Interim Measures of Beijing Municipality for the Implementation of the Provisions on the Administrations of Intermediary Activities for Overseas Employment

北京市实施《境外就业中介管理规定》暂行办法

Chapter I General Provisions
 

第一章 总则


Article 1 In order to regulate the intermediary activities of overseas employment, to protect the legitimate rights and interests of the personnel under overseas employment, the present Measures are formulated in accordance with the Provisions on the Administration of Intermediary Activities for Overseas Employment (hereinafter referred to as the Provisions), combining with the actual situation of this Municipality.
   第一条 为规范境外就业中介活动,维护境外就业人员合法权益,根据劳动保障部、公安部、国家工商行政管理总局《境外就业中介管理规定》(以下简称《规定》),结合本市实际情况,制定本办法。
Article 2 The present Measures shall be applicable to the management of the institutions engaged in intermediary activities for overseas employment and the pertinent intermediary activities within the administrative area of this Municipality.
The term “overseas employment” mentioned in the present Measures refers to the employment for which a Chinese citizen enters into a contract with an overseas employer so as to provide labor abroad and obtain remunerations.
The term “ intermediary activities for overseas employment” as mentioned in the present Measures refers to the activities in which intermediary institutions provide relevant services for Chinese citizens to be employed abroad or for overseas employers to employ Chinese citizens to work abroad.
   第二条 本办法适用于在本市行政区域内从事境外就业中介的机构及相关中介活动的管理。
本办法所称境外就业,是指中国公民与境外雇主签订劳动合同,在境外提供劳动并获取劳动报酬的就业行为。
本办法所称境外就业中介,是指为中国公民境外就业或者为境外雇主在中国境内招聘中国公民到境外就业提供相关服务的活动。
Article 3 The intermediary activities for overseas employment shall be subject to the administrative license system. Without approval and registration, any entity or individual shall not be engaged in the intermediary activities for overseas employment.
Any of the overseas institutions, individuals and foreign institutions in China shall not be engaged in intermediary activities of overseas employment within China.
   第三条 境外就业中介实行行政许可制度。未经批准及登记注册,任何单位和个人不得从事境外就业中介活动。
境外机构、个人及外国驻华机构不得在中国境内从事境外就业中介活动。
Article 4 Beijing Labor and Social Security Bureau shall be responsible for the preliminary examination of the establishment of intermediary institutions for overseas employment and the management, supervision and check of the intermediary activities for overseas employment within the administrative area of the Municipality.
Beijing Public Security Bureau shall be responsible for the management of the order of exit and entry regarding the intermediary activities of overseas employment within the administrative area of this Municipality.
Beijing Administration for Industry and Commerce shall be responsible for the registration of intermediary institutions for overseas employment within the administrative area of this Municipality, the district or county administrations for industry and commerce shall be responsible for the supervision and management of the market order of the intermediary activities for overseas employment.
   第四条 北京市劳动保障局负责本市行政区域内境外就业中介机构设立的初审及境外就业中介活动的管理、监督和检查。
北京市公安局负责本市行政区域内境外就业中介活动出入境秩序的管理。
北京市工商行政管理局负责本市行政区域内境外就业中介机构的登记注册,区县工商分局负责境外就业中介活动市场秩序的监督管理。
Chapter II Establishment of Intermediary Institutions
 

第二章 中介机构的设立


Article 5 Where an applicant is to establish an institution to be engaged in intermediary activities for overseas employment, it shall meet the following requirements:
   第五条 申请人申请设立从事境外就业中介活动的机构(以下简称申请人)应当具备下列条件:
(1) It meets the requirements for establishing a legal person of enterprise;
 (一)符合企业法人设立的条件;
(2) It has no less than 5 employees, among whom, some shall be familiar with the labor security laws, regulations and policies and shall be full-time employee(s) with professional qualifications of law, foreign language and accounting;
 (二)有不少于5名的工作人员,其中应当具有熟悉我国和相关国家的劳动保障法律、法规、政策和具有法律、外语、财会专业资格的专职工作人员;
(3) It has a reserve fund of not less than 1,500,000 yuan;
 (三)备用金不低于150万元;
(4) It has well-established working system and institution and personnel management system;
 (四)有健全的工作制度和机构、人员管理制度;
(5) Other conditions as provided for by the laws and regulations.
 (五)法律、法规规定的其他条件。
Article 6 Before a new established intermediary institution for overseas employment files an application to Beijing Labor and Social Security Bureau, it shall go through the formalities for prior approval of enterprise name in Beijing Administration for Industry and Commerce.
   第六条 新设境外就业中介机构向北京市劳动保障局提出申请前,应当到北京市工商行政管理局办理企业名称预先核准登记。
Article 7 When establishing an intermediary institution for overseas employment, the applicant shall submit the following documents and certificates to Beijing Labor and Social Security Bureau:
   第七条 设立境外就业中介机构,应当向北京市劳动保障局提出申请并提交下列文件、证件:
(1) An application for the establishment of intermediary institution for overseas employment;
 (一)开办境外就业中介机构申请书;
(2) A completed Application Form for the Qualification of Intermediary Institution for Overseas Employment;
 (二)填写完整的《境外就业中介机构资格申请表》;
(3) The identity certifications, resumes and education backgrounds and relevant qualification certifications of the legal representative or the person chiefly in charge, and of the main staff members;
 (三)机构法定代表人、主要负责人、主要工作人员身份证明、简历、学历及相关的专业资格证明;
(4) The report on the verification of capital issued by a qualified capital verification agency;
 (四)具有法定资格的验资机构出具的验资报告;
(5) The articles of association;
 (五)机构章程;
(6) The institution's working rules, management rules and service rules;
 (六)机构工作制度、管理制度和服务规程;
(7) The report on the administrative area in which the intermediary activities for overseas employment are to be carried out and the feasibility study report;
 (七)拟开展境外就业中介活动的行政区域和可行性报告、工作方案、业务范围、收费办法说明;
(8) The sample contract to be concluded by the intermediary institution for overseas employment and overseas employees;
 (八)与境外就业人员签订的境外就业中介服务合同样本;
(9) The certification for the place of residence and business place (lease contract and real property certificate);
 (九)住所和经营场所使用证明(场地租赁合同、房地产证);
(10) The legal person business license and the notice of prior approval of enterprise name.
The above-mentioned materials shall be in triplicate, the “certificates” shall be original or copies.
 (十)企业法人营业执照或企业名称预先核准通知书。
以上材料应一式三份,材料中的证件应当提供原件和复印件。
Article 8 The Municipal Labor and Social Security Bureau shall examine the application materials jointly with the Municipal Public Security Bureau within 50 working days when an application is accepted, and shall conduct an inspection on the spot.
For an applicant who meets the requirements upon preliminary examination, the Municipal Labor and Social Security Bureau shall serve the applicant the Notice about Entering into Agreement on the Entrusted Supervision of Reserve Fund (hereinafter referred to as Notice). For an applicant who fails to meet the requirements, a written notice and explanations shall be given to it and the application materials shall be returned to it.
Within 7 days as of an applicant's receiving the Notice of the Municipal Labor and Social Security Bureau, the applicant shall reach an Agreement on the Entrusted Supervision of Reserve Fund with the Municipal Labor and Social Security Bureau, shall deposit adequate reserve fund into the special account (for overseas employment supervision reserve fund) of this intermediary institution in the commercial bank designated by the Municipal Labor and Social Security Bureau.
Within 5 working days as of receiving the voucher of the reserve fund paid by the applicant, the Municipal Labor and Social Security Bureau shall submit the application materials to the Ministry of Labor and Social Security for examination and approval. Upon examination and approval, the Ministry of Labor and Social Security shall send a copy to the Ministry of Public Security and shall issue the Overseas Employment Intermediary Institution Operation License (hereinafter referred to as Operation License) to the applicant.
Within 5 working days as of receiving the notice from the Municipal Labor and Social Security Bureau, the applicant shall get the Operation License in the Municipal Labor and Social Security Bureau.
An Operation License shall have 3 years of valid period from the day when it is issued.
   第八条 市劳动保障局自受理申请之日起50个工作日内,会同市公安局对申请材料进行审核,并进行实地核查。
经初步审查符合规定条件的,市劳动保障局向申请人送达《签订委托监管备用金协议通知书》(以下简称《通知书》)。不符合规定条件的,书面通知申请人,说明理由,并将申请材料退回。
申请人应当自接到市劳动保障局《通知书》之日起7个工作日内,与市劳动保障局签订《委托监管备用金协议》,并按照协议规定将足额备用金存入市劳动保障局指定的北京市商业银行中该境外就业中介机构的专门(境外就业备用金监管)账户。市劳动保障局收到申请人缴纳备用金的凭证后,应当在5个工作日内,将申请材料上报劳动保障部审批。劳动保障部审查批准并抄送公安部后,向申请人颁发境外就业中介机构经营许可证(以下简称经营许可证)。
申请人应当自接到市劳动保障局的通知之日起5个工作日内,到市劳动保障局领取经营许可证。
经营许可证自颁发之日起有效期为3年。
Article 9 Within 30 days of getting the Operation License, the applicant shall file an application to Beijing Administration for Industry and Commerce for the establishment or modification registration of legal-person enterprises, for which the operation items shall be uniformly determined as “intermediary and proxy services for overseas employment”.
Only after an enterprise has obtained the Operation License, it may carry out the above-mentioned business operations, and within 10 days from the day when the establishment or modification registration is approved, it shall report to the Municipal Labor and Security Bureau and the Municipal Public Security Bureau for archival purposes.
   第九条 申请人应当自领取经营许可证之日起30日内,到北京市工商行政管理局申请企业法人设立登记或者变更登记,其经营项目统一核定为“境外就业中介服务、代理服务”。
企业应当在领取营业执照后,开展上述经营活动,并应当于设立登记或者变更登记核准之日起10日内,向市劳动保障局和市公安局备案。
Chapter III Operation and Management of Intermediary Institutions
 

第三章 中介机构的经营和管理


Article 10 In accordance with the present Provisions, an intermediary institution for overseas employment may be engaged in the following businesses:
   第十条 境外就业中介机构依据《规定》可以从事下列业务:
(1) Providing Chinese citizens with overseas employment information and consultation;
 (一)为中国公民提供境外就业信息、咨询;
(2) Accepting the entrustment of overseas employers and recommending the personnel that meet their requirements;
 (二)接受境外雇主的委托,为其推荐所需招聘人员;
(3) Offering pre-exit training to the personnel under overseas employment, and assisting them in handling the notarization of relevant professional qualification certificates and other procedures;
 (三)为境外就业人员进行出境前培训,并协助其办理有关职业资格证书公证等手续;
(4) Assisting the personnel under overseas employment in handling the procedures and certificates such as passport, visa, notarization materials, physical examination, epidemic prevention injection, etc. as required in the exit;
 (四)协助境外就业人员办理出境所需护照、签证、公证材料、体检、防疫注射等手续和证件;
(5) Purchasing social insurance for the personnel under overseas employment;
 (五)为境外就业人员代办社会保险;
(6) Assisting the personnel under overseas employment in safeguarding their legitimate rights and interests through mediation, arbitration or litigation, etc.
 (六)协助境外就业人员通过调解、仲裁、诉讼等程序维护其合法权益。
Article 11 An intermediary institution for overseas employment shall carry out intermediary activities within the administrative area of Beijing Municipality.
Where an intermediary institution intends to establish a branch, it shall go through the formalities for examination and approval, registration and archives and shall deposit the reserve fund in accordance with the relevant requirements in Chapter II of the present Measures.
   第十一条 境外就业中介机构应当在北京市行政区域内开展中介活动。
境外就业中介机构设立分支机构的,应当按照本办法第二章的有关规定办理申请审批、登记和备案手续,并交存备用金。
Article 12 An intermediary institution for overseas employment shall perform the following obligations in compliance with the law:
