Notice of the Supreme People's Court on Properly Handling Mass Administrative Cases
(No.316 [2006] of the Supreme People's Court)
The higher people's courts of all provinces, autonomous regions, municipalities directly under the Central Government, the Production and Construction Corps branch court of the Higher People's Court of Xinjiang Uygur Autonomous Region:
With the deepening of reform, the social benefit pattern becomes more diversified and complex with each passing day, administrative disputes tend to increase, especially, the mass administrative disputes evoked by such hot social issues as rural land expropriation, demolishment of urban houses, enterprise restructuring, labor and social security and environmental protection of resources, etc, attract more attention. It matters much to the people's vital interests and social harmony and stability to properly handle mass administrative cases, and the people's courts at all levels shall attach great importance to it. Therefore, we hereby notify the relevant issues concerning properly handling mass administrative cases as follows:

各省、自治区、直辖市高级人民法院,新疆维吾尔自治区高级人民法院生产建设兵团分院:
随着改革的深入,社会利益格局日益多元化和复杂化,行政争议呈现增多的趋势,特别是由农村土地征收、城市房屋拆迁、企业改制、劳动和社会保障、资源环保等社会热点问题引发的群体性行政争议较为突出。依法妥善处理好群体性行政案件,关系到人民群众的切身利益,关系到社会的和谐稳定,必须引起各级人民法院的高度重视。为此,特就妥善处理群体性行政案件的有关事项通知如下:
1. Fully understanding the significance of properly handling mass administrative disputes. We shall, under the guidance of the Decision on Several Major Issues Concerning the Construction of Socialist Harmonious Society made at the 6th plenary session of the 16th Central Committee, earnestly study the Opinions of the General Office of the Central Committee of the Communist Party of China and the General Office of the State Council on Preventing and Solving Administrative Disputes and Improving the Administrative Dispute Resolution Mechanism and the spirit of the speech delivered by Xiao Yang, the president of the Supreme People's Court, at the video teleconference of the courts across the whole nation on strengthening administrative trial and properly handling administrative disputes so as to clearly see the rigorous situation that mass administrative disputes increase with each passing day, be fully aware of the significance of properly handling mass administrative disputes, firmly build up the socialist philosophy of ruling by law, accurately define the roles of people's courts in safeguarding social harmony and stability, effectively increase the sense of responsibility and sense of mission and properly handle mass administrative cases according to law.
   一、充分认识妥善处理群体性行政争议的重要性。要以党的十六届六中全会《关于构建社会主义和谐社会若干重大问题的决定》为指导,认真学习中共中央办公厅、国务院办公厅《关于预防和化解行政争议,健全行政争议解决机制的意见》和肖扬院长在全国法院加强行政审判工作,妥善处理行政争议电视电话会议的重要讲话精神,认清当前群体性行政争议日趋增多的严峻形势,充分认识妥善处理群体性行政争议的重要意义,牢固树立社会主义的法治理念,准确定位人民法院在维护社会和谐稳定中的作用,切实增强责任感和使命感,依法妥善处理好群体性行政案件。
2. Attaching great importance to the registration and acceptance work of mass administrative cases. As for a mass administrative dispute brought to the court, if it satisfies the statutory conditions for commencing an action, the court shall register and accept the case according to law in a timely manner and may not close the door on it; if it fails to satisfy the statutory conditions for commencing an action or it does not fall within the jurisdiction of the court, before the handling of the case according to law, the court shall explain the reasons to the plaintiff, inform the plaintiff of the channels for solving the dispute according to law and, in light of the specific situation, notify the relevant departments to do a good job in stabilizing and controlling the situation; as for the political and policy-oriented disputes, in case it is difficult to simply solve them by way of administrative litigation, we shall treat and handle them in a prudent manner and do the best to solve them through the uniform coordination of the local Party committees and governments; the major and complex mass cases that involve large number of people and satisfy the conditions for putting a case on file may be accepted by the intermediate people's courts or the appointed grass-root people's courts. In light of different circumstances, the separable mass cases may be put on record and accepted separately. The case filing divisions and administrative divisions of the people's courts of various levels shall strengthen communication and closely cooperate with each other in the link of registration and acceptance.

   二、高度重视群体性行政案件的立案受理工作。对于起诉到法院的群体性行政争议,符合法定起诉条件的,应当依法及时立案受理,不得拒之门外;对于不符合起诉条件的,或者不属于法院主管的问题,在依法作出处理前,应当向起诉人说明原因,告知其依法解决问题的途径,并视情况通知有关部门做好稳控工作;对于政治性、政策性强,难以单纯通过行政诉讼解决问题的争议,要慎重对待和处理,尽可能通过当地党委、政府统一协调解决;对于人数众多、重大复杂、符合立案条件的群体性案件,可以由中级人民法院受理,也可以指定其他基层人民法院受理。要根据案件的不同情况,对于可分的群体性案件,可以分别立案受理。各级人民法院的立案庭和行政庭在立案受理环节上要加强沟通,密切配合。
