INTERIM PROCEDURES FOR EXPORT COMMODITIES CONTROL
(Approved by the State Council on December 21, 1992 and issued by Order No. 4 of the Ministry of Foreign Economic Relations and Trade on December 29, 1992)
The following interim procedures are enacted according to international trade practice to meet the need of the development of a socialist market economy, to strengthen macro-control on exports, to promote shifting of managerial mechanism of businesses, and to speed up the expansion of foreign trade.

为适应社会主义市场经济发展的需要，加强出口宏观管理，促进企业转换经营机制，加快对外贸易发展，参照国际贸易惯例，特制订以下出口商品管理暂行办法：
|
1. Export Commodities Under Control of State Quota License.
These are mainly the following export commodities: bulk exports of resources that are of importance to national economy and people's livelihood and the bulk export of traditional products that accounted for a great portion in China's total exports; key commodities that have dominant effect on the whole or specific markets of the world and goods with quotas imposed by foreign countries or by China's own initiative under requests of foreign countries; commodities that are exported in huge quantities but would easily lead to mess in export; important brand-name, top-quality, or special local products, and those having to meet other specific conditions in export. There are 138 varieties of export commodities under quota licensing control (a list of them attached at the end). As the reform deepens, the number of export commodities under quota licensing control will gradually be reduced.
| | 一、国家实行配额许可证管理的出口商品范围
实行配额许可证管理的出口商品主要是：关系国计民生的大宗资源性出口商品及在我出口中占有重要地位的大宗传统出口商品；我在国际市场或某一市场占主导地位的重要商品，国外对我有配额或要求我主动限制出口数量的商品；出口额大且易于引起经营秩序混乱的商品，重要的名、优、特出口商品，或有特殊要求的出口商品。实行配额许可证管理的出口商品共138种（目录附后）。随着改革的深化，今后实行配额许可证管理的出口商品将逐步减少。

(1) Under planned quota control are 38 varieties of bulk exports of resources that have a great bearing on the national economy and people's livelihood and bulk traditional exports that are accounted for a great portion in China's total exports, the quotas of which in a year will be notified by the Ministry of Foreign Economic Relations and Trade (MOFERT) to all provinces, autonomous regions,municipalities directly under the Central Government, and cities handling their own development plans (hereafter referred to as "all localities), as well as foreign trade (industry and trade) corporations under various central department (hereafter referred to as "foreign trade companies of various departments~)for execution.
| | （一）对关系国计民生的大宗资源性出口商品以及在我国出口中占有重要地位的大宗传统出口商品，实行计划配额管理，品种为38种。每年出口数量确定后，由经贸部下达到各省、自治区、直辖市和计划单列市（以下简称各地方）及中央各部门所属外贸（工贸）总公司（以下简称各部门外贸公司）具体执行。

(2) 54 varieties of China's key export commodities that have dominant effect on the whole or specific markets in the world or that foreign countries request China to restrict their export amount are under quota control, in which 31 are exported to far overseas areas and 23 are to Hong Kong and Macao. Each year as soon as the quotas of the goods are fixed by MOFERT according to domestic and foreign market conditions and after soliciting the opinions of the related importers and exporters associations, all localities and foreign trade companies of various departments will be notified for fulfilling the quotas in principle.
| | （二）我在国际市场或某一市场上占主导地位的重要出口商品、外国要求我主动限制的出口商品，实行主动配额管理，品种为54种，其中远洋地区配额商品为31种，港澳地区配额商品为23种。每年出口数量由经贸部根据国内外市场情况征求有关进出口商会意见确定，原则上分配到各地方和各部门外贸公司执行。

(3) 22 varieties of key brand-name, top-quality and special local products, products exported in great amounts but would easily lead to mess in export, and a few other exports needed to be put under control are put under general export licensing control. Their varieties would be readjusted each year according to circumstances. In general, the exports of which are restricted in amount in a year but efforts are to be paid to keep the export in order.
| | （三）出口金额大且经营秩序易于混乱和重要的名、优、特出口商品以及少数确需管理的商品，实行一般许可管理，列入出口许可证管理商品范围，品种为22种。每年将根据情况调整品种。每年出口数量原则上不限制，着重是管理经营秩序。

(4) Foreign countries have imposed quotas on 24 varieties of Chinese exports which are put under passive quota control. The amounts of these exports will be fixed according to bilateral agreements. The allotment procedures will be enacted separately.
| | （四）国外对我有配额的24种出口商品，继续实行被动配额管理，每年出口数量按双边协议执行。分配办法另行制定。

(5) Quotas for export commodities produced by FFEs that come under quota control shall be fixed according to the contracts concerned.
| | （五）对外商投资企业生产出口的属配额许可证管理的商品，按立项时批准的合同安排出口配额。

2. Export License Control
| | 二、出口许可证管理
|
(1) All export commodities which are imposed of planned quotas or quotas on China's own initiative or are under general export licensing control shall come under export licensing, totaling 114 varieties.
| | （一）计划配额、主动配额和一般许可管理的出口商品都实行出口许可证管理。出口许可证管理商品的品种共114种。
|
(2) For commodities which are imposed of planned quotas and quotas on China's own initiative, licenses shall be issued according to plans and quota amounts. Licenses issued for export commodities under general export licensing control shall in principle not restrict their amounts. If changes in the world in the world or domestic market require any restriction, MOFERT shall notify the license-issuing offices of the requirement in advance.
| | （二）计划配额、主动配额出口商品按计划和配额数量发证；一般许可管理的出口商品发证数量原则上不限，如国际、国内市场情况变化需限制时，由经贸部提前通知发证机构执行。

(3) MOFERT shall enact procedures for license control and exercise macro-control and total amount control. Local foreign economic relations and trade departments and specially-appointed offices shall be in charge of issuing licenses for general export license control commodities.
| | （三）经贸部制定许可证管理办法，实行宏观管理和总量控制，一般发证商品发证的事务性工作主要放到地方经贸管理部门和特派员办事处。

(4) For part of the export licensing control commodities, issuing of licenses will be made bidding under the charge of the importers and exports associations on trial basis. 1. Export licenses shall be issued by the license-issuing offices to the bid winners according to the amount and prices set in the bids, and be executed under the supervision of the foreign economic relations and trade departments. More and more commodities under general license control will be put on biddings for their export quotas.
| | （四）对部分许可证管理商品发证试行招标办法，由进出口商会主持招标，发证机关在已确定的配额内按企业中标数量和价格核发出口许可证。经贸管理部门监督合同的执行。试行招标的配额许可证管理商品范围，将逐步扩大。

3. The management of export commodities.
| | 三、出口商品经营管理
|
(1) 16 kinds of specially important export commodities under planned quotas shall be jointly managed by State organizations under the unified and concrete management of MOFERT.
| | （一）计划配额商品中的十六种特别重要出口商品，由国家组织统一联合经营。具体由经贸部组织实施。
|
(2) Besides the above 16 kinds of commodities, the other export commodities under quota licensing shall be allotted to the management by successful enterprises in export or businesses that have obtained the right to export those commodities by foreign economic relations and trade departments of all provinces, autonomous regions, municipalities directly under the Central Government and cities handling their own development plans. (MOFERT shall be responsible for the allotment to foreign trade corporation of various departments according to their merit in export or management). Apart from these, trade in all other export commodities can be managed by foreign trade enterprises approved by the State.
