Circular of the People's Government of Beijing Municipality on Adjusting Base Land Prices for the Assignment of the Right to the Use of State-owned Land (No.32 [2002] of the People's Government of Beijing Municipality) The people's governments of the districts and counties, the commissions, offices and bureaus under the Municipal Government, and the agencies affiliated to the Municipal Government: In accordance with the Urban Real Estate Administration Law of the People's Republic of China, the Measure of Beijing Municipality for the Implementation of the Provisional Regulations of the People's Republic of China on Assignment and Transfer of the Right to the Use of Urban State-owned Land, and the arrangements of the Ministry of Land Resources on the renewal and balance of the urban base land prices of the whole nation, and in order to further strengthen the administration of the prices for assignment of the right to the use of state-owned land of this Municipality, and to normalize and foster the real estate market, the Municipal Bureau of Land and House Administration has, in conjunction with the relevant departments, adjusted and renewed the base land prices for assignment of the right to the use of state-owned land of this Municipality fixed in 1993. The List of Base Land Prices of Beijing Municipality is hereby issued to you, please carry it out accordingly, and the relevant matters are hereby notified as follows:
| | 北京市人民政府关于调整本市出让国有土地使用权基准地价的通知 (京政发[2002]32号) 各区、县人民政府,市政府各委、办、局,各市属机构: 根据《中华人民共和国城市房地产管理法》、《北京市实施<中华人民共和国城镇国有土地使用权出让和转让暂行条例>办法》和国土资源部关于全国城市基准地价更新与平衡工作的部署,为进一步加强本市国有土地使用权出让价格管理,规范和培育房地产市场,市国土房管局会同有关部门对1993年本市出让国有土地使用权基准地价进行了调整更新。现将《北京市基准地价表》印发给你们,请认真贯彻执行,并就有关事项通知如下:

1.The base land prices for assignment of the right to the use of state-owned land (hereinafter referred to as base land prices) adjusted this time are the base prices of various kinds of lands determined by classification and grading on the basis of the base land prices of this Municipality fixed in 1993 and according to the recent market information.
| | 一、本次调整的出让国有土地使用权基准地价(以下简称基准地价)是在1993年本市基准地价的基础上,以近期市场资料为依据,采用分类定级方法确定的各类土地基准价格。

2.As a general principle, the base land prices shall be adjusted every 2 or 3 years by the Municipal Government. The Municipal Government may also adjust the prices in case of significant change of prices on the real estate market. The Municipal Bureau of Land and House Administration may adjust the grades of base land prices of some areas in light of the actual situations.
| | 二、基准地价一般由市政府每2年至3年调整一次。在房地产市场价格发生重大变化的情况下,市政府也可适时进行调整。市国土房管局可根据实际情况,对局部地区的基准地价级别进行调整。

3.Apart from the list of base land prices and instructions of use, and the range of the base land price grades, the results of this renewal of base land prices also include the application methods, list of correction factors, the figured diagram of the grades of base land prices and other documents and materials, which shall be promulgated by the Municipal Bureau of Land and House Administration.
| | 三、本次基准地价更新成果除本通知印发的基准地价表及使用说明、基准地价级别范围外,还包括的应用方法、修正系数表、基准地价级别示意图等文件材料,由市国土房管局负责公布实施。

4.Prices for assignment and transfer of land plots shall be determined through reasonable evaluation methods by referring to the base land prices and according to the prescribed procedures. Among which, the prices for assignment shall be determined after the examination by the departments of land and house administration.
| | 四、宗地出让、转让价格需参照基准地价,按照规定的程序,使用合理的评估方法确定。其中,出让价格须经国土房管部门审核后确定。

5.This Circular shall come into force on December 10, 2002, and the Circular of the People's Government of Beijing Municipality on Promulgating the Base Land Prices for Assignment of the Right to the Use of State-owned land of Beijing Municipality (No.34 [1993] of the People's Government of Beijing Municipality) shall be repealed at the same time. The Municipal Bureau of Land and House Administration shall be responsible for coordinating and settling the concrete problems arising in the implementation.
