Notice of the Ministry of Finance on Issuing the Regulation on Further Strengthening the Administration of the Reloaning of the Prepayment of Foreign Government Loans

The finance offices (bureaus) of all provinces, autonomous regions, autonomous regions, and municipalities directly under the Central Government, and cities under separate state planning, the Financial Bureau of Sinkiang Production and Construction Army Corps, and the Export-Import Bank of China:
In order to guarantee the safe use of the capital from prepayment of foreign government loans and strengthen the administration of the reloaning of the capital prepaid, we hereby print and distribute the Regulation on Further Strengthening the Administration of the Reloaning of the Prepayment of Foreign Government Loans to you for your compliance and implementation.

各省、自治区、直辖市、计划单列市财政厅（局）、新疆生产建设兵团财务局，中国进出口银行：
为确保外国政府贷款提前还款资金使用安全，加强对提前还款资金再转贷工作的管理，现将《关于进一步加强外国政府贷款提前还款资金再转贷管理的规定》印发给你们，请遵照执行。

Article 1 For the purpose of strengthening the administration of the reloaning of the prepayment of foreign government loans, improving the efficiency of capital utilization and guaranteeing the repayment of the principal and interest of the reloaned capital, the present Regulation is formulated in accordance with the relevant provisions of the State Council and the Measures for the Administration of Loans and Grants of International Financial Organizations and Foreign Governments (Order No. 38 of the Ministry of Finance), etc.
| | 第一条 为了加强外国政府贷款提前还款资金再转贷管理，提高资金使用效益，确保再转贷资金的还本付息，根据国务院有关规定和《国际金融组织和外国政府贷款赠款管理办法》（财政部令第38号）等，制定本规定。

Article 2 This Regulation applies to the reloaning of the prepayment of foreign government loans (hereinafter referred to as prepayment).
| | 第二条 本规定适用于外国政府贷款提前还款资金（以下简称提前还款资金）再转贷。

Article 3 The reloaning of the prepayment of foreign government loans (hereinafter referred to as reloaning) refers to the activity of the Export-Import Bank of China to reloan the foreign government loans that are not due but collected in advance to the finance departments at the provincial level.
The reloaning projects shall be administered as the projects of category I of foreign government loans.
| | 第三条 外国政府贷款提前还款资金再转贷（以下简称再转贷），是指由中国进出口银行将其未到期而提前收回的外国政府贷款资金再次转贷给省级财政部门的活动。
再转贷项目作为外国政府贷款一类项目进行管理。

Article 4 As the reloaning bank of the prepayment, the Export-Import Bank of China shall perform the following functions and duties according to law:
| | 第四条 中国进出口银行作为提前还款资金的转贷银行，依法履行以下职责：
|
(1) Concluding reloaning agreement with the borrower;
| | （一）与借款人签订再转贷协议；
|
(2) Handling the payment of the relevant capital; and
| | （二）办理相关资金的支付；
|
(3) Managing, supervising and checking the use of the prepayment and the operation of the reloaning projects.
| | （三）对再转贷资金使用和再转贷项目运行进行管理和监督检查。

Article 5 The finance offices (bureaus) of all provinces, autonomous regions, and municipalities directly under the Central Government and cities under separate state planning (hereinafter referred to as provincial finance departments), as the borrowers and the departments of management of the prepayment, shall be responsible for directly handling or organizing the reloaning of capital, debt repayment, risk prevention and other relevant work, and shall exercise management, supervision and check over the finance departments at the lower level and the project entities.
| | 第五条 各省、自治区、直辖市、计划单列市财政厅（局）（以下简称省级财政部门）作为提前还款资金的借款人和管理部门，负责直接办理或者组织资金转贷、债务偿还、风险防范等有关工作，对下级财政部门和项目单位进行管理和监督检查。

Article 6 A provincial finance department that plans to borrow the prepayment shall submit an application for borrowing and a Letter of Repayment Commitment to the Ministry of Finance.
