The Measures for the Implementation of the Regulation on Land Survey, which were deliberated and adopted at the 9th executive meeting of the Ministry of Land and Resources on May 31, 2009, are hereby promulgated and shall come into force as of the date of promulgation.

Chapter I General Provisions
| | 第一章 总则
|
Article 1 To ensure the effective implementation of land surveys, these Measures are formulated in accordance with the Regulation on Land Survey (hereinafter referred to as the Regulation).
| | 第一条 为保证土地调查的有效实施，根据《土地调查条例》（以下简称条例），制定本办法。
|
Article 2 The term “land survey” refers to the survey, monitoring, calculation and analysis of the natural attributes, namely, the type, location, acreage and distribution of land, and the social attributes, namely, land ownership, etc., and the changes thereof, as well as the status of basic farmland.
| | 第二条 土地调查是指对土地的地类、位置、面积、分布等自然属性和土地权属等社会属性及其变化情况，以及基本农田状况进行的调查、监测、统计、分析的活动。

Article 3 Land surveys include national land surveys, land change surveys and special land surveys.
The term “national land survey” refers to all-round surveys of various categories of urban and rural land throughout the country conducted by the state for purposes of promoting the national economic and social development.
The term “land change survey” refers to surveys of urban and village land cadastre changes and surveys of land use changes conducted at any time on the basis of the national land survey and in light of the urban and rural land use status quo and the ownership changes, and the regular summarization and statistical analysis of relevant data.
The term “special land surveys” refers to the special surveys of special objects within a certain scope and a certain time depending on the needs in the administration of land and resources, including surveys of arable land resources in reserve, dynamic remote sensing monitoring of land use, survey and demarcation of boundaries, etc.
| | 第三条 土地调查包括全国土地调查、土地变更调查和土地专项调查。
全国土地调查，是指国家根据国民经济和社会发展需要，对全国城乡各类土地进行的全面调查。
土地变更调查，是指在全国土地调查的基础上，根据城乡土地利用现状及权属变化情况，随时进行城镇和村庄地籍变更调查和土地利用变更调查，并定期进行汇总统计。
土地专项调查，是指根据国土资源管理需要，在特定范围、特定时间内对特定对象进行的专门调查，包括耕地后备资源调查、土地利用动态遥感监测和勘测定界等。

Article 4 National land surveys shall be uniformly organized by the leading group of the State Council for national land surveys and be implemented by the leading groups of the people's governments at and above the county level for land survey under relevant requirements.
Land change surveys shall be organized by the Ministry of Land and Resources together with other relevant departments and be implemented by the land and resources administrative departments together with other relevant departments at and above the county level.
Special land surveys shall be organized and implemented by the land and resources administrative departments at and above the county level.
| | 第四条 全国土地调查，由国务院全国土地调查领导小组统一组织，县级以上人民政府土地调查领导小组遵照要求实施。
土地变更调查，由国土资源部会同有关部门组织，县级以上国土资源行政主管部门会同有关部门实施。
土地专项调查，由县级以上国土资源行政主管部门组织实施。

Article 5 A local land and resources administrative department at or above the county level shall, in accordance with the Regulation, assist the public finance department at the same level to ensure the necessary operating funds of the local people's government for land survey. Where necessary, it may, jointly with the public finance department at the same level, formulate administrative measures for disbursing the land survey operating funds out of land proceeds, such as the fees for the paid use of land for newly added for construction purposes, and income from the paid transfer of the right to use state-owned land.
| | 第五条 县级以上地方国土资源行政主管部门应当配合同级财政部门，根据条例规定落实地方人民政府土地调查所需经费。必要时，可以与同级财政部门共同制定土地调查经费从新增建设用地土地有偿使用费、国有土地使用权有偿出让收入等土地收益中列支的管理办法。

Article 6 The relevant land and resources administrative departments shall, under the provisions of the state, commend or give awards to those entities and individuals who have made outstanding contributions in land surveys.
| | 第六条 在土地调查工作中作出突出贡献的单位和个人，由有关国土资源行政主管部门按照国家规定给予表彰或者奖励。

Chapter II Land Survey Institutions and Personnel
| | 第二章 土地调查机构及人员
|
Article 7 The office of the leading group of the State Council for national land surveys shall be set up in the Ministry of Land and Resources. The office of the leading group of a local people's government at or above the county level for land survey shall be set up in the land and resources administrative department at the same level.
A land and resources administrative department at or above the county level shall designate an office and personnel to take charge of the concrete work on land change surveys, special land surveys, etc.
| | 第七条 国务院全国土地调查领导小组办公室设在国土资源部，县级以上地方人民政府土地调查领导小组办公室设在同级国土资源行政主管部门。
县级以上国土资源行政主管部门应当明确专门机构和人员，具体负责土地变更调查和土地专项调查等工作。

Article 8 Land surveyors include the functionaries of the land and resources administrative departments and other relevant departments at and above the county level, personnel of relevant public institutions, as well as personnel of the entities undertaking land survey tasks.
| | 第八条 土地调查人员包括县级以上国土资源行政主管部门和相关部门的工作人员，有关事业单位的人员以及承担土地调查任务单位的人员。
|
Article 9 A land surveyor shall accept the professional trainings organized by the land and resources administrative departments at or above the province level, pass the national uniform evaluation of land surveyors and obtain a land surveyor's certificate.
A person who has already obtained a land registration agent qualification certificate jointly issued by the Ministry of Land and Resources and Ministry of Human Resources and Social Security may directly apply for a land surveyor's certificate.
The land surveyor's certificates shall be uniformly made and issued by the Ministry of Land and Resources and be subject to the uniform numbering management under relevant provisions.
| | 第九条 土地调查人员应当经过省级以上国土资源行政主管部门组织的业务培训，通过全国统一的土地调查人员考核，领取土地调查员工作证。
已取得国土资源部、人力资源和社会保障部联合颁发的土地登记代理人资格证书的人员，可以直接申请取得土地调查员工作证。
土地调查员工作证由国土资源部统一制发，按照规定统一编号管理。

Article 10 To undertake a national land survey, an entity shall conform to the provisions of Article 13 of the Regulation and meet the following requirements:
| | 第十条 承担国家级土地调查任务的单位，应当符合条例第十三条的规定，并具备以下条件：
|
1. Having land survey projects with the aggregate contractual amount of 10 million yuan during the recent 3 years, which are determined as qualified upon check by the land and resources administrative department at or above the county level;
| | （一）近三年内有累计合同额1000万元以上，经县级以上国土资源行政主管部门验收合格的土地调查项目；
|
2. Having a specialized quality inspection department and full-time quality inspectors, and having sound and efficient rules for ensuring the quality of land survey results;
| | （二）有专门的质量检验机构和专职质量检验人员，有完善有效的土地调查成果质量保证制度；
|
3. Having no record of bad quality of land survey results during the recent three years;
| | （三）近三年内无土地调查成果质量不良记录；
|
4. Having at least 20 technicians who have obtained a land surveyor work certificate; and
| | （四）取得土地调查员工作证的技术人员不少于20名；
|
5. Other requirements as prescribed in the rules, regulations and regulatory documents of the Ministry of Land and Resources.
| | （五）国土资源部规章、规范性文件规定的其他条件。

Article 11 To apply for being included in the directories of state-level land survey entities, an entity shall file an application with the Ministry of Land and Resources. If the applicant meets the provisions of Articles 13 of the Regulation and Article 10 of these Measures, it shall be listed in the directories of national land survey entities and be published as such.
