The Military Service Law of the People's Republic of China, as revised and adopted at the 30th Session of the Standing Committee of the Thirteenth National People's Congress of the People's Republic of China on August 20, 2021, is hereby issued, and shall come into force on October 1, 2021. 中华人民共和国兵役法》已由中华人民共和国第十三届全国人民代表大会常务委员会第三十次会议于2021年8月20日修订通过,现予公布,自2021年10月1日起施行。

Military Service Law of the People's Republic of China 中华人民共和国兵役法

Chapter I General Provisions 

第一章 总  则

Article 1 For the purposes of regulating and strengthening the military service work of the state, ensuring that citizens perform military service in accordance with the law, safeguarding the replenishment and reserve of members of the armed forces, and developing and consolidating national defense and powerful armed forces, this Law is enacted in accordance with the Constitution.   第一条 为了规范和加强国家兵役工作,保证公民依法服兵役,保障军队兵员补充和储备,建设巩固国防和强大军队,根据宪法,制定本法。
Article 2 Defending the motherland and resisting aggression shall be a sacred duty of every citizen of the People's Republic of China.   第二条 保卫祖国、抵抗侵略是中华人民共和国每一个公民的神圣职责。
Article 3 The People's Republic of China shall implement a military service system that combines volunteer military service with conscript military service but is mainly based on volunteer military service.   第三条 中华人民共和国实行以志愿兵役为主体的志愿兵役与义务兵役相结合的兵役制度。
Article 4 The military service shall adhere to the leadership of the Communist Party of China, implement Xi Jinping's thought on strengthening the armed forces, implement the military strategy for the new era, adhere to coordination with the state's economic and social development, adhere to compatibility with the development of national defense and the armed forces, and follow the principles of serving the needs of national defense, focusing on preparations for war and combat, demonstrating the honor to serve in the military, and showing the consistency between rights and obligations.   第四条 兵役工作坚持中国共产党的领导,贯彻习近平强军思想,贯彻新时代军事战略方针,坚持与国家经济社会发展相协调,坚持与国防和军队建设相适应,遵循服从国防需要、聚焦备战打仗、彰显服役光荣、体现权利和义务一致的原则。
Article 5 All citizens of the People's Republic of China shall have the obligation to perform military service under this Law, regardless of ethnicity, race, occupation, family background, religious belief, and education.   第五条 中华人民共和国公民,不分民族、种族、职业、家庭出身、宗教信仰和教育程度,都有义务依照本法的规定服兵役。
Citizens unfit for performing military service because of their serious physical defects or serious disabilities shall be exempt from military service. 有严重生理缺陷或者严重残疾不适合服兵役的公民,免服兵役。
Citizens deprived of political rights by law shall not serve in the military. 依照法律被剥夺政治权利的公民,不得服兵役。
Article 6 The military service shall have an active component and a reserve component. Those serving on active duty in the Chinese People's Liberation Army are referred to as active-duty service members; those pre-assigned to active forces or assigned to reserve forces to serve on reserve duty are referred to as reservists.   第六条 兵役分为现役和预备役。在中国人民解放军服现役的称军人;预编到现役部队或者编入预备役部队服预备役的,称预备役人员。
Article 7 Active-duty service members and reservists must abide by the Constitution and laws, and perform their obligations as citizens while enjoying their rights as citizens; and their rights and obligations resulting from performing military service shall be specified by this Law and other relevant laws and regulations.   第七条 军人和预备役人员,必须遵守宪法和法律,履行公民的义务,同时享有公民的权利;由于服兵役而产生的权利和义务,由本法和其他相关法律法规规定。
Article 8 Active-duty service members must abide by the doctrines and regulations of the armed forces, faithfully discharge their duties, and always be ready to fight for the defense of the motherland.   第八条 军人必须遵守军队的条令和条例,忠于职守,随时为保卫祖国而战斗。
Reservists must participate in military training, perform duties of combat readiness support, and execute missions in non-war military operations according to the relevant provisions, and always be ready to be called up to fight for the defense of the motherland. 预备役人员必须按照规定参加军事训练、担负战备勤务、执行非战争军事行动任务,随时准备应召参战,保卫祖国。
Active-duty service members and reservists shall take a military oath in accordance with the law when they join the military. 军人和预备役人员入役时应当依法进行服役宣誓。
Article 9 The Ministry of National Defense shall be responsible for the military service work across the country under the leadership of the State Council and the Central Military Commission.   第九条 全国的兵役工作,在国务院、中央军事委员会领导下,由国防部负责。
The provincial military commands (capital defense command and garrison commands), the military sub-commands (garrison commands), and the departments of people's armed forces of counties, autonomous counties, non-districted cities, and municipal districts shall concurrently act as the military service authorities of the people's governments at the same level, and be responsible for the military service work in their respective administrative regions under the leadership of military authorities at a higher level and the people's governments at the same level. 省军区(卫戍区、警备区)、军分区(警备区)和县、自治县、不设区的市、市辖区的人民武装部,兼各该级人民政府的兵役机关,在上级军事机关和同级人民政府领导下,负责办理本行政区域的兵役工作。
Government authorities, social groups, enterprises, public organizations, and the people's governments of townships, ethnic townships, and towns shall complete their military service work in accordance with the provisions of this Law. The operations of military service work shall be conducted by the department of people's armed forces if an entity has such department, or by a department designated by the entity if it has no such department. A regular institution of higher learning shall have a body responsible for military service work. 机关、团体、企业事业组织和乡、民族乡、镇的人民政府,依照本法的规定完成兵役工作任务。兵役工作业务,在设有人民武装部的单位,由人民武装部办理;不设人民武装部的单位,确定一个部门办理。普通高等学校应当有负责兵役工作的机构。
Article 10 The military service authorities of the local people's governments at or above the county level shall, in conjunction with the relevant departments, strengthen the organization, coordination, and supervisory inspection of the military service work within their respective administrative regions.   第十条 县级以上地方人民政府兵役机关应当会同相关部门,加强对本行政区域内兵役工作的组织协调和监督检查。
The local people's governments at or above the county level and the military authorities at the same level shall include the military service work in the contents of assessment of the awards for “supporting the armed forces and providing preferential treatment for military family members” and “supporting the government and loving the people” and the assessment and evaluation of the relevant entities and the persons in charge thereof. 县级以上地方人民政府和同级军事机关应当将兵役工作情况作为拥军优属、拥政爱民评比和有关单位及其负责人考核评价的内容。
Article 11 The state shall strengthen the information technology development of military service work, take effective measures to achieve the information sharing among relevant departments, and advance the modernization of technology for the collection, processing, transmission, and storage, among others, of information on military service, so as to support the improvement of quality and efficiency of military service work.   第十一条 国家加强兵役工作信息化建设,采取有效措施实现有关部门之间信息共享,推进兵役信息收集、处理、传输、存储等技术的现代化,为提高兵役工作质量效益提供支持。
The departments related to military service work and their staff members shall strictly keep the personal information collected confidential, and shall not divulge or illegally provide it to any other person. 兵役工作有关部门及其工作人员应当对收集的个人信息严格保密,不得泄露或者向他人非法提供。
Article 12 The state shall take measures to strengthen the publicity and education on military service, raise citizens' awareness of performing military service in accordance with the law, and create a favorable social atmosphere of taking pride in the performance of military service.   第十二条 国家采取措施,加强兵役宣传教育,增强公民依法服兵役意识,营造服役光荣的良好社会氛围。
Article 13 Active-duty service members and reservists who have distinguished themselves by outstanding meritorious service shall be commended and rewarded in accordance with the provisions issued by the state and the armed forces on outstanding meritorious service, honor and commendation.   第十三条 军人和预备役人员建立功勋的,按照国家和军队关于功勋荣誉表彰的规定予以褒奖。
Organizations and individuals who have made outstanding contributions to military service work shall be commended and rewarded in accordance with the relevant provisions issued by the state and the armed forces. 组织和个人在兵役工作中作出突出贡献的,按照国家和军队有关规定予以表彰和奖励。
Chapter II Military Service Registration 

第二章 兵役登记

Article 14 The state shall implement a military service registration system. Military service registration shall include initial military service registration and reserve service registration.   第十四条 国家实行兵役登记制度。兵役登记包括初次兵役登记和预备役登记。
Article 15 All male citizens who have attained the age of 18 by December 31 each year shall undergo initial military service registration in the year according to the arrangements of military service authorities.   第十五条 每年十二月三十一日以前年满十八周岁的男性公民,都应当按照兵役机关的安排在当年进行初次兵役登记。
Government authorities, social groups, enterprises, public organizations, and the people's governments of townships, ethnic townships, and towns shall, according to the arrangements of the military service authorities of the people's governments of counties, autonomous counties, non-districted cities, or municipal districts, be responsible for organizing the initial military service registration of male citizens meeting the age limit within the entities or their respective administrative regions. 机关、团体、企业事业组织和乡、民族乡、镇的人民政府,应当根据县、自治县、不设区的市、市辖区人民政府兵役机关的安排,负责组织本单位和本行政区域的适龄男性公民进行初次兵役登记。
The initial military service registration may be conducted in the form of online registration or be conducted on the spot at a military service registration station (or point). In military service registration, personal information shall be entered truthfully. 初次兵役登记可以采取网络登记的方式进行,也可以到兵役登记站(点)现场登记。进行兵役登记,应当如实填写个人信息。
Article 16 Citizens who have not performed active service after initial military service registration and meet the conditions for reserve service may be registered for reserve service by the military service authority of the people's government of a county, autonomous county, non-districted city, or municipal district as needed.   第十六条 经过初次兵役登记的未服现役的公民,符合预备役条件的,县、自治县、不设区的市、市辖区人民政府兵役机关可以根据需要,对其进行预备役登记。
Article 17 An enlisted member separated from active duty shall, within 40 days of separation from active duty, or a commissioned officer separated from active duty shall, within 30 days of determination of the place of resettlement, undergo military service registration information modification at the military service authority of the people's government of the county, autonomous county, non-districted city, or municipal district where the separated service member is resettled; and if the separated service member meets the conditions for reserve service, undergo reserve service registration as needed upon determination by the military unit.   第十七条 退出现役的士兵自退出现役之日起四十日内,退出现役的军官自确定安置地之日起三十日内,到安置地县、自治县、不设区的市、市辖区人民政府兵役机关进行兵役登记信息变更;其中,符合预备役条件,经部队确定需要办理预备役登记的,还应当办理预备役登记。
Article 18 The military service authorities of the local people's governments at or above the county level shall be responsible for the military service registration work within their respective administrative areas.   第十八条 县级以上地方人民政府兵役机关负责本行政区域兵役登记工作。
The military service authorities of the people's governments of counties, autonomous counties, non-districted cities, and municipal districts shall organize annual verification of military service registration information, and check the military service registration status of citizens in conjunction with relevant departments, so as to ensure the timeliness of military service registration and the accuracy and completeness of information. 县、自治县、不设区的市、市辖区人民政府兵役机关每年组织兵役登记信息核验,会同有关部门对公民兵役登记情况进行查验,确保兵役登记及时,信息准确完整。
Chapter III Enlistment in Peacetime 

第三章 平时征集

Article 19 The number of new enlisted members for active service, frequency of enlistment, time of enlistment, and requirements for enlistment each year shall be prescribed by order of the State Council and the Central Military Commission.   第十九条 全国每年征集服现役的士兵的人数、次数、时间和要求,由国务院和中央军事委员会的命令规定。
