The higher people's courts of all provinces, autonomous regions and municipalities directly under the Central Government, the Military Court of the PLA, and the Xinjiang Production and Construction Corps Branch of the Higher People's Court of Xinjiang Uigur Autonomous Region,
The Guiding Opinions on Further Conducting Well the Trial of Cases of Real Estate Disputes under the Present Situation are hereby printed and distributed to you. Please implement them effectively by taking into account the local actualities.

Guiding Opinions on Further Conducting Well the Trial of Cases of Real Estate Disputes under the Present Situation
At present, to stabilize the real estate market and ensure the sound development of the real estate industry are a significant decision of arrangement made by the Party and state for purposes of responding to the impact of the international financial crisis and promoting the steady and rapid development of the economy. To give full play to the functional roles of the people's courts in the trial work and earnestly conduct well the trial of cases of real estate disputes are a must for the people's courts to serve the major objectives and serve the people in respect of justice. The people's courts at all levels should deeply apprehend the significance of conducting well the trial of cases of disputes over real estate under the present situation, accurately grasp the objective changes of the macro economic situation, properly try the real estate cases by applying the approaches which stress both the principles and the flexibility within the frame as prescribed by law and policies of the state, so as to provide strong judicial guarantee for the major objectives of the state, namely, “ensuring growth, ensuring people's wellbeing and ensuring stability”. You are hereby given the following guiding opinions on conducting well the trial of cases of real estate disputes:

现将最高人民法院《关于当前形势下进一步做好房地产纠纷案件审判工作的指导意见》印发给你们,请结合当地实际,认真贯彻落实。

关于当前形势下进一步做好房地产纠纷案件审判工作的指导意见
当前,稳定房地产市场,保障房地产业的健康发展,是党和国家应对国际金融危机影响,促进经济平稳较快发展的重大决策部署。充分发挥人民法院的审判职能作用,切实做好房地产纠纷案件审判工作,是人民法院为大局服务、为人民司法的必然要求。各级人民法院要深刻认识当前形势下做好房地产纠纷案件审判工作的重要意义,准确把握宏观经济形势发生的客观变化,在法律和国家政策规定框架内,适用原则性和灵活性相统一的方法,妥善审理房地产案件,为国家“保增长、保民生、保稳定”的工作大局提供强有力的司法保障。现就做好房地产纠纷案件的审判工作,提出如下指导意见。

1. To earnestly maintain the market of transfer of the right to use the state-owned land. You should, under the Real Right Law, Contract Law, Law on Urban Real Estate Administration and other laws, as well as the Interpretations of the Supreme People's Court on Issues Regarding the Application of Law to Cases of Disputes over Contracts Involving the Right to Use State-owned Land, try your best to maintain the validity of the land use right transfer contracts, protect the lawful rights and interests of the party honoring the contract, and promote the steady development of the market of transfer of the right to use the state-owned land.
   一、切实依法维护国有土地使用权出让市场。要依照物权法合同法城市房地产管理法等法律及最高人民法院《关于审理涉及国有土地使用权合同纠纷案件适用法律问题的解释》的规定,尽可能维持土地使用权出让合同效力,依法保护守约方的合法权益,促进土地使用权出让市场的平稳发展。
2. To earnestly protect the market of transfer of the right to use the state-owned land. You should correctly understand the provisions of the Urban Real Estate Administration Law and other laws and administrative regulations regarding the conditions for the transfer of the land use right, accurately apprehend the principle on distinguishing the validity of real rights from the validity of contracts, endeavor to maintain the validity of contracts and promote the normal turnover of the land use rights.

   二、切实依法维护国有土地使用权转让市场。要正确理解城市房地产管理法等法律、行政法规关于土地使用权转让条件的规定,准确把握物权效力与合同效力的区分原则,尽可能维持合同效力,促进土地使用权的正常流转。
