心区)区域范围。商务中心区占地面积约4平方公里,西起东大桥路,东至西大望路,南起通惠河,北至朝阳路。
Article 3 The Business Center shall set up an administration agency of the municipal government, which will represent the municipal government and will centrally exercise the functions of development, construction, and administration of the Business Center of Beijing; and shall undertake the daily work of the Joint Construction Conference of the Business Center.
   第三条 商务中心区设立管理机构,为市政府在商务中心区设立的行政机构,代表市政府统一行使北京商务中心区的开发建设和管理职能;同时承担商务中心区建设联席会议的日常工作。
Chapter 2 Area Planning

Article 4 According to the Overall Urban Planning of Beijing, the administration agency of the Business Center together with the administration department of urban planning shall formulate the overall planning of the Business Center, the detailed control-related planning, and special planning in the areas of traffic, urban planning, network, environmental, and visual planning, etc., which shall be submitted to the municipal government for approval, and shall be implemented upon approval.
   第四条 根据《北京城市总体规划》,商务中心区管理机构会同城市规划管理部门,制订商务中心区总体规划、控制性详细规划及交通、市政、网络和环境景观等专项规划,报市政府批准后,组织实施。
Article 5 The detailed control-related planning of the Business Center shall fully embody the development functions of the Business Center and be formulated by drawing upon the advanced experiences of other countries. On the premise that the total volume of buildings in the Business Center is controlled and the total number is balanced, encouragement measures such as volume transfer, volume award, etc, may be applied to promote the planning and construction of the undeveloped areas of the Business Center. The administration agency of the Business Center together with the administration department of urban planning may, according to actual needs, make appropriate adjustments to the guidelines regarding targets governing the grass-growing, building intervals and accessory buildings of the premium residences and the office buildings of the Business Center.
   第五条 商务中心区的控制性详细规划,要充分体现商务中心区的发展功能,并借鉴国际先进经验制订。在实行商务中心区内建筑容积率总体控制、总量平衡的前提下,可采取容积率转移、容积率奖励等鼓励办法,促进商务中心区开放空间的规划建设。商务中心区管理机构会同市规划管理部门,可根据实际需要,对商务中心区内高档住宅和写字楼的绿地建设、建筑间距及公建配套等指标给予适当调整。
Article 6 The overall planning, detailed control-related planning and special planning of the Business Center, etc, shall be promulgated to the public and be subject to public supervision.
   第六条 商务中心区总体规划、控制性详细规划及专项规划等要公开发布,接受社会监督。
Chapter 3 Land Development
 

第三章 土地开发


Article 7 In order to ensure the seriousness of the overall planning and the standardized implementation of the development and construction of the Business Center, the land purchase reserve system shall first be established in the Business Center. The Business Area Sub-Center of the Land Arrangement and Reserve Center of Beijing (hereinafter referred to as the “Land Reserve Sub-Center”) shall be established, and the land reserve and first class land development shall be conducted according to the provisions of the relevant laws and regulations of the State and this municipality. Land in which the development has completed the “opening of seven facilities and the leveling of land” process shall be bid off by the municipal administration department of land and house by means of a public bid invitation and auction.
   第七条 为保证商务中心区总体规划的严肃性和开发建设工作的规范进行,率先在商务中心区建立土地收购储备制度。设立北京市土地整理储备中心商务区分中心(以下简称土地储备分中心),按照国家及本市有关法律、法规规定,进行土地储备和土地一级开发,对开发已完成“七通一平”的土地由市国土房管部门以公开招标、拍卖等方式出让。
Article 8 The area of approximately 10 sq. km from the Second East Circle to the Fourth East Circle, and from the Tonghui River to the North Chaoyang Road shall be brought into the scope of the key reserve of the Land Arrangement and Reserve Center of Beijing, and the land purchase reserve within the planned scope of the Business Center shall be centrally administered and operated by the Land Reserve Sub-Center.

   第八条 将东二环至东四环、通惠河至朝阳北路之间约10平方公里的区域,纳入北京市土地整理储备中心的重点储备范围。其中,商务中心区规划范围内的土地收购储备由土地储备分中心负责统一管理和运营。
