Guiding Opinions of the People's Bank of China on Promoting the Development of the Business of Commercial Acceptance Bills

A commercial acceptance bill is a bill issued by a legal person or other organization, accepted by a non-bank payer, under which the payer shall unconditionally pay a determined amount to the payee or the holder on a designated date. A commercial acceptance bill is a credit payment instrument on the basis of commercial credit, and has the features such as the rights and obligations are clear, the date of payment can be agreed upon, the discount is negotiable, and so on. To extend the use of commercial acceptance bills helps to enrich the means of enterprise payment, and coordinate enterprises' production, supply and sale; it helps to alleviate inter-enterprise default of purchase prices, and maintain the normal and smooth commodity transaction order; it helps to promote the organic combination of the bank's credit with the enterprise's commercial credit, and alleviate the contradictions of difficult financing of medium and small enterprises; it helps to promote the conversion of commercial credit into bills, enrich the instruments in the bill market, and promote the development of the bill market; it also helps to establish and improve a good credit mechanism, to enhance social consciousness of credit, and to improve the social credit level.
In recent years, the business of commercial bills in China has been developed rapidly, and the scale of acceptance, discount and inter-bank discount of commercial bills have been enlarged continuously. The situation has played a positive role in facilitating settlement of enterprise payments, broadening enterprise financing avenues, and improving the quality of credit assets of commercial banks. However, among commercial bills, there is a prominent structural contradiction, that is, bank acceptance bills occupy an excessive large proportion while commercial acceptance bills occupy an excessive small proportion. In order to further improve the settlement efficiency of enterprises, adjust the category structure of commercial bills, lead and encourage the development of commercial credit, and exert the promoting function of commercial acceptance bills to the social and economic development, we hereby put forward the following opinions.

商业承兑汇票是法人以及其他组织签发的,银行以外的付款人承兑的,由付款人在指定日期无条件支付确定的金额给收款人或者持票人的票据。商业承兑汇票是建立在商业信用基础上的信用支付工具,具有权利义务明确、可约期付款、可转让贴现等特点。推广使用商业承兑汇票,有利于丰富企业支付手段,协调企业产供销关系;有利于缓解企业间货款拖欠,维护正常顺畅的商品交易秩序;有利于促进银行信用和企业商业信用的有机结合,缓解中小企业融资难的矛盾;有利于促进商业信用票据化,丰富票据市场工具,促进票据市场发展;有利于建立和完善良好的信用机制,增强社会信用意识,提高社会信用程度。
近年来,我国商业汇票业务获得了快速发展,商业汇票承兑、贴现、转贴现规模不断扩大,对便利企业支付结算、拓宽企业融资渠道、改善商业银行信贷资产质量等发挥了积极作用。但是,商业汇票中银行承兑汇票占比过高、商业承兑汇票占比过低的结构性矛盾比较突出。为进一步提高企业结算效率,调整商业汇票种类结构,引导和鼓励商业信用发展,发挥商业承兑汇票对社会经济发展的促进作用,现提出以下意见。
I.Mobilizing the initiative of all sectors, and building up a virtuous mechanism for effectively extending commercial acceptance bills.
The People's Bank of China shall organize commercial banks to make and extend specific implementation schemes on using commercial acceptance bills, select and encourage some enterprises with good credit standing and stable production, supply and sale, as well as issue, receive and transfer commercial acceptance bills in commodity transactions and labor service supply; it shall, by making key demonstrations and by fanning out from a point to an area, drive other enterprises to make wide use of commercial acceptance bills upon strength of the business of commercial acceptance bills between high-quality enterprises and their upstream or downstream enterprises; it shall, according to the macro-control policies and industrial development policies of the state, adjust measures to local conditions, and provide re-discount supports to the commercial acceptance bills issued to enterprises with good credit conditions; it shall create conditions, propel the establishment of a convenient inquiry platform for the business of commercial acceptance bills, and reduce the transaction cost for the business of commercial acceptance bills; it shall, in light of the principle of balancing cost, income and risk as well as helping to mobilize the initiatives of all sectors, research and probe into a reasonable price mechanism for promoting the development of the business of commercial acceptance bills.

   一、调动各方积极性,建立有效推广商业承兑汇票的良性机制。
人民银行要组织商业银行制定推广使用商业承兑汇票的具体实施方案,选择并鼓励一些资信状况良好、产供销关系比较稳定的企业,在商品交易和劳务供应中签发、收受、转让商业承兑汇票;通过重点示范、以点带面,以优质企业和上下游企业之间商业承兑汇票业务的开展,带动其他企业广泛使用商业承兑汇票;要根据国家宏观调控政策和产业发展政策,因地制宜,对信用状况良好的企业签发的商业承兑汇票给予再贴现支持;要创造条件,推动建立便捷的商业承兑汇票业务查询平台,降低商业承兑汇票业务的交易成本;要按照成本、收益和风险对称,有利于调动各方积极性的原则,研究探索促进商业承兑汇票业务发展的合理的价格机制。
商业银行要转变观念,创新商业承兑汇票业务的开展形式,发掘新的利润增长点,实现银企双赢;要继续探索建立票据专营机构,扩展和健全票据专营机构的业务范围,促进票据业务的专业化、集约化经营;大力推广银行信用助推企业商业信用的模式,探索保函业务、票据保证业务与商业承兑汇票业务的结合,采取对商业承兑汇票保证、保贴等形式,提高商业承兑汇票信用保障程度;做好对商业承兑汇票的授信工作,对信用状况良好的企业签发的商业承兑汇票给予贴现支持。
