The Decision of the Standing Committee of the National People's Congress on Amendment to the Reserve Officers Law of the People's Republic of China, which was adopted at the 16th meeting of the Standing Committee of the 11th National People's Congress of the People's Republic of China on August 28, 2010, is hereby issued, and shall come into force on the date of issuance.

It is decided at the 16th meeting of the Standing Committee of the 11th National People's Congress to amend the Reserve Officers Law of the People's Republic of China as follows:

《全国人民代表大会常务委员会关于修改<中华人民共和国预备役军官法>的决定》已由中华人民共和国第十一届全国人民代表大会常务委员会第十六次会议于2010年8月28日通过,现予公布,自公布之日起施行。

全国人民代表大会常务委员会关于修改《中华人民共和国预备役军官法》的决定
(2010年8月28日第十一届全国人民代表大会常务委员会第十六次会议通过)
第十一届全国人民代表大会常务委员会第十六次会议决定对《中华人民共和国预备役军官法》作如下修改:
1. One article shall be added as Article 3: “Reserve officers are an important part of the reserve forces for national defense and a major source of complements to active officers.
“Reserve officers shall fulfill the obligations conferred by law on them and have the status and honor commensurate with the obligations. The state protects the legitimate rights and interests of and treatments to reserve officers.”
   一、增加一条,作为第三条:“预备役军官是国防后备力量的重要组成部分,是战时补充现役军官的主要来源之一。
“预备役军官履行法律赋予的职责,享有与其职责相应的地位和荣誉。国家依法保障预备役军官的合法权益和相应待遇。”
2. Article 3 shall be changed into Article 4 with Paragraph 1 being amended as: “Reserve officers, by the nature of the positions they hold, shall be classified into operational officers, political officers, logistics officers, equipment officers and specialized technical officers.” Hence, Paragraph 1 of Article 14, Item 1, Paragraph 1 of Article 20 and Paragraph 2 of Article 21 shall be amended accordingly.
   二、将第三条改为第四条,第一款修改为:“预备役军官按照职务性质分为军事军官、政治军官、后勤军官、装备军官和专业技术军官。”根据本条的修改,对第十四条第一款、第二十条第一款第一项、第二十一条第二款作相应修改。
3. Article 4 shall be changed into Article 5 with Paragraph 2 being amended as: “The political departments of the military commands, provincial military commands (including garrison commands) and military sub-commands (including garrison commands) shall be responsible for the administration of reserve officers in their respective regions. The political departments of the army forces shall be responsible for the administration of reserve officers in their respective forces.”
   三、将第四条改为第五条,第二款修改为:“军区、省军区(卫戍区、警备区)、军分区(警备区)政治部负责本区域的预备役军官管理工作。军兵种政治部负责军兵种部队预备役军官的有关管理工作。”
4. One article shall be added as Article 7: “The General Political Department of the People's Liberation Army, the political departments of the military commands, the political departments of provincial military commands (including garrison commands), the political departments of military sub-commands (including garrison commands) and the county people's armed forces shall, together with the relevant governmental departments, set up the joint meeting system for reserve officers for military and civil services, hold joint meetings attended by the military and local departments, the local reserve forces and active forces pre-regimented with reserve officers on a regular basis, and make concerted efforts to solve the problems about reserve officers. Under special circumstances, a meeting can be convened on short notice.
“For matters decided at a joint meeting, the military and local departments shall handle them within their respective scopes of duties.”
   四、增加一条,作为第七条:“人民解放军总政治部、军区政治部、省军区(卫戍区、警备区)政治部、军分区(警备区)政治部和县人民武装部会同有关政府部门,建立健全军地预备役军官工作联席会议制度,定期召开军队和地方有关部门、当地预备役部队和预编预备役军官的现役部队参加的联席会议,协调解决预备役军官工作中的有关问题。有特殊需要时,可以临时召集会议。
“联席会议议定的事项,军队和地方有关部门应当按照各自的职责办理。”
5. Article 8 shall be deleted.
   五、删除第八条。
6. Article 9 shall be changed into Article 10 with Paragraph 2 being amended as: “Entities and individuals that make outstanding contributions in the work on reserve officers shall be honored or rewarded pursuant to the relevant provisions.”
   六、将第九条改为第十条,第二款修改为:“对在预备役军官工作中做出突出成绩的单位和个人,依照有关规定给予表彰或者奖励。”
7. The name of Chapter II shall be changed into “Conditions, Sources and Selection of Reserve Officers”.
   七、将第二章章名修改为“预备役军官的条件、来源和选拔”。
8. Article 10 shall be changed into Article 12 and be amended as: “Reserve officers shall be selected from:
“(1) Military and civil officers retired from active service;
“(2) Soldiers retired from active service;
“(3) Full-time officers of the people's armed forces and the people's militias;
“(4) Graduates from ordinary institutions of higher learning;
“(5) Specialized technical personnel of the non-military departments; and
“(6) Other citizens who meet the basic requirements for reserve officers.”
   八、将第十条改为第十二条,修改为:“预备役军官从下列人员中选拔:
“(一)退出现役的军官和文职干部;
“(二)退出现役的士兵;
“(三)专职人民武装干部和民兵干部;
“(四)普通高等学校毕业学生;
“(五)非军事部门的专业技术人员;
“(六)符合预备役军官基本条件的其他公民。”
9. Article 13 shall be changed into Article 14, and Item 2 of Paragraph 2 shall be amended as: “Candidates for reserve officers of Class One shall be examined and approved jointly by the reserve forces or active forces concerned and the county people's armed forces, while candidates for reserve officers of Class Two shall be examined and approved by the county people's armed forces.”
   九、将第十三条改为第十四条,第二款第二项修改为:“选拔服第一类军官预备役的,由有关预备役部队或者现役部队会同县人民武装部共同审核确认人选,选拔服第二类军官预备役的,由县人民武装部审核确认人选”。
10. One article shall be added as Article 20: “The state applies the system of military ranks to reserve officers.
“The military ranks to reserve officers are titles or symbols of the class and identity of reserve officers and honors conferred by the state to reserve officers.”
   十、增加一条,作为第二十条:“国家实行预备役军官军衔制度。
“预备役军官军衔是区分预备役军官等级、表明预备役军官身份的称号、标志和国家给予预备役军官的荣誉。”
11. One article shall be added as Article 24: “During the period when reserve officers have military trainings or perform military duties, those with higher military ranks shall be the superiors of those with lower military ranks; if a reserve officer with a higher rank is subordinate to a reserve officer with a lower rank in terms of official position, the one with a higher position shall be the superior.”

   十一、增加一条,作为第二十四条:“预备役军官参加军事训练、执行军事勤务期间,军衔高的预备役军官为军衔低的预备役军官的上级;军衔高的预备役军官在职务上隶属于军衔低的预备役军官的,职务高的为上级。”
