The Measures for the Reduction or Postponement of the Payment of Patent Fees, which have been formulated according to Article 98 of the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China, are hereby promulgated and shall come into force as of November 13, 2006.

根据《中华人民共和国专利法实施细则》第九十八条，制定《专利费用减缓办法》，现予以公布。该办法自二○○六年十一月十三日起施行。

Article 1 The present Measures are specially formulated according to the provisions of the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China and relevant documents.
| | 第一条 根据《中华人民共和国专利法实施细则》及有关文件规定，特制定本办法。
|
Article 2 Where an applicant or patent owner has any difficulty in paying the relevant patent fees, it/he may apply with the State Intellectual Property Office (hereinafter referred to as the SIPO) to reduce or postpone the repayment of relevant expenses according to the present Measures.
| | 第二条 申请人或者专利权人缴纳有关专利费用确有困难的，可以依照本办法请求国家知识产权局专利局（以下简称“专利局”）减缓缴纳有关费用。

Article 3 The following patent expenses may be reduced or postponed, subject to approval of the SIPO:
| | 第三条 经专利局批准，下列专利费用可以减缓：
|
(1) Application fees (wherein the printing expenses for publicity and application surcharges shall not be reduced or postponed);
| | 一、申请费（其中公布印刷费、申请附加费不予减缓）；
|
(2) Examinations fees for invention patents under application;
| | 二、发明专利申请审查费；
|
(3) Annual fees (within 3 years as of the year when the right of patent is authorized);
| | 三、年费（自授予专利权当年起三年内的年费）；
|
(4) Maintenance fees for invention patents under application; and
| | 四、发明专利申请维持费；
|
(5) Fees for review.
| | 五、复审费。
|
Article 4 Where an applicant or patent owner is an individual, he may apply for reducing or postponing the payment of 85 % the application fees, examination fees for invention patents under application and annual fees as well as 80% the maintenance fees for invention patents under application and fees for review.
．．．．．． | | 第四条 申请人或者专利权人为个人的，可以请求减缓缴纳85%的申请费、发明专利申请审查费和年费及80%的发明专利申请维持费和复审费。
申请人或者专利权人为单位的，可以请求减缓缴纳70%的申请费、发明专利申请审查费和年费及60%的发明专利申请维持费和复审费。
