According to the Decision of the State Council on the Investment System, Notice of the General Office of the State Council on Preserving Some Non-administrative Licensing Examination and Approval Items and the Measures for the Administration of State Poverty Alleviation Funds and in order to regulate and intensify the administration of welfare-to-work, enhance the benefits from using the welfare-to-work fund, the Measures for State Welfare-to-work Administration have been specially formulated, and were adopted at the executive meeting of the director of the State Development and Reform Commission, and are hereby promulgated and shall come into force as of promulgation.

依据《国务院关于投资体制改革的决定》、《国务院办公厅关于保留部分非行政许可审批项目的通知》和《国家扶贫资金管理办法》,为了规范和加强以工代赈管理,提高以工代赈资金的使用效益,特制定《国家以工代赈管理办法》,经国家发展和改革委员会主任办公会讨论通过,现予发布,自发布之日施行。

国家以工代赈管理办法


Chapter I General Provisions
 

第一章 总则


Article 1 The present Measures are formulated according to the relevant requirements of the Decision of the State Council on the Investment System, Notice of the General Office of the State Council on Preserving Some Non-administrative Licensing Examination and Approval Items and the Measures for the Administration of State Poverty Alleviation Funds in order to regulate and intensify the welfare-to-work administration, enhance the benefits from using the welfare-to-work fund, improve the production and living conditions as well as the development environment of poverty-stricken rural areas and help poor farmers to get rid of poverty and become rich.
   第一条 根据《国务院关于投资体制改革的决定》、《国务院办公厅关于保留部分非行政许可审批项目的通知》和《国家扶贫资金管理办法》的有关要求,为了规范和加强以工代赈管理,提高以工代赈资金的使用效益,改善贫困农村生产生活条件和发展环境,帮助贫困农民脱贫致富,制定本办法。
Article 2 The term “welfare-to-work” refers to a supporting policy that the government invests in the construction of infrastructure projects, wherein a person who receives the relevant relief participates in the project construction to obtain the remuneration derived from labor services (hereinafter referred to as the remuneration) instead of direct relief. At the present time, welfare-to-work is a policy for rural poverty alleviation. The state involves welfare-to-work input in the construction of rural small-sized infrastructure projects, wherein poor farmers may participate in the construction of welfare-to-work projects and thus obtain remuneration so as to directly increase their income.
   第二条 以工代赈,是指政府投资建设基础设施工程,受赈济者参加工程建设获得劳务报酬,以此取代直接救济的一种扶持政策。现阶段,以工代赈是一项农村扶贫政策。国家安排以工代赈投入建设农村小型基础设施工程,贫困农民参加以工代赈工程建设,获得劳务报酬,直接增加收入。
Article 3 The welfare-to-work input is classified into in-kind input and capital input. The in-kind input shall be verified in the form of the capital exchanged by in-kind. The state welfare-to-work input shall be incorporated into the central fiscal budget. The corresponding welfare-to-work input at the local levels shall be incorporated into the local fiscal budget. For the welfare-to-work input, social input may be introduced thereinto through market mechanism so as to jointly support the development of the poverty-stricken regions.
   第三条 以工代赈投入分为实物投入和资金投入。实物投入以实物折资形式核算。国家以工代赈投入纳入中央财政预算,地方各级以工代赈配套投入纳入地方本级财政预算。以工代赈投入可以通过市场机制引导社会投入,共同支持贫困地区发展。
Article 4 The welfare-to-work input shall be applied to the supported areas as determined by the state and relevant priority shall be given to the old revolutionary base areas, ethnic minorities regions, frontier regions and extremely poverty-stricken areas with a large poor population, great difficulties to get rid of poverty as well as weak infrastructure. The welfare-to-work input for other relevant regions shall be arranged according to the relevant requirements of the state.
   第四条 以工代赈投入用于国家确定的扶持地区,并向贫困人口多、脱贫难度大、基础设施薄弱的革命老区、少数民族地区、边疆地区和特困地区倾斜。其他有关地区的以工代赈投入,按照国家有关要求安排。
Article 5 The welfare-to-work input shall be focused on the construction of rural small-sized infrastructure projects that promote the economic development of poor regions as well as help farmers to overcome poverty and achieve prosperity. The construction includes such contents as county, township or village roads, farmland water conservancy, drinking water construction projects for rural human and livestock, basic farmland, grassland construction and control of small river basins as well as other projects as required by the state for arrangement.
   第五条 以工代赈投入重点建设与贫困地区经济发展和农民脱贫致富相关的农村小型基础设施工程。建设内容是县乡村公路、农田水利、人畜饮水、基本农田、草场建设、小流域治理,以及根据国家要求安排的其他工程。
Article 6 The development and reform departments at all levels are the administrative departments in charge of welfare-to-work and shall bear the functions and duties of welfare-to-work administration.
   第六条 各级发展改革部门是以工代赈的行政主管部门,承担以工代赈工作的具体管理职责。
Chapter II Plan Administration
 

第二章 计划管理


Article 7 The planning for welfare-to-work construction shall be the base for welfare-to-work plans, including such basic contents as guiding opinions, construction objects, construction tasks, project planning, investment scale, capital funding, implementation steps and supporting measures.
   第七条 以工代赈建设规划是以工代赈计划的基本依据,基本内容包括指导思想、建设目标、建设任务、项目规划、投资规模、资金筹措、实施步骤、配套措施等。
Article 8 The local development and reform departments at all levels shall take charge of formulating the planning for welfare-to-work construction and shall, upon the approval of the people's government at the same level, incorporate it into the development planning for the national economy and society at its level and report it to the development and reform department at a higher level for archival filing.

   第八条 地方各级发展改革部门负责编制本级以工代赈建设规划,经本级人民政府批准后,纳入本级国民经济和社会发展规划,并报上级发展改革部门备案。
