The "Measures for the Administration of Balloon Flying" are hereby promulgated, and shall come into force on February 1, 2005. The "Measures for the Administration of Balloon Flying" as promulgated by China Meteorological Bureau on June 6, 2003 shall be repealed simultaneously.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 These Measures are formulated in accordance with the "Regulation on the Control of General-Purpose Aviation Flight" and other relevant legal provisions and in light of the actual situation on the administration of balloon flying for the purpose of strengthening the administration of balloon flying activities, and guaranteeing the safety of aviation flight and the safety of people's lives and properties.
| | 第一条 为加强对施放气球活动的管理，保障航空飞行和人民生命财产安全，根据《通用航空飞行管制条例》及其他有关规定和施放气球管理工作的实际，制定本办法。

Article 2 Balloons as mentioned in these Measures shall include unmanned free balloons and captive balloons.
An unmanned free balloon shall refer to a freely drifting inflatable object which is driven with no power, is piloted by nobody, is lighter than air, and whose gross mass is more than 4 kilograms.
A captive balloon shall refer to an inflatable object lighter than air, which is tied to an object on the ground, and whose diameter is more than 1.8 meters or whose capacity is more than 3.2 cubic meters.
| | 第二条 本办法所称气球，包括无人驾驶自由气球和系留气球。
无人驾驶自由气球，是指无动力驱动、无人操纵、轻于空气、总质量大于4千克自由漂移的充气物体。
系留气球，是指系留于地面物体上、直径大于1.8米或者体积容量大于3.2立方米、轻于空气的充气物体。

Article 3 Those who carry out balloon flying activities inside the territory of the People's Republic of China shall abide by these Measures and other relevant legal provisions of the state.
Those who carry out balloon flying activities due to meteorological work shall be governed by the relevant legal provisions of the State Council's institution in charge of meteorology.
| | 第三条 在中华人民共和国境内从事施放气球活动，应当遵守本办法及国家其他有关规定。
因气象业务从事施放气球活动，按照国务院气象主管机构的有关规定执行。

Article 4 The State Council's institution in charge of meteorology and flight control administrative department, etc. shall, according to the division of their duties and functions, take charge of administering and guiding the national balloon flying activities.
The local institution in charge of meteorology and the flight control administrative department, etc. at each level shall, according to the division of their duties, take charge of administering the balloon flying activities within their own jurisdiction under the guidance and coordination of the local people's government.
| | 第四条 国务院气象主管机构及飞行管制等部门按照职责分工，负责管理和指导全国的施放气球活动。
地方各级气象主管机构及飞行管制等部门按照职责分工，在当地人民政府的指导和协调下，负责管理本行政区域内的施放气球活动。

Article 5 Whoever flies a balloon shall adhere to the principle of "safety first", and strictly implement the relevant technical criteria, standards and rules formulated by the state.
| | 第五条 从事施放气球活动，应当坚持安全第一的原则，严格执行国家制定的有关技术规范、标准和规程。

Chapter II Administration of Balloon Flying Entities
| | 第二章 施放气球单位的管理
|
Article 6 An eligibility accreditation system shall be adopted to balloon flying entities.
An entity that has not obtained a "Eligibility Certificate for Balloon Flying" in accordance with the legal provisions shall not carry out balloon flying activities.
| | 第六条 对施放气球单位实行资质认定制度。
未按规定取得《施放气球资质证》的单位不得从事施放气球活动。

Article 7 An entity that applies for flying balloons shall fulfill the following conditions:
| | 第七条 申请施放气球的单位应当具备下列条件：
|
(1) It has the status of an independent legal person;
| | （一）有独立的法人资格；
|
(2) It has a fixed work place, and its transport, use and deposit of dangerous gas must conform to the relevant legal provisions of the state;
| | （二）有固定的工作场所，危险气体的运输、使用和存放必须符合国家有关规定；
|
(3) It has 4 or more workers who have passed the examination held by the meteorology society at the provincial level or districted municipality level, and have obtained a "Qualification Certificate for Balloon Flying", among whom there shall be at least one person having the technical title at medium level or above in the relevant major;
| | （三）有4名以上经省级或者设区的市级气象学会考试合格并取得《施放气球资格证》的作业人员，其中至少有1名具有相关专业中级以上技术职称的人员；
|
(4) It has the necessary apparatus and equipment; and
| | （四）有必需的器材和设备；
|
(5) It has well-developed safety guaranty rules and measures.
| | （五）有健全的安全保障制度和措施。
|
Article 8 An entity engaging in balloon flying activities shall file a written application to the local institution in charge of meteorology at the districted municipality level or of the province, autonomous region, or municipality directly under the Central Government (hereinafter referred to as the accreditation institution), and shall provide the following application materials:
| | 第八条 从事施放气球活动的单位，应当向所在地的设区的市级或者省、自治区、直辖市气象主管机构（以下简称认定机构）提出书面申请，并提供下列申请材料：
|
(1) the "Application Form for the Eligibility Certificate for Balloon Flying";
| | （一）《施放气球资质证申请表》；
|
(2) the original and photocopy of its qualification certificate of legal person;
| | （二）法人资格证原件及复印件；
|
(3) the originals and photocopies of the form of registration of the staff, and of the qualification certificates of the relevant persons;
| | （三）人员登记表、有关人员资格证原件及复印件；
|
(4) a list of the apparatus and equipment required for flying balloons;
| | （四）施放气球的器材和设备清单；
|
(5) safety guaranty liability rules and measures;
| | （五）安全保障责任制度和措施；
|
(6) other materials prescribed in any law or regulation.
The accreditation institution shall, in accordance with Article 32 of the "Administrative License Law", decide on whether or not to accept the application, and issue a written document. If it decides not to accept the application, it shall state the reason therefor.
| | （六）法律、法规规定的其他材料。
认定机构应当根据《行政许可法》第三十二条的规定，决定受理或者不予受理申请，并出具书面凭证。不予受理申请的，应当说明理由。

Article 9 The accreditation institution shall, after accepting an application, appoint two or more working personnel to make an on-site check, where necessary.
| | 第九条 认定机构受理申请后，应当根据需要，指派两名以上工作人员进行现场核查。
|
Article 10 Where an applicant entity's application meets the legal conditions, the accreditation institution shall, within 20 days as of acceptance of the application, make a decision on administrative license, and shall, within 10 days as of making the decision, issue to the applicant entity an "Eligibility Certificate for Balloon Flying" affixed with the seal of the accreditation institution. If the accreditation institution is unable to make a decision within 20 days, it may, upon approval of the person-in-charge of the institution in charge of meteorology at the present level, extend the period by 10 days, and inform the applicant of the reasons for extending the period.
Where the accreditation institution legally makes a written decision on not granting the administrative license, it shall state the reason therefor, and inform applicant entity of the right to apply for administrative reconsideration or bring an administrative lawsuit in accordance with the law.
| | 第十条 申请单位的申请符合法定条件的，认定机构应当自受理申请之日起二十日内作出行政许可决定，自决定之日起十日内向申请单位颁发加盖认定机构印章的《施放气球资质证》。二十日内不能作出决定的，经本级气象主管机构负责人批准，可以延长十日，并将延长期限的理由告知申请人。
认定机构依法作出不予行政许可的书面决定的，应当说明理由，并告知申请单位依法享有申请行政复议或者提起行政诉讼的权利。

Article 11 The valid term of an "Eligibility Certificate for Balloon Flying" shall be 3 years, and an annual inspection system shall be adopted. An entity having obtained the eligibility shall, by the end of April each year, submit the information of the last year on balloon flying and other materials, including the "Eligibility Certificate for Balloon Flying" to the accreditation institution for examination and inspection. The entities failing to pass the annual inspection shall make rectifications within a time limit, and shall not engage in balloon flying activities during the period of rectification.
An entity having obtained the eligibility for flying balloons shall, 30 days before the expiry of the valid term, apply to the former accreditation institution for renewal of the valid term. The accreditation institution shall, upon application of the entity, decide, prior to the expiry of the valid term, on whether or not to approve the renewal.
| | 第十一条 《施放气球资质证》有效期为3年，并实行年检制度。取得资质的单位，应当在每年的4月底前将上一年度施放气球的情况及《施放气球资质证》等材料报认定机构审验。对年检不合格的单位，限期进行整改，整改期间不得从事施放气球活动。
取得施放气球资质的单位，应当在有效期届满三十日前向原认定机构申请延续。认定机构应当根据该单位的申请，在有效期届满前作出是否准予延续的决定。

Article 12 Where an entity having obtained the eligibility for balloon flying is under any of the following circumstances, its eligibility certificate shall be nullified by the accreditation institution:
